Although I have all the inclination in the world to do what may be acceptable to your Grace yet I can by no means think it proper for me to advise her Majesty to grant your request as to the ship Peter Francis and her cargo: and I easily persuade myself when your Grace has read the enclosed representation you will be of the same opinion. |
Appending: representation dated March 12 by J. Taylour of the state of the Prizes and Perquisites of Admiralty with respect to any gifts or grants which may be desired thereout. By a privy seal of 1 Anne [see supra, Calendar of Treasury Books, Vol. XVIII, p. 114, under date 20 Jan. 1702–3] the Queen declared that all her Majesty's share of prizes should be applied to the service of the war and the Lord High Admiral has by deed resigned all the Rights and Perquisites of Admiralty to the same uses. The House of Commons in March 1707[–8] addressed the Queen to give satisfaction (out of her Majesty's said moiety) to the owners and freighters of the Worcester for damage sustained, which on reference have been assessed at above 19,000l. There has been already directed near 8,000l. [for the said Worcester owners] out of the said Queen's moiety and there still remains due 11,225l. for which daily and almost continual application is made by great numbers of poor people and nothing left for their satisfaction (since the Act [6 Anne, c. 64 cl. 2] for giving all prizes to the captors) but the Perquisites of Admiralty. It is therefore submitted whether it is advisable to grant or apply any part thereof [of said Perquisites] to any other uses than the satisfaction of the persons concerned in the said ship Worcester. I have yours of the 1st inst. with your observations on the late Tack of the Customs “which indeed is the fullest state I have yet had of that matter.” I gave directions a good while ago for raising a process against the Farmers upon the suggestions that had been given to the Parliament
last session of their having broken their contracts: and I am informed by letters from the Lord Advocate and the Barons of the Exchequer [of Scotland] that a Bill is filed and the cause will come on next term. I thank you for the trouble you have taken to inform me of the true state of the matter.
