Indenture of Contract between the Treasury and the Contractors
for Circulating Exchequer Bills under the Act for making good the
Deficiency of several Funds and other Acts, detailed. All as follows: |
|
By the Act (8–9 Wm. III, c. 20) for making good the Deficiency
of several Funds and for enlarging the Capital Stock of the Bank of
England the Treasury is empowered to covenant with persons &c.
for contracting for advancing moneys for exchanging [encashing]
such Exchequer Bills (part of the total of 1,500,000l. such Bills
authorised by said Act) as should be refused in repayment of tallies
and orders: and that such Contractors should have for their security
and satisfaction the said Exchequer Bills or such securities as should
be agreed by the Treasury: with 10 per cent. interest. By the Act
(8–9 Wm. III, c. 24) for a further subsidy of Tonnage and Poundage
and an additional Land Tax a further issue of 1,200,000l. Exchequer
Bills was authorised but so that the total outstanding should at no
time exceed 2,000,000l. and to have the like currency and to carry
the like interest of 5 pence per 100l. per diem: and with the like
authority to the Treasury to contract with persons as above. |

By the Act (12–13 Wm. III, c. 1) for renewing Bills of Credit
commonly called Exchequer Bills (being uncancelled or undischarged) the Treasury is empowered to cancel any such Bills brought
at any time into the Receipt (and which happen to be too full with
endorsements) and to issue new Bills for the amount of the principal
and interest standing on such cancelled Bills, such new Bills to bear
interest of 4 pence a day per 100l. and to be of the denominations of
100l., 50l. or 25l. |
|
The Subscribers to the present Indenture, being Contractors as
above (severally and respectively and not one for the other) do
hereby agree with the Treasury Lords that they will pay to Sir
Henry Furnase, Sir James Bateman, John Heathcote and Henry
Farmer, Trustees in this behalf, the sums individually subscribed
in proportions of not more than a fifth at a time, as the Treasury
Lords may by public notice require: provided that as any part of
the money so subscribed shall be required and paid for exchanging
such Bills, the Bills exchanged shall be immediately delivered to
the said Subscribers or Contractors. And the said Subscribers or
Contractors shall immediately upon the signing of this Indenture
advance to the said Trustees 5 per cent. of their respective subscriptions, to remain in the hands of the said Trustees until the
determination of the present contract. |
|
If any subscriber fail in his subscription he shall forfeit the said
5 per cent. deposit and also the reward or allowance [of 10 per cent].
And the said Trustees shall duly apply the moneys so deposited and
subscribed to and for the satisfaction [encashment] of tallies and
orders as aforesaid which shall be in course of payment "which such
Trustees shall faithfully do and perform in all cases where any of the
said Bills shall be actually brought into the Exchequer [to wit from
the Auditor of the Receipt to the Tellers and by the said Tellers paid
out] instead of money for payment of such tallies and orders" where the
owners of such tallies and orders shall be desirous to receive payment
in money instead of in such Bills. In all such cases the said Trustees
shall take into their custody such Bills so by them encashed: keeping
a just account of their receipts and payments and doings herein. |
|
The said Subscribers or Contractors are to be obliged but for one
year from date of this Indenture. |
|
On their payment of their subscriptions (or so much thereof as
there shall be occasion for within the said year) the deposit money
shall be repaid to them by the Trustees and the Subscribers shall
receive a reward of 3 percent. on the whole sum subscribed by each
of them: and they shall be entitled to this reward of 3 per cent. for
a whole year on their whole subscription whether or not there be
occasion for employing the whole of their subscription or less or for
the full year or less. And the whole cost of executing this truse shall
be borne by his Majesty. |
