September 1716, 11–15

Sept. 11. Same to Anthony Cracherode [Treasury Solicitor] to pay 36l. to Thomas Oldcroft, a Reformed Lieutenant of Col. Frank's late Regiment; to reimburse the charges and expenses he has been at in defending himself against a prosecution which appears to have been maliciously commenced by reason of his appearing zealous for his Majesty and the present Government during the time he was quartered at Chester. Treasury warrant dormant to Horatio Walpole and Francis Hawes, Customs Cashiers, to pay the salary of 61l. per an. to Lancellot Whitehall as Customer of Chichester port. Money Book XXV, p. 1.
Same to Anthony Cracherode, Treasury Solicitor, to repay to Capt. Ralph Whitfeld the 105l. damages sustained by him as follows and 20l. in satisfaction of his service, pains and expenses in conducting from Liverpool to London 54 witnesses with which he was charged.
Prefixing: said Cracherode's report dated 1716 July 31 on said Whitfeld's petition. He belongs to his Royal Highness's own Regiment of Royal Welsh Fusiliers and by orders of Secretary Townshend of March 21 last was commanded with a detachment of 50 foot soldiers to convoy as above the witnesses for his Majesty against the Rebels (against several prisoners at London on account of the late Rebellion) and to use all possible expedition in his march. As most of the witnesses were aged or sick it was impossible for him to perform the said service without being supplied with horses from the country; he requested the constables of the county of Chester to provide horses, which the magistrates at Middlewich in Cheshire absolutely refused; he was forced on March 31 to press 38 horses from several persons for the said service by his own men and thereupon the Justices (to wit John Egerton of 0lton and Charles Cholmondley of Vale Royal) took an affidavit against him and sent it up to Lord Lincoln as Paymaster of the Forces requiring him (pursuant to the Act of Parliament of 1 Geo. I., St. 2, c. 9, for preventing Mutiny) to stop 105l. from said Whitfeld's pay for the penalties of the several offences alleged against him in the said affidavit (being 5l. for every one of the said 21 offences of which they had convicted him). Further the allowance for the support of the said witnesses was only 4d. a day to each man, so that petitioner was at above 20l. expense extraordinary out of his own pocket to entertain them and his own men fatigued with so long and expeditious a journey; for which he hath had no consideration from the Government. The sum of 11l. 5s. 0d. has been already stopt out of his pay and further stoppages will be likewise made of his subsistence money. His pressing the horses is not justifiable by law, but he had no other view therein but his Majesty's service. Money Book XXV, pp. 5–8.

Sept. 11. William Lowndes to the Postmasters General enclosing the representation from the Mayor and other chief inhabitants of the borough of St. Mawes in Cornwall in behalf of Thomas Rice as in every way qualified to command a pacquet boat. The Treasury Lords recommend him to you for such employment if you have no objection thereto.

Same to the Attorney General. The Prince of Wales some time since signed a warrant to you for a great seal to grant to Charles Hyett the office of Constable and Keeper of Gloucester Castle. The Treasury Lords desire that, in case the bill is not prepared and sent by you to one of the Secretaries of State, you do stop preparing or sending the same and return to them the original warrant signed by the Prince. Same to Mr. Brudenell. My Lords have read your letter of the 8th inst. which communicates to them Lord Bingley's answer to you about the plate expected to be returned by him into the Jewel Office. My Lords have commanded me to acquaint you that unless the said plate be returned by the beginning of next term you immediately proceed against Lord Bingley for recovery thereof. Ibid.
Same to Sir Joseph Hodges. My Lords desire you to exhibit to them with all speed an account of your receipts and payments with respect to the Trust for repaying the loan of 250,000l. and interest to the Genoese. Ibid.
