The Attorney & Solicitor General are of opinion that there is no probability of success if they should question the validity of Maryot's lease upon the objections stated in the said paper: and they are also of opinion that it is not advisable to move the Court of Exchequer to delay the decree. If the Bank of England will advance the sum of 20000l. upon a deposit of Land Tax tallies anno 1708 [to be deposited] by Sir Thomas Littleton [as security for the said loan to him] for the service of the Navy my Lord agrees that the same shall be repaid to them out of the fifth payment to be made by the East India Company on or before the 12th January next together with interest at 5 per cent. |

Likewise my Lord agrees that if the Bank will advance 9500l. on a deposit of Malt or Land Tax tallies in the hands of the Paymaster General of Guards & Garrisons anno 1708 the same shall be repaid to them out of the abovesaid fifth payment. Ibid., p. 264. |

[In the Disposition Book this minute is expressed as a letter of direction as follows “His Lordship also desires [that] upon the unsatisfied order in the name of Thomas Micklethwayte, Treasurer & Paymaster for the Transports, for the service of his Office the sum of 40000l. may be issued out of loans to be made by the said Micklethwayte on credit of Malt Duties

[The gentlemen of the Bank communicate to my Lord the text of a minute of their Court as follows.] At a Court of Directors of the Bank the 10th Nov 1908 ordered that the sum of 12335l. 14. 5 be advanced to my Lord Treasurer on a deposit of tallies on the Subsidies of 5 Anne; with [condition of] my Lord Treasurer's minute to be obtained for repayment of the same in money with interest at the rate of 6 per cent in 4 months from the making the said loan. |
