February 1. William Lowndes to the Revenue Commissioners in Ireland to report on the enclosed memorial [missing] of the Duke of Ormonde for extension of his lease to the Crown of the Prizage and Butlerage of Wines. Out Letters (Ireland) VIII, p. 430.
February 3. Same to Mr. [Charles] Godolphin. I thought my Lord Treasurer would have been here this morning to answer your letter of the 29th with copies of your three memorials to the Customs Commissioners relating to debts standing out on several old Collectors. In answer thereto the presentment of the said Commissioners to my Lord was read Jan. 10 last, they being present, and the Lord Treasurer agreed thereto and ordered a privy seal to discharge several of the supers mentioned therein and of a further list of those debts, which [list] they are to prepare and send in. February 4. Treasury reference to the Customs Commissioners of the petition of Francis Nelly, Commander of the ship Anna, shewing that he obtained a warrant to compound the penalty of 10,000l. for breaking bulk and has offered 100l. for the full Customs of the goods landed in Ireland and 40 guineas to the informers but the offer is not accepted and the cause is to be tried this term: that petitioner is poor and by reason of this process is kept out of all business: therefore praying that all proceedings may cease and that the Commissioners may accept the said Duties and such proportion for the informer as they think fit. Samuel Shapman and William Vickerye shewing that said Shapman was captor of the ship Whitebear laden with white wines, of which Vickerye is entitled to a fourth part; that Guybon and Cheesly, the petitioners' agents, have sold to the value of 4000l. of the said wines and refuse to account for same and have given bond for 1000l. for Customs thereon for which petitioners are prosecuted: therefore praying relief. Same to same and to the Excise Commissioners of the petition of James Lane et al. of the ship Seymour from Barbados shewing that having a quicker passage from Barbados than they expected the rum which was on board for their use was not spent; that the ship was cast away on the Spell Sand but they saved 150 gallons of rum which is seized by the Collector at Margate (“Margret”: therefore praying delivery of same to them. Warrant by Treasurer Godolphin to Mr. St. John, Secretary at War, to prepare a new royal warrant to revoke the royal warrant of 1706 July 6 ut supra Tr. Cal. vol. XX, pp. 669–70 relative to 10,119l. 6s. 7d. and in lieu thereof to authorise payment of said sum to the Regiments as therein on the Colonels thereof giving receipts in full of all demands for their clearings for the period 1702 Oct.24 to 1703 Dec. 24.
Prefixinig: report by the Comptrollers of Army Accounts that the above procedure will be sufficient security to the Queen, the said Colonels having applied to the Duke of Marlborough in this matter in Dec. last concerning the security demanded of them to discharge the Queen from all demands upon her in respect of demands from all the Officers and soldiers of said Regiments “as well living as dead” as to which the Officers insist that the payments shall not extend to the discharge of such as remain unsatisfied. Royal warrant dated St. James's to John Dodd, Receiver of the Rights and Perquisites of the Admiralty, to pay (out of the moneys arising by such Rights and Perquisites) 261l. 9s.10d. to Charles, Duke of Bolton, whereof 135l. 14s. 4d. is to reimburse him so much paid for the Lord Admiral's Tenths on the brandies seized out of the French vessel called Maria Anne of St. Valiere [Valery] condemned as a perquisite of the Admiralty and the remaining 125l. 15s. 6d. to be by him paid over for the port charges and other incident expenses relating thereto in seizing said brandies. Treasury reference to the Surveyor General of Crown Lands of the petition of Sir Thomas Mansell bart. for a grant of seven water corn grist mills in the Honor or Lordship of Brecon co. Brecon, the Crown leases of all which are expired or near expiring; same being originally built for the conveniency of the inhabitants of said Honor, who are most of them the petitioner's tenants. Royal warrant to James, Duke of Ormonde, Lord Lieutenant of Ireland, to pay to the Countess of Dorchester 133l. 0s.d. for quit rents included in her grant of lands but which have been paid into the Exchequer; and likewise to pay her 1125l. (out of the rent of 1500l. per an. reserved on her said grant) for the difference of exchange between England and Ireland on the 6750l. arrears of her pension of 3000l. per an. formerly payable in England; and likewise to pay her 96l. 3s.d. for so much stopped by the collectors of the revenue Ireland for loss of money in their hands at the time of the alteration of the money in that kingdom in June 1701: and further to make a true account of moneys due on the said pension of 3500l. per an. and after the arrears thereof have been paid them to take care that she pays her rent of 1500l. to the Crown. Same to same for an allowance of 5s. a day to Mary Murray, widow of Col. Adam Murray; Wm. III having made him a Lieut. Colonel in Lord Charlemont's Regiment for his signal services in the defence of Londonderry and he continued therein till it was disbanded and from that time was on half pay at 6s. a day till he died “in Feb. last” leaving his said widow and four children wholly unprovided for. Treasurer Godolphin to the Lord Lieutenant of Ireland to report on the enclosed petition [missing] of Laurence Stanyan, one of the late Farmers of the Revenue in Ireland, in behalf of himself and the widows and orphans of those [of the said late Farmers] that are deceased, praying the aid of the Crown to collect certain arrears alleged to be due to them on account of the said late farm. Treasury reference to the Attorney General of the petition of Sir John Trevor shewing that he has a patent as Constable and Mayor of the Castle and town of Flint, by virtue whereof he has appointed Humphrey Lloyd as Recorder and Steward of said town and of the Queen's Manor of Flint; that the bailiffs of the town have unlawfully and irregularly held a Court Leet by their own authority denying the petitioner's precept for holding the said Court and have given many insults and interruptions to said Lloyd in the execution of justice; and likewise that Sir Roger Mostyn and Humphrey Jones (who procured themselves to be chosen bailiffs for the ensuing year) have brought a mandamus against petitioner to be sworn: therefore praying that the Attorney General may take up the matter on behalf of the Queen's right, as petitioner cannot follow this matter as he should by reason of his employment.
