Lieut. Tho. Burke having petitioned for a grant of certain lands, co. Limerick (which were taken by the usurpers from petitioner's father and fell to the lot of Capt. Walcot, who was lately executed for treason) desires that no grant of said lands may pass to the Earl of Roscommon, Capt. Mich. Burke or any other till petitioner have notice at his lodgings at Mr. Burton's, a taylor over against Carey House in Tuttle Street. Caveat Book, p. 23.

Oct. 6. Same to Mr. Hewer to forthwith pay 40s. each to the poor Tangier soldiers mentioned in the last list sent to you by the Treasury Lords and now living. Ibid.
Same to the Excise Commissioners to forthwith admit Mr. Nicho. Fenn to the office of Housekeeper of the Excise Office which Mr. Chiffinch has surrendered to the King with a view to a grant thereof to said Fenn. Ibid.
The Treasury Lords to the Revenue Commissioners, Ireland. We are informed that the Collector of Customs in Dublin City and the Collector of Inland Excise ibid. do not give in abstracts as other collectors do and that neither the Receiver General nor the Accomptant General [Ireland] have any account or abstract of the produce of those branches nor of the Hearthmoney or quit rents of the said city. If true we take this to be a great omission and not to be continued. We therefore direct that all the receipts in the port and city of Dublin upon all the branches [of the revenue] since Dec. 25 last be accounted for to the Receiver General [Ireland] and that he have an account of all that has been paid since Dec. 25 last for salaries to the officers of the revenue in Dublin or the outports and that for the future the like accounts be given to him from time to time. This will bring all the accounts clearly to him "and since you by your commission are exempted from being accomptants it is most necessary that he [the Receiver General] who by his office must be one should have a perfect knowledge of the whole receipt and every particular branch of it." To this end it is requisite that he should have duplicates of all the abstracts that he may know from time to time what cash there is and in whose hands and likewise thereby be informed what arrears are standing out, so that he may be enabled to keep an account of the whole revenue as well as the Accountant General. As to the latter, by the way, we are informed that he is not so diligent or so knowing as he was represented to us when we recommended him and particularly that his assistants are not fit workmen for this business. But pray note that we have recommended no one for favour or any consideration. Out Letters (Ireland) III, pp. 196–7.
We are informed that when the Act of Customs was passed care was taken to appoint two in some ports and three in others to examine and keep an account of several entries, which [duty] is not now carefully performed and that the inland Excise and [beer] licences want a due cheque and control. Be careful to see if there be any ground for these informations.
Mr. Guy's letter of May 19 last [ut supra, p. 792, for an account of the charges of management of the revenue [Ireland] was not complied with at June 24 [last]. We call on you for it again and let it be a perfect and particular establishment of the whole charge of the management with each person's name, employment and salary throughout the whole kingdom. At the end of every quarter such an establishment ought to be made and it is the transcripts of them that we desire should be quarterly sent over to us.
Oct. 6. Report to the King from the Treasury Lords on a draft royal letter proposed to be sent to the Lord Lieutenant of Ireland for allowing 1,750l. in the Earl of Ranelagh's account. On examining the account of the said moneys we are satisfied that same has been fully paid by said Earl according to your Majesty's directions and have therefore nothing to object to said Earl's discharge as by said draft. Out Letters (Ireland) III, pp. 197–9.
Prefixing: (1) said draft. By royal letters of 1682, April 15, and 1682, Oct. 31, ut supra, pp. 451 and 624–5, allowance was to be made to said Earl of Ranelagh of 92,750l. and 7,416l. 13s. 4d. and 1,018l. in his accounts, those sums having been paid and issued here [in England] by him by order and direction of the King from time to time pursuant to the clause in the then establishment of Ireland which reserved a yearly sum to the King's dispose. The said Earl has petitioned shewing that besides the said sums he has since laid out and issued here [in England] by similar direction the sum of 1,750l. and desires to be discharged of that sum in his accounts now passing. Having caused the account of said sum to be examined the King finds that same has been so paid by said Earl. It is therefore hereby to be allowed in his final account which he is now passing. (2) Reference dated Whitehall, Sept. 29, from the King to the Treasury Lords of said draft.
Sir Thomas Slingsby having the King's promise for a lease of several encroachments and cottages within the Honor of Knaresborough, co. Yorks (he having discovered that they belong to the King) desires that no grant thereof pass to any other person till notice be given to Mr. Brune Clench at his house in Hunts Court in Castle Street in Leicester Fields. Treasury warrant to the Customs Cashier to pay back to the East India Company 6 per cent. discount for six and six months on the duty of the goods they have lately imported in the Trinquand Merchant, Dragon, Nathaniell, Defence, Society and Williamson, upon the Company's paying said duties. Money Book IV, p. 274.
Oct. 7. Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Nicholas Fenn, esq., of the office of housekeeper of the Excise Office with the fee or salary of 400l. per an. loco William Chiffinch, esq., who has resigned same by a deed dated the 6th inst. To hold during pleasure. King's Warrant Book IX, p. 214.
Same to same for a same for a grant to St. John Broderick of the duty or sum of 2s. for every gross of cards hereafter to be made by any of the Company or Mistery of Makers of Playing Cards of the city of London: to hold for 21 years on the annual rent to the Crown of 5l.: and further to constitute and appoint said St. John Broderick Receiver of said duty with the further fee of 1s. per gross of such cards to his own use without account: the said Company having been incorporated 4 Car. I and having by their charter covenanted to pay for ever to the Crown the said 2s. per gross and also the further sum of 12d. per gross to the officers or persons to be appointed to receive said sums, the said latter sum being to their own use. Upon which charter the Attorney General has reported, 1683, May 23, that the King is well entitled to the said duty [of 2s. per gross] and may grant the same, together with the office of sealing the cards. Oct. 8. Report to the King from the Treasury Lords on the petition and reports as follow. We agree with the Duke of Ormonde that petitioner's pretences be referred to the Lord Deputy of Ireland for examination and report. Out Letters (Ireland) III, pp. 199–201.
Prefixing: petition to the King from William Mac Brien of Akerloe in the Province of Munster concerning his and his wife's ancestors' estates now concealed from the King and offering to make discovery thereof and of other considerable concealed lands and Crown interests in Ireland and not yet legally granted or disposed of; "which said lands were formerly discovered and contracted for by your petitioner to some of the deficient persons who were stopt in the prosecution of such discovery and yet since, others (by your Majesty's late orders) do now proceed upon discoveries by commission of inquiries, etc." Petitioner and his wife and five orphan children are in extreme poverty. Therefore prays a reference to the Lord Deputy for examination in Ireland of his proposed discoveries, as advised by the Duke of Ormonde on a previous reference; and also some royal bounty towards his expenses [in returning] thither and to enable him to prosecute the premises; or otherwise for a grant of a blank patent of a knight banneret to be conferred by the Lord Lieutenant or Deputy of Ireland on some nominee of petitioner's. (2) Order of reference dated Whitehall, Feb. 18 last, from the King to the Duke of Ormonde of said previous petition. (3) Report from said Duke dated St. James's Square, May 30 last. Petitioner's certificates are signed by men of good repute. His pretences may be referred to the Lord Deputy for examination. (4) Reference dated Windsor, Aug. 13 last, from the King to the Treasury Lords of said petition and report. (5) Copy of an order of the King in Council dated Whitehall, Mar. 2 last, (made on said McBryene's previous petition) permitting him to sue in forma pauperis.
Oct. 8. Money warrant for 1,500l. to Henry Sidney, Gentleman and Master of the Robes; 250l. thereof to complete 1680, Christmas quarter, and 1,250l. thereof as for 1681, Lady day quarter, on the 5,000l. per an. for the Robes. Hereof 150l. is to be for his own use without account and 1,350l. for the service of the Robes. (Money order dated Oct. 9 hereon.) Money Book IV, p. 275. Order Book XXXIX, p. 105.
Henry Guy to the Navy Commissioners to make an inventory and appraisement of provisions and remains of Navy victuals as below and in case of need to forthwith provide such cask, hoops, bags and victuals as may be necessary for carrying on the victualling from Christmas next. Further to take an estimate thereof and to present same, together with the inventory and appraisement to the Treasury Lords "that their Lordships may have before them the whole charge of these particulars. Also their Lordships desire you to certify them whether the Victuallers had the King's remains at the commencement of their contract and whether they were appraised and charged in the first year's account of the Victuallers according to the said agreement." Prefixing: an extract of the covenant (in the present contract with the Victuallers of the Navy) providing that Richard Brett, Samuel Vincent and John Parsons [the said Victuallers] shall take into their possession all such provision of cask, hoops and bags and other provision of victuals as shall at the beginning of this contract belong to his Majesty in any of his storehouses in London, Rochester, Dover, Portsmouth, Plymouth, Harwich or Kinsale or on any of the King's ships and all remains of victuals; same to be inventoried and appraised by the Navy Commissioners: the Victuallers to charge themselves therewith in their first year's account. Similarly the King to take from them at the end of their contract said provision of cask etc. and remains of victuals by similar inventory and appraisement. In case of dispute as to the appraisement six indifferent men to be appointed to decide same.
Oct. 8. Henry Guy to Mr. Bertie to consult with Sir Christopher Musgrave about the following petitioner and to pay the poor man 20l. out of any money in the office "in case he hath any vouchers since the stop of the Exchequer." Out Letters (General) VII, p. 211.
Appending: petition of Richard Blaker, sawyer, to the Treasury Lords: shewing that 82l. 0s. 1d. remains due to him for sawyer's work by him done in Sheerness fort between 1670, Sept. 29, and 1672, June 15, and that much more money being now due to him he is reduced to great straits being twice arrested last week for 40l. and must be cast in prison by next Wednesday if not relieved.
Report to the King from the Treasury Lords on the petition of Thomas Squire. Petitioner is of very loyal principles and utterly unable to pay his fine and has lain long in prison for it. We have nothing to object against the pardoning of the fine. Warrants not Relating to Money IX, p. 235.
Prefixing: (1) said Squire's petition shewing that he has lain for a long time prisoner in York Castle for 500l. fine to the King for assaulting Thomas Jones, esq.; petitioner having no fortune as being a younger brother. (2) Reference dated Whitehall, Sept. 27 last, from the King to the Treasury Lords of said petition.
Oct. 9. Henry Guy to the Customs Commissioners to report on two Acts which are passed in Virginia (viz. an Act to prohibit the exportation of wire, and an Act for encouraging linen and woollen manufactures): said Acts being transmitted to the Treasury Lords from the Committee of Trade and Foreign Plantations. Same to the Auditor of the Receipt to issue to Philip Packer, Paymaster of the Works, the 327l. 3s. 3d. arrear of the 1673, Eighteen Months' Assessment, co. Midd., which will be speedily paid into the Exchequer. Same is to be applied by Packer as follows viz. 157l. 16s. 0d. to John Angier and the executors of Thomas Kinward, late his Majesty's joiner, for work done in his Majesty's bathing room in Whitehall, and the remaining 169l. 7s. 3d. to said Angier in part of his debt at the Office of the Works. Same to same. There is a present occasion for 400l. to be put in my hands to be disposed of as the King shall direct me. As the King is at Newmarket the necessary warrants for the regular issue thereof cannot be despatched as quickly as required. You are to get one of the Tellers to advance me that sum out of King's Bench fines, taking my acquittance and detaining their fees as for money issued for secret service. The regular warrants for the issue thereof will be despatched with all expedition. Ibid, p. 273.

Appending: (1) request dated Oct. 10, from the Navy Commissioners to Henry Guy for such Customs free shipment of a proportion of victuals shipped in the Constant Richard, David Lockwood master, being intended for his Majesty's ship Ruby at Jamaica for four months, and a proportion of victuals for three months for the ship Guernsey at Jamaica, together with a supply of boatswain's and carpenter's stores for the said [latter] ship. The said ship Richard is now down at Gravesend and ready to proceed on her voyage. (2) Schedules of said boatswain's and carpenter's stores delivered from the stores at Deptford Sept. 28 last. And schedules of said victuals as received from the Navy Victuallers, being good and wholesome sea victuals, detailed, for 200 men for 112 days for the Ruby and for 110 men for 84 days for the Guernsey.

The Admiralty Lords (being credibly informed that some persons are endeavouring to procure a grant of the soil or ground lying between high and low water mark not only in the Thames but in other parts of this kingdom) pray that no such grant may pass till they be heard in what they have to object thereto not only in relation to the rights of the Admiralty, but also the great prejudice which they conceive may ensue to the trade and navigation of this kingdom by such grant. Oct. 22. Henry Guy to the Navy Commissioners to send with all speed their reply to the letter of the 8th inst. supra, p. 925, concerning the inventories and estimate of the remains of Navy provisions and victuals. Out Letters (General) VII, p. 218.
Same to same to assign out of the Navy's weekly money, by three weeks' instalments, the payment of the bill of exchange for 583l. 10s. 0d. drawn on you by Mr. Thomas Chudleigh, his Majesty's shipwright at Kinsale, for so much disbursed by him for saving and refitting his Majesty's ship Lark and for repairing and supplying with stores some of his Majesty's other ships upon the coast of Ireland. Same to Mr. Stephens [Cashier to the Treasurer of the Navy] for an estimate forthwith of the lowest charge that will pay off his Majesty's ship Crowne. Ibid.
Same to Sir Christopher Wrenn to survey the new Navy Office with the houses and buildings about the same as built by Mr. Ward and to report how you find same. Ibid.
Same to the Customs Commissioners to consider the enclosed papers ("Monsieur Ammonett's petition and the declaration in favour of French Protestants") and to do therein what you can by law for the petitioner, whose case is very deplorable. Ibid.
Same to the Attorney General to consider the grant made 1642, April 28, to John Gosling and to report whether the herbage and pannage of Berkland and Billhaigh and the other things therein be legally passed to said Gosling. Mr. Millington will attend you with the grant. Ibid, p. 219.
Same to Mr. Brisbane. The Treasury Lords desire the Admiralty Lords to come to speak with them to-morrow. The Crown will be paid off this week. Ibid.
Oct. 23. Same to Mr. Froud [Deputy Postmaster General] to inform the Treasury Lords what authority you have for suffering any Post letters to go free. Ibid.
Same to the Navy Commissioners. As you are not yet prepared to report concerning the repairs of the Victualling Office you are to attend the Treasury Lords on Thursday concerning the inventory and estimate of the Victuallers' provisions and victuals ut supra. Ibid.
Oct. 24. Same to the Customs Commissioners enclosing a copy of Lord Howard of Effingham's proposal made to the Committee for [Trade and] Foreign Plantations, for a man of war ketch for Virginia. (The like letter on the following day to William Blathwayte.) Ibid, pp. 220–1.
Appending: (1) said proposal: shewing that it is absolutely necessary that a small vessel be sent to remain on the coasts of Virginia "and that whatever reasons prevail that ships are sent to other Plantations (as they are so frequently) are of so much the more force to induce it here by how much the King's revenue from Virginia is more considerable than that of all the other Plantations if joined together. By this assistance the peace of the colony wilbe secured and any future disorder or rebellion not permitted to grow to that head as it did in the year 1676, the charge of which to suppress was very great out of the King's Exchequer here. It will likewise curb the insolencies of those who so lately have diminished the King's Customs to the value of 20,000l. by cutting the tobacco plants." Said ship will hinder irregular traders who carry their commodities to other parts than England contrary to the Acts of Parliament and so advance the Customs "not only by the due collecting of the 1d. for every lb. of tobacco to other Plantations but by the increase of the Customs here, both which are frequently avoided by the merchants for want of such force as may examine all ships" that pass between the two Capes of Virginia. This will likewise be serviceable to Maryland and other parts, all ships being forced to pass those Capes; and will prevent pirates from committing so great mischiefs on the Plantations as they have so lately done: and will also be a great awe to all the inhabitants on this side the tropic and especially to New England, whither it may be sent as occasion requires. (2) Extract out of the representation from the Council of Virginia to the Committee for Plantations. As the present state and natural situation of the colony is such we are equally concerned to have regard to the security of the government by water as by land to provide against pirates and to curb the insolencies and rebellious intentions of mutinous and restless spirits on shore. Therefore desire a man of war ketch with 12 guns and 40 men which will not only preserve the peace but also prevent Customs frauds "which in this plentiful watred country is not to be prevented by other means." (3) Resolution of the Admiralty Lords dated Derby House the 24th inst. and signed by J. B[risbane] that a ketch with the above force [of guns and men] will be fit for the abovesaid service.
