Same to the Lord Chief Baron [of the Exchequer Court in Scotland]. I shall not be able to send your Lordship's new commission till the method of passing warrants relating to Scotland is adjusted, which I think will be in a very few days. As to the poor on the Charity Roll a warrant is prepared for 850l. for one year from the Union to the 1st of May 1708 but as no perfect list of them is exhibited here
[in London] the Lord Treasurer has directed the issue of that money to Sir David Nairne to be by him forwarded to her Majesty's Almoner at Edinburgh, for the greater ease and despatch of that matter. The same is to be paid and distributed by said Almoner according to such list as shall be allowed and approved of by your Lordship and any two of the other Barons of the Exchequer Scotland. As soon as same has been paid please send a list of the names to the Lord Treasurer England in order to be laid before the Queen. If you think any other method more proper to be used for the future please intimate the same. |
The Lord Treasurer has also signed a warrant for the usual charity to be distributed to the poor at Edinburgh on her next birthday now coming. |
I know of no money that has been imprested for payment of salaries for which there were precepts from the late Lords of the Treasury [Scotland]. I am sorry you meet with so much difficulty in adjusting the matters relating to the Equivalent. But 'tis I believe no more than was expected. As soon as the deficiencies of the year 1707 are stated you will please to give my Lord Treasurer an account thereof. His Lordship would be glad to know from time to time what is done about calling to account the late tacksmen of the Customs, so that if Parliament make any inquiry as to same they may receive a satisfactory answer. Treasury reference to the Surveyor General of Crown Lands of the petition of Mary Goldsmith setting forth her being undone by the fire at Windsor which burned eight stables, a large barn and part of two dwelling houses to the value of 360l.; that the stables were her sole dependence, the late Prince's horses standing there ever since he came to England: therefore praying a grant of the old buildings near the waterside in Eton which for some years past have lain waste. Same to the Principal Officers of the Mint of the petition of Robert Millar, Clerk to the Mint at Edinburgh, shewing that the Privy Council of Scotland, when settling the order and method of the recoinage [of Scotch moneys in 1707] appointed Mr. Rutherford, Mr. Bruce and Mr. Brown as Commissioners for taking in the money from the Bank by weight and tale, overseeing the melting and certifying the deficiency. Subsequently (upon particular application from the Bank) petitioner was adjoined to them for overseeing the said tale and weight and to sign with them the declarations to the Bank of the receipt thereof into the Mint. Now that all is melted the said three Commissioners have applied for their remuneration without taking notice of petitioner. Therefore prays consideration for his pains and trouble, his salary as Clerk of the Mint being but 40l. per an. by which he is narrowly subsisted. In your memorial of the 10th inst. you represent that the clothiers who furnished her Majesty's Forces borne upon the Establishment of Spain and Catalonia anno 1706 are still a considerable sum in arrear by reason that great part of the moneys granted for those Forces out of which the offreckonings should have been paid was applied in Spain by direction of the Commander in Chief there to answer several extraordinary services of the war for which [extraordinary services] no provision has been yet made by Parliament except the sum of 7,631l. 16s. 8d. voted by the House of Commons as above. This sum is directed to you this day as above. You are to assign [to the clothiers] the tallies and orders for the said loans, and interest is to commence thereon from the day of making the same [the said assignments] to the said clothiers towards satisfying what is due to them for [out of] the said offreckonings “the said clothiers first entering into the same agreement with you about these tallies as the clothiers have done to whom like tallies have been lately delivered.” Disposition Book XIX, p. 254. |

William Lowndes to Consul Cole at Algiers. Application has been made to Treasurer Godolphin relating to the prize St. John Baptist taken by three English letters-of-mart men and carried into the port of Algiers, to wit that such part of the goods of the said prize as are looked upon to be unvendible there may at the proprietor's own pleasure be shipped to Leghorn or any other port. The Lord Treasurer referred the matter to Mr. Baker, one of the late Commissioners for Prizes, who thinks the request reasonable provided the goods be first appraised on oath and that the usually adjudged Admiralty perquisite of one tenth (both of what is sold at Algiers and what is so exported) be remitted to her Majesty's Exchequer. Same to same enclosing the report of the Customs Commissioners of England on the query supra, p. 43, concerning the charging of seizures: the Scottish Commissioners of Customs having by their letter of Sept. 30 last [to the Lord Treasurer] desired to be informed how a clause in the Act of the last Session for charging seizures [to wit clause 12 of the Act 6 Anne c. 73] is to be construed with reference to the Queen's moiety and the officers' proportion. |
Appending: said report dated Jan. 21 inst. The practice on the Act of last session in question, pursuant to a late order in the Exchequer Court is that all French goods (to which only this clause
is supposed to relate) being seized are to be appraised at their full value including the Duties and after condemnation the Duties to be paid and the remainder of the appraisement to be divided between the Queen and the officer; and when the appraisal falls short of the Duties the goods are to be sold to the best advantage and the produce to be applied by the collector towards the payment of the several Duties on such goods proportionately. But although this method of paying Duties for goods seized has been formerly much desired by this Board [the Customs Commissioners in England] to prevent collusive seizures yet the Duties on French goods being so very high it may so happen that the moiety of the value remaining after the Duties paid instead of affording any encouragement to the officer for seizing will not answer the charge of prosecution.
