Nov. 16. William Lowndes to the Salt Commissioners to report on the enclosed petition [missing] of Mathias Partis and others concerning their previous petitions as to their losses. Out Letters (General) XVII, p. 276.
Same to Mr. Wilcox to report on the enclosed letter and papers [missing] from the Navy Commissioners "signifying that it would be much for her Majesty's advantage if liberty could be had to cut heath and furze in the New Forest for breeming her Majesty's ships at Portsmouth." Ibid., p. 277.

Treasury reference to Mr. Borrett of the petition of William Elphingston shewing that Dr. John Butler of Appletree co. Northants. devised by will 250l. per an. to one Mary Tomkins and 3 illegitimate children : that said Mary Tomkins was soon after drawn in to convey the said estate to one Simon Butler, a papist, for 3500l. of which he never paid a penny and hath possession thereof : that petitioner is guardian of the said children and hath hitherto maintained them : therefore praying one third of the estate. Same to the Customs Commissioners of the petition of Nathaniell Senior shewing that he has exhibited informations in the Exchequer against illegal traders to St. Sebastian whereby near 5000l. has been paid to the Crown, notwithstanding which he is prosecuted in the Exchequer on the affidavits of Stephen Creagh and others which are notoriously false : therefore praying a stay of process. Paston, praying a grant of a market to be held weekly on Tuesdays, Thursdays and Saturdays for ever in or near a certain piece of ground without Smithfield Barrs where butchers bring their sheepskins and lambskins to sell without lawful authority : with authority to take toll for such skins not exceeding 6d. per score. Letter of direction for 10,915l. 8s. 1d. to Charles Fox : for the service of the 40,000 men : out of branches of the revenue as follows viz. 307l. 5s. 0d. of arrears of the Customs at Xmas 1699 ; 246l. 5s. 10½d. of the 25 per cent. on French goods ; 7971l. 18s. 10d. of the Surplus of the East India Company Fund at Michaelmas 1703 (to wit 1790l. 14s. 8d. of Additional Stamp Duty and 6181l. 4s. 2d. of the 28d. per bushel on Salt ;) 860l. 3s. 3d. of penalties levied on maltsters ; 1005l. 4s. 11¾d. of loans on the Duties on coals and 524l. 10s. 1¾d. of loans on the sixth 4s. Aid. This total of 10,915l. 8s. 1d. (together with 3351l. 10s. 5d. remaining undisposed of the tallies put into said Fox's on the New Duties on coals) is to be applied to clear the Queen's Subject Troops, part of the 40,000 men from Aug. 25 last to Oct. 24 last, amounting to 14,266l. 18s. 6d. Order by Treasurer Godolphin to the respective Commissioners and Officers [of Prizes, Admiralty and Navy] concerned, to observe (a) infra :
Prefixing : (a) : Order of the Queen in Council dated St. James's Nov. 11 for the distribution of the captors' share of the prizes taken at Vigo. The said distribution is to be made among all the sea Officers and mariners of the several ships according to the proportion allowed by the Declaration of 1702 June 1 without distinction of the rates of the ships ; and assisting ships are to be esteemed as principals : and the eighth part to Flag Officers is to be as in said Declaration : and marine soldiers on the muster books of said ships are to be accompted seamen and the Officers of such marines are to make their application to the Lord High Admiral who is empowered to order rewards out of the Queen's share, there being no share allowed to them as such in the said Declaration. The sum of 60,000l. being by estimation about three fourths of the total is to be distributed immediately in the mean time, pending final settlement of the account and of all formalities. Same to Mr. Clark, Secretary to the Lord Admiral. The Prizes Commissioners have received a warrant from his Royal Highness to pay 55l. to the Navy Treasurer out of the Queen's share of prizes to provide medals for the master, 3 mariners and a boy of the merchant ship Leonora for services. My Lord Treasurer conceives that the Queen's Declaration that the rewards to be distributed by the Lord Admiral should be paid out of the Queen's share of prizes does intend that the same should be paid out of the perquisites of the Admiralty, otherwise the Prizes Commissioners will be in a great difficulty to know what moneys they are to reserve in their Receiver General's hands. Please communicate this to the Lord Admiral. Ibid.
Same to Mr. Hewett. Under pretence of fee trees the verderers of Sherwood Forest cut the very best trees, fit for the Navy. The Lord Treasurer is not well satisfied as to the legality of this claim. You are to immediately inhibit them from felling the same. Ibid., p. 282.

Treasury reference to the Customs Commissioners of the petition of James Hazard and Company, of London fishmongers, for return of their deposit for duty on a parcel of Bank fish which they bought from the Prizes Commissioners in Nov. or Dec. 1702 out of the Gentile prize then lying at Portsmouth : the said fish being neither fit for export nor home consumption as appears by the oaths of the "fish meators." Money warrant for 40,000l. to Henry Scobell, Receiver and Paymaster in this behalf, as imprest for buying tin in Cornwall and Devon on the Queen's behalf and for making loans to tinners between the coinages, pursuant to 2 several contracts made with the Convocation of said tinners. Nov. 26. Royal warrant to the Clerk of the Signet for a privy seal for an additional allowance of 800l. per an. out of the Four and a Half per cent. Duty to Sir Bevil Granville Governor of Barbados, to make his salary 2000l. per an., which may make a competent maintenance for that Governor without dependence on the people, whereby the Assemblies of the said Island will be in a condition of applying those large sums (which they usually give in presents by yearly levies to their Governors) towards other public uses as may be most necessary for the defence and safety of the Plantations : the Commissioners for Trade and Plantations having by the Queen's direction laid before her an account of the salaries which now are or might be properly assigned to the respective Governors of the Plantations for the better enabling them to support the dignity of the several Governments and for hindering them for the future from receiving presents from the General Assemblies there. The said additional allowance is hereby to commence from 25 July 1702 the day of his Commission. "And we do hereby signify and declare that the said Governor shall not receive any gifts or presents from the Assembly of the said Island of Barbados upon any account whatsoever except only a temporary assignment of a house or rent for the same in such manner as is proposed by our said Commissioners of Trade and Plantations." Same to William Borret of the petition of Mary Whitebread shewing that in the Quarter Sessions for Surrey she prosecuted James Mervin for violent and barbarous assault in 1701 and obtained a fine of 20l. and 44l. costs against him but Mervin has withdrawn himself to evade costs and she is so much disabled by the said assault that she is unfit to work for her living : therefore praying that the fine of 20l. which is in the hands of the [Sheriff of the] county may be paid to her. Same to the Navy Commissioners of the petition of Sir Gilbert Heathcote of London merchant, shewing that after the earthquake at Jamaica which swallowed up the public store houses belonging to the Crown the Governor prevailed with petitioner's brother to hire a warehouse for the public stores and to stand engaged for the rent and he has paid for the rent and charges thereof 115l. 10s. 0d. ; that the Governor drew a bill [for same] on the Navy Commissioners but they refuse to pay same, alleging the Governor to be no officer of the Navy and that the hiring of storehouses was forbidden : therefore praying that same may be paid. Certificate by Treasurer Godolphin "that her Majesty hath been generously pleased to say to me that it is her pleasure and intention" that the further payments of the pension of 1500l. per an. to Henry, Earl of Clarendon, out of secret service (which she directed from 1702 June 24 and on which 3500l. has been already paid by way of advance in pursuance of her Majesty's command) shall be continued to the said Earl or his assigns and that she will not determine the same during her Majesty's life. The like of a like order dated Nov. 24 for the delivery to Mr. Jones of particulars, detailed, to be carried by him to the Emperor of Morocco as a present from her Majesty : (fine cloth of a new fabric and of divers colours, a fine repeating clock with Arabic figures and Arabian tunes, an amber China ship with clock work, a suit of armour, 2 swords, 6 gun barrels, locks &c. to be made Morocco fashion, 3 pair of pistols, 2 telescopes, 2 double microscopes, 2 barometers, 2 concave burning glasses, &c). Warrant by Treasurer Godolphin to the Receiver of the Rights and Perquisites of Admiralty to make the distribution of the profit of the French prize ship Eagle and Crown to the owners, captain and company of the Larke frigate which took the said ship without a letter of marque ; Dr. Bramston, Surrogate to the Judge of the Admiralty Court, having reported that during the late war such captures without letters of marque have been as beneficial to the owners, captain and company as if under letters of marque.
