November 17. Letter of direction for 3000l. to John Tailer, deputy to the Surveyor General of Crown Lands: out of Civil List moneys: and is in further part of his [third] order for 20,000l. for building at Woodstock [for the Duke of Marlborough]. Disposition Book XIX, p. 69.
William Lowndes to the Attorney General enclosing the report [missing] from the Agents for Taxes relating to prosecutions against the collectors and inhabitants of several parishes in co. Surrey for supers of 363l. 18s. 0d. set on them in the accounts of Nuthald and Child, late Receivers General for same. By their direction one Lucas, a surveyor of said Duties, received part thereof. Royal warrant dated St. James's to the Attorney or Solicitor General for a great seal for a new Commission of Prizes, the new Commissioners to be John Evelyn, Thomas Baker, Sir Thomas Skipworth, Mathew Barton and Charles Killigrew in place of Anthony Duncomb, John Evelyn, Thomas Baker, Nicholas Pollexfen and Fleetwood Dormer, whose commission is hereby determined. Petition to the House of Commons from several merchants of Scotland setting forth the facts relating to their importations into England after the date of the Treaty of Union of goods imported into Scotland and owned by them there before the said date; and the seizure thereof made in England with the arrangements made with the Attorney General in order to a trial etc. ut supra pp. 369, 415; all which the petitioners conceive is contrary to the Articles of Union. [This petition was presented to the House on the 19th November and is abstracted in the Journals Vol. XV, p. 435. The note of the papers therewith as follows is not printed in the Journals.]
Prefixing: a note of the several papers relating to the proceedings about goods brought from Scotland since May 1 last.
1. A representation from the Customs Commissioners dated 26 April 1707 that the Queen's learned Counsel might be consulted what directions were to be given concerning foreign goods imported into Scotland before the Union and brought from thence after the 1st May 1707.
2. The Lord Treasurer's order of reference 29 April 1707 to the Attorney General and Solicitor General on a paper containing several queries made by the Customs Commissioners about merchandise from Scotland.
3. The report dated 5 May from the Queen's counsel thereupon; and the Lord Treasurer's warrant dated 6 May to the Customs Commissioners pursuant to the said'report.
4. A petition of several Scotch merchants to the Queen in Council setting forth that they had brought divers quantities of their effects in wines etc. from Scotland by permits, which [effects] were seized; and praying her Majesty to give directions for the unloading and delivery thereof.
5. Her Majesty's order in Council dated 21 July referring the said petition to the Lord Treasurer.
6. The Lord Treasurer's order transmitting the said petition to the Customs Commissioners; and their report thereon, together with a certificate of the warehousekeeper concerning cellars for the said wines.
7. The Lord Treasurer's report dated 28 July to the Queen in Council [thereon].
8. Her Majesty's order thereupon to the Attorney and Solicitor General to call the parties concerned before them and endeavour to settle such a method of proceedings as might be most expeditious for bringing the matter to an easy and proper determination.
9. A report from the Attorney General and Solicitor General to my Lord Treasurer dated 18 August of their proceedings upon the said order of Council.
10. A warrant from my Lord Treasurer to the Customs Commissioners dated 19 August (made upon the said [No. 9] report) for the delivery of the goods contained in a list thereto annexed in the method agreed upon between the said Attorney and Solicitor General and the parties concerned.
11. Another warrant from the Lord Treasurer dated 8 September to the Customs Commissioners (upon a verbal representation from the Attorney General that other ships were arrived or might arrive with goods under like circumstances) directing them to govern themselves as to these goods in like manner as to what was contained in the ships named in the list appended to the Lord Treasurer's former warrant of 19 August.
Followed by: a tabular statement giving an abstract of brandy, wines etc., imported into England from the respective ports, detailed, of North Britain as above. [In this statement the list of ships is practically identical with that supra p. 415 under date August 19 but the present statement contains details of their ladings]. Treasury reference to the Victualling Commissioners of the petition of the merchants of London, owners of several ships which are lett [by them for hire] into the Victualling service to Lisbon and Jamaica, setting forth the great disappointment and discouragement they are under in not having convoys for their ships for many months after the time they are to be ready under their contracts with the Victualling; having no allowance for demurrage; and the bills that have been delivered them towards that service are at 20 per cent. discount, carrying no interest as other Victualling bills do: therefore praying allowance of demurrage and interest. Warrant by Treasurer Godolphin to Sir Robert Cotton and Sir Thomas Frankland, the Postmasters General, to pay to Edmund Dummer the money due at October 25 last on his contract for the West India pacquet service without any abatement or deduction. Warrants not Relating to Money XX, p. 88.

Warrant by Treasurer Godolphin to Rowland Holt, Comptroller General of the Accounts of the Customs, to observe such rules and instructions from time to time as he shall receive from the Customs Commissioners relating to the General Accounts of the Customs: the Lord Treasurer thinking it highly conducive to the public service that all possible care and despatch should be used in the framing, making up, adjusting, keeping and passing of the said General Accounts. If greater trouble or charge result therefrom to the said Comptroller, consideration shall be had thereof. Out Letters (Customs) XV, p. 71.
November 22. William Lowndes to the Commissioners of Transports to pay 116l. 10s. 2d. to Edmund Dummer upon his contract for transporting 22 men of Col. Handasyde's Regiment to the West Indies. Disposition Book XIX, p. 71.
J. Taylour to the Customs Commissioners [England] to report on the petition of Mr. Wallace et al. as follows.
Appending: Supplication to the Queen from James Wallace and Robert Sinclair, supercargo and master of the ship Industry of Leith, with concourse of the merchants of Glasgow, owners thereof, shewing that by casualties of wind etc. they could not bring their brandies to Scotland before May 1; an advice boat was therefore sent with orders to discharge her from landing in Scotland but the same storm which drove the ship into the mouth of the Clyde prevented the advice boat from reaching the ship. Thereupon the ship and cargo were seized by Sir John Shaw of Greenock. On a trial in the Exchequer we superseded defence rather on the legal ground that we had our clearance from a lawful port and had not broken bulk nor touched ground in Scotland (being resolved with the first fair wind to carry the cargo to some foreign port) or upon ground of misfortune and ignorance but chose rather to throw ourselves on your Majesty's compassion. All the time of our ship's clearance and going off we were altogether ignorant of the laws of England which after the 1st of May because the laws of Scotland. We have not been in the least blamed for embezzlement and in time coming we for ever resolve to observe the laws according to the strictest rules of a regular and fair trade and the total loss of our ship would be ruinous to our poor families. November 24. Allowance by Thomas Godolphin of the incidents bill, detailed, of the Prize Office for half a year to June 24 last: total 1129l. 7s. 10d. Money Book XIX, p. 114.
Letter of direction for 198l. to Charles Dartiquenave, Paymaster of the Works: out of Civil List moneys: to be paid over to Michael Studholme, Surveyor of her Majesty's Roads, for repairing the road between Hyde Park Gate and Kensington House Gate, containing 510 foot in length, 28 foot in breadth and 2½ foot thick. J. Taylour (in the absence of William Lowndes) to the Customs Commissioners enclosing the proposal from the East India Company relating to the bond for the Herbert galley. The Lord Treasurer thinks this may be an expedient as to that ship only and is in hopes that before the Company have occasion to send out any more ships the law may be so explained as that there may no further difficulties arise for the future in relation to the bonds to be given for any East India ships.
Appending: Note of said proposal. “The Court of Managers for the United East India Company have granted licence to Capt. Richard Chadsley, Commander of the Herbert galley, to carry out for himself and mariners 230l. in foreign bullion; to Mr, William Salladine and Mr. Richard Wilmer, two of their supercargoes, 200l. in foreign bullion and to Mr. Gabriel Reau third supercargo 40l. in foreign bullion. The Court of Managers are content to give security in 10,000l. for their own goods and that the Capt. and the others should give security for what [is] licenced them.” Out Letters (General) XVIII, p. 370.
William Lowndes to Mr. Whitfeild, Paymaster of the Marines, to report on the enclosed petition [missing] of the Master, Wardens and Society of the Art and Mystery of Apothecaries, London, praying payment of 280l. due to them for medicines delivered on shore at Gibraltar for the use of the Garrison and of the detachment of Marines left there by the directions of Sir George Rooke, the Admiral. Warrant by Treasurer Godolphin to the Customs Commissioners to give 6 months leave to Samuell Cox, one of the Commissioners for the Four and a Half per cent. Duty, to come to England for his health, leaving Thomas Beckles in his place.

Treasury reference to the Victualling Commissioners of the petition of Samuel Shepheard, junr., of London, merchant, shewing that he has contracted with the Navy Board to furnish with wine, oil and other provisions her Majesty's ships that should [happen to] come to Leghorn or Genoa, but his bills amounting to 5670l. 6s. 0d for that service, drawn on the Victualling Commissioners, are not paid, the Commissioners alleging they have no money to satisfy the same: therefore praying that money may be directed for that service and that interest may be allowed till date of payment. November 24. Treasury reference to the Customs Commissioners of the petition of Nath. Hunt and Francis Moult, executors of Richard Hunt who in 1691 was surety for John Clerk, collector of Customs at Boston in Lincolnshire, who died in 1702 [indebted to the Crown] and petitioners are now prosecuted on said Richard's bond though he died in 1694 and they have distributed his estate. Royal warrant dated Kensington to John How, Paymaster General of Guards and Garrisons, to pay 225l. to Gregory King, Secretary to the Office of Comptrollers of Army Accounts, for salaries of his clerks etc. and office rent and incidents for last September 29 quarter: being the sum which would have incurred and become payable to the said Comptrollers for the said purposes (under the royal sign manual of 1703 September 17 supra Treasury Calendar, vol. XVIII, p. 406) in case the said Office had not been vacant as it is now and has been for some time but the business thereof has none the less been attended by the secretary and clerks and officers and it is necessary that same should be paid notwithstanding the said vacancy. Same to John Howe, Paymaster of Guards and Garrisons, to pay 7000l. for the present year to 24 December 1707 “or to or for any former year or years” for the maintenance and support of the pensioners of Chelsea College: the Queen being informed that the fund set apart for the support of said Hospital, and for the pensioners commonly called outpensioners qualified to be provided for therein, does fall short of answering the said charge by reason of the great number of non-commissioned Officers and soldiers who in this time of war by wounds etc. are certified as qualified and accordingly admitted to pensions there; and her Majesty being desirous that such indigent and disabled persons should be under no streights or necessities for want of such pensions or rewards as they are qualified to receive by means of such certificates and admissions: nevertheless the Queen's intention is that the said 7000l. hereby directed to be applied in aid of the fund appointed for said Hospital and pensioners shall be accounted as paid out of the savings by respits or otherwise on the Establishment of the Guards and Garrisons for this or any former year or years. William Lowndes to the Navy Commissioners. When the Russia merchants attended the Lord Treasurer on the 19th inst. on the subject of their petition (which had been sent to you) touching their contract with you for 2400 tons of hemp, his Lordship told them they ought to comply with their contracts and that he would enquire what equitable considerations might be had of their losses. November 29. Privy seal dated “at our Palace of Westminster” for 500l. to Major General William Cadogan for his equipage and 5l. a day as ordinary as Envoy Extraordinary to the States General “and as Plenipotentiary in the negotiations we are entered into in concert with other princes and states for what relates to the common interest”: the said ordinary to commence from November 1 inst.
