Dr. Wilde and Rawlinson, concerning the Rectory of Lambeth.

The Marquis of Dorchester reported from the Committee of Petitions, the Case between John Rawlinson and Dr. Wilde, concerning the Rectory of Lambeth:

"It did appear, that the said Dr. Wyl'e had the Benefit of the general Order of this House, for Sequestration or Ejection; but he was not sequestered. But it was conceived by some of the Lords Committees that he was ejected, because a lawful Possession by Grant from the King is good, by reason of Institution and Induction. But, there being different Opinions, the Lords Committee leaves it to the House, to give further Directions therein."

A Petition also was read, from John Rawlinson.

And, upon Debate, it is ORDERED, That both Parties shall be heard, by their Counsel, at this Bar, on Monday Morning next, upon the whole Business.

D. of Albemarle introduced.

The Lord Chancellor acquainted the House, "That His Majesty hath conferred the Honour and Title of Duke of Albemarle on the Lord General Monke."

Upon this, the House appointed, he should be (fn. 2) inducted between the Duke of Buckingham and the Marquis of Winton, the Lord Great Chamberlain without Robes and Garter King at Arms going before him; and being brought in, delivered his Patent upon his Knee to the Lord Chancellor, who delivering the same to Clerk of the Parliament, it was publicly read. Garter (fn. 2) of Arms delivered the said Patent to the Lord Chancellor, who delivered the same to the Lord General Monck, who, by this Grant from His Majesty, dated 7° die Julii, A° 12° Car'li II. is created Baro de Potheridge, Beauchamp et Teys, Comes Torrington, Dux Albemarliæ.

And the Ceremonies aforesaid being ended, he was placed by Garter between the Duke of Buckingham and the Marquis of Winton.

E. of Banbury, concerning his Peerage.

It was moved, "That there being a Person that now sits in this House as a Peer, who, as is conceived, hath no Title to be a Peer; videlicet, the Earl of Banbury:"

It is ORDERED, That this Business shall be heard, at the Bar, by Counsel, on Monday come Sevennight.

Thanks to the King, for conferring the Title on the D. of Albemarle.

It is ORDERED, That the Lord Great Chamberlain and the Lord Berkeley shall wait upon His Majesty, to give Him Thanks, from this House, for the Honour he hath been pleased to confer upon the Duke of Albemarle.

ORDERED, That the Duke of Albemarle be added to the Committee for Privileges.

Adjourn.
