Memorandum: this ship is forfeited by the late Quarantine Act [9 Anne, c. 2], the master whilst she was under quarantine going on shore and breaking bulk: the Attorney General, to whom the case was referred, reported only the ship and tackle and furniture forfeit, not the cargo: so that she is permitted to unlade such goods as were designed, at their lading, for Cadiz and to re-ship them: but the prosecution to proceed against the ship and master. April 17. | Treasury reference to same of the petition of Nathaniel Estwick of Cork in Ireland on behalf of himself et al., owners of the ship Escape of Cork, shewing that she was employed in June last to transport 225 prisoners from Kinsale to France; that at his being there the Cessation of Arms was solemnly proclaimed, by virtue whereof he freighted his ship there with salt, wine and brandy for Ostend, but by reason of violent winds was driven into Falmouth and was next day seized by the Collector and salt officer there, but the Commissioners gave him leave to proceed, on giving satisfaction to the officers for their trouble, “who demanded 200 guineas and would take no less, upon which the seizure was prosecuted and a verdict found against the petitioner contrary to all expectation, for that the nature of the cargo sufficiently proved the voyage for Ostend”: therefore prays relief. Prefixing said Commissioners' report on said Wise's petition. On the 26th April 1712 when he absconded he owed for tobacco Duties 23,018l. 19s. 11½d., now reduced to 18,102l. 17s. 10¾d. He is also surety for Mr. Thomas Perrin in 2,825l. 13s. 10½d. and for Cornelius Denn in 3,351l. 12s. 1d., making the total outstanding debt 24,280l. 3s. 10¼d. He is interested in the manor of Latchleys, Co. Essex, mortgaged to him by James Brain, and [which] he, Wise, mortgaged to John Pollexfen: and likewise in an annuity of 50l. per an. claimed by John Dodwell, gent., and Mary his wife. Mr. Roderick Price, one of the gunners and bombardiers of the Ordnance, has represented to my Lord Treasurer that on the Expedition to Canada the Commissary of the Ordnance being in want of money to buy clothes for the gunners and matrosses, borrowed of him [Price] 140l. New England money, for [repayment of] which he [the Commissary] gave a bill on your Board for 100l. sterling of which he [Price] has only received two thirds. Inasmuch as the case of this person differs much from that of the merchants who were great gainers as well by the exchange as by the stores and provisions which they sold, my Lord Treasurer agrees that the remaining third be paid to him provided Price's case be singular and if you find by the Commissary's account that her Majesty hath availed herself of the money which Price advanced to him. My Lord is informed by Mr. Howe, Paymaster of Guards and Garrisons, that bedding and other necessaries for the lodging of the Guards in barracks were supplied and paid for by the Ordnance in the reign of Charles II. and at all times since without any charge upon the Regiments. Treasury reference to the Customs Commissioners of the petition of “several [traders] who upon the occasion of the Peace with France have the expectations of importing the wines of that country upon payment of a reasonable Duty to be laid upon them before the hot weather shall take place; they being traders in wine and informed that now the peace is concluded with France the Parliament is like to take off the last 25l. per tun laid on French wines. They represent to the Lord Treasurer that the season of the year is already so far advanced [as that] except the Duties on French wines shall be speedily reduced the persons that have secured the best wines in France and have delayed importation in expectation of the Duties being lessened will be obliged by reason of the approaching heats to send a great part of them to other foreign markets; and those that shall be brought in here will be very liable to great damage by heat of the weather, the fine clarets being a very nice sort of wine and most liable to be affected by heat.” (This petition is signed by Sam Shepheard, Tho. According to the view taken by the officers at Plymouth as to the damaged condition of the wines the Duties were to be 1,823l. 17s. 7d., but according to the view made by the officers at London they were only 772l. 17s. 3d. besides the London Duty (fn. 1) of 51l. 3s. 1½d. The length of the voyage [? to and from Plymouth to London] being but 14 days could not be suffered to be the occasion of so much additional damage, and the low produce of the wines upon a public sale on the 18th ult.
