Persons in Custody concerning the E. of Holland's, &c. Death, to be brought to the House.
ORDERED, Those Persons that are in Custody of the Gentleman Usher, upon the Business concerning the Earl of Cambridge, Earl Holland, Lord Capell, Earl Derby, be brought before the Lords, at this Bar, on Thursday next.

Next, the House was adjourned into a Committee during Pleasure, to consider of the Bill of Indemnity.
The House was resumed.
Message from H. C. to expedite it, and the Bill to confirm Judicial Proceedings.
A Message was brought from the House of Commons, by Arthur Annesley Esquire and others:
To desire their Lordships would please to give Dispatch to Two Bills brought up from them, One of Indemnity, the other concerning Judicial Proceedings. The Reasons were: "Because, unless the Act for confirming Judicial Proceedings [ (fn. 2) be passed], there can be no Assizes kept, though they are appointed. Another Reason was, That, unless the Bill of Indemnity be passed, Animosities of the People will be increased, whereby the Peace of the Kingdom will be disturbed."

The House again was adjourned into a Committee during Pleasure, to consider of the Bill of Indemnity.
The House being resumed;
Persons exempted from Indemnity.
The Lord Robertes reported the Opinion of the Committee, "That all those Persons who gave Sentence of Death upon the King, or signed the Warrant for His Murder, shall be excepted out of the Bill of Indemnity: That, to know who the Persons are, the Evidences shall be desired from the House of Commons, for their Lordships Information:"
Which Opinion the House confirmed; and ordered the same accordingly.
Message to H. C. for the Warrant for the late King's Execution, and other Papers.
A Message was sent to the House of Commons, by Justice Foster and Justice Hyde:
To desire that they would send up to their Lordships the Instrument under the Hands and Seals of those Persons that gave Sentence of Death upon the King, and signed His Death; and all other Instruments concerning that Business which may inform their Lordships in this.
Bill of Indemnity.
ORDERED, That this House will resume this Business concerning the Act of Indemnity To-morrow Morning, if (fn. 3) the Committee for the Poll-money be not ready to report that Bill.
Report concerning Cox being admitted a Witness in Ly. Hewit's Cause.
The Lord Chief Baron reported the Opinion of the Judges, concerning the Case referred to them Yesterday touching Alban Cox, "whether he could be admitted a Witness in the Lady Mary Hewitt's Cause."
And they are of Opinion, "That if it appear to the Committee that he is clear from the Sentence against Doctor Hewit, that then the Committee de bene esse may examine him as a Witness, he being not particularly mentioned in the (fn. 4) Mention. And if, upon the Report from the Committee to the House, it shall also appear that Cox is clear from the Sentence, then the Judges conceive he may stand for a good Witness, and his Testimony taken before the Lords Committees may be allowed of by the House; otherwise not."
