ORDERED, That the Earl of Rivers shall have Leave, for some Time, to be absent from attending this House.
Serjeant at Arms and Gentleman Usher, concerning the Execution of Warrants.
This Day the Counsel of the Gentleman Usher attending this House were heard, what Precedents were to be found, in the Case of Difference between him and the Serjeant at Arms attending upon the Lord Chancellor, concerning the Right to whom the Orders of this House should be directed, for apprehending and bringing Delinquents before this House.
And, upon a long Debate, it is ordered and declared, That this House reserves the Power to themselves, to employ what Persons they think fit, for the sending for Delinquents, as they shall see Cause.
Order for Delivery of Papers to the Marquis of Worcester.
Upon Information given to the House, "That Elizabeth Cromwell Widow, the Relict of Oliver Cromwell, Richard Cromwell Esquire, and Henry Lord Herbert, have many Deeds, Evidences, and Writings, belonging to the Lord Marquis of Worcester:"
It is ORDERED, by the Lords in Parliament assembled, That the said Elizabeth and Richard Cromwell, and the Lord Herbert, shall deliver up unto the said Lord Marquis, his Agents, or Assigns, all such Deeds, Evidences, Conveyances, Court-rolls, Surveys, Patents, Fines, Recoveries, Rentals, Plats; Paper, Memorials, and Writings, whatsoever, belonging or any wise of Right appertaining, unto the said Lord Marquis, in the Hands or Possession of the said Elizabeth or Richard Cromwell, or the said Lord Herbert, or any of them, or in the Possession of any other to their or any of their Uses whatsoever; and that the said Lord Marquis, his Agents or Assigns, shall have free Access to the Deeds and Writings aforesaid, in whose Custody soever they do or shall remain, and to have Copies of any of them until further Order be given for the detaining them, (fn. 1) until further Order be given for the delivering them up into his Lordship's Possession, his Agents or Assigns. And hereof all Parties (fn. 2) whom this doth or may appertain are to yield their Obedience accordingly.

Upon hearing of Counsel and Precedents this Day at the Bar, upon Petition of Humphrey Leigh Serjeant at Arms, Plaintiff, attending the Lord Chancellor, and Alexander Thayne, Gentleman Usher of the Black Rod attending the House of Peers, Defendant, wherein the said Serjeant affirmed, "That all Warrants of that House ought to be directed to him, for apprehending and bringing of Delinquents before the Lords in Parliament, and for carrying them into safe Custody:"
The Lords entering into a serious Debate of the Matter, and after a due Consideration of the whole Business:
It is ORDERED and Declared, by the Lords in Parliament assembled, That their Lordships do reserve the Power to themselves, to employ what Persons they shall think fit, for the sending for of Delinquents, and keeping them in safe Custody, as they shall see Cause.
