currants imported by Peter Witcomb of London merchant being

on payment of Customs as [if] they were imported in a qualified
ship; with reasonable allowance for damage: the said Commissioners having reported (on the information of John Dagg collector
of Fowey port detailing the circumstances of the ship's distress and
that he had arrested 60 butts of currants by warrant from the High
Court of Admiralty whereupon the Customs Commissioners instructed
him to take the goods into warehouse in order to assist Witcomb
to secure them from falling into the hands of his correspondents
abroad who were broke and failed) that the petitioner's allegations
are true and that the currants are damaged and in a spoiling condition
and that in compassion he deserves favourable consideration, the

Customs Commissioners on the memorial of the Prizes Commissioners concerning the lading of the ship St. Peter of Ostend, being
a ship re-taken from the French by the King's ship Anglesey; as
to which the Customs Commissioners are of opinion that same
appears to be stuffs made or mixed with wool upon which there
was a great Duty laid in favour of our own manufacture and that
there is some reason why this Duty should not be rigorously exacted
on the prize goods, the rather because it falls out that the Duty is
near the value of some of them so that there would be nothing left
to the Commander and seamen, for which cause it might be reasonable to take the Duty ad valorem; but that the same Act which
"makes" the distribution of prize goods provides that out of the sale
thereof the Subsidy of Tonnage &c. shall be deducted; and that
they see no expedient to extricate the goods from the difficulty
except by the Treasury Lords directing the whole parcel to be
entered without distinction of kinds or denominations and the Duty
received for the whole ad valorem in one gross sum, which supposing
them subject to the Additional Impositions will amount to 10 per
cent.; and further that they cannot come at the value but by sale
and the goods cannot be exposed to sale until the Custom be made

Herts. Upon a complaint made to you that several great quantities
of malt lying in the malting lofts in the parish of Hitchin had been
lately gauged by the officers and the owners desired an allowance
for dust that should be screened out of the same, you thereupon
caused a certain quantity of malt to be screened and measured in
which the dust was computed to be after the measure of 18 bushels
out of 20 quarters of malt. Thereupon you have by your order of
June 1 directed [an allowance of] the like quantity of dust out of every
quarter or lesser quantity of malt to be made to the persons concerned.
We have upon this occasion advised with the King's Counsel who
have given their opinion that the said order is not warrantable by
law: and though we do not believe that you had any intention to
prejudice his Majesty's revenue, yet considering how many have
paid the Duty without such allowance and what inconvenience and
disorder it may occasion in the collection thereof and that it is in the
power of the officer to measure the malt (which it's believed would
be more to the advantage of the revenue but of great trouble to the
owners) we recommend and desire you not only to recall and vacate
the said order which must otherwise be brought to a decision at
law but also to give all due encouragement to the officers in collecting

Treasury warrant to the Auditor of the Receipt to issue 10,000l. in
Exchequer Bills to Edward, Earl of Orford, on the unsatisfied order
in his name as Treasurer of the Navy: as imprest: to be paid over
to the Victualling Commissioners; to be by them applied as follows viz.
5,000l. for short allowances money due to ships in the line of battle

Same to the Surveyor General of Crown Lands. By a great seal
of 1696 June 29 the King granted Alexander Johnstowne an annuity
of 300l. for 31 years out of Sir Roger Strickland's forfeited estate
in Co. Yorks. Johnstowne has petitioned for a grant of the whole
estate for 31 years together with the arrears and mesne profits
thereof since the forfeiture. The King has directed such grant on
the surrender of said annuity and arrears thereon. I enclose you
a constat of the estate. Please enquire into the nature and value

Treasury reference to the Customs Commissioners of the petition
of Peter Peterson shewing that the ship Tolmodigheyt of Copenhagen
laden with linen cloth of France was seized in Dartmouth port by
Mr. Roper and Mr. Stephens and condemned as a perquisite of the
Admiralty; that a King's warrant granted Roper and Stephens
500l. clear of all charges out of the proceeds of the ship and declared
that petitioner should have his ship on payment of said 500l. which
he accordingly paid and set sail from Dartmouth but a storm arising
he was forced to put in at Plymouth where the ship and goods were
again seized and the officers threaten to sell the ship: therefore
praying that if the ship be sold he may have the net product

Same to same of the petition of Jona. and Benj. Furley praying
a noli prosequi against a parcel of cut whalebone which they imported
from Holland to Colchester port and is there seized, they having
written to Holland to stop the shipment on the passing of the late
Act ut supra p. 199 but the winds proving contrary the mailes did not
arrive in time to stop the shipment. Ibid. |

Treasury warrant to the Attorney General to enter a noli prosequi
to the information against the ship Etmore frigate belonging to Sir
Alexander Rigby and Jos. Cagnoni of London merchants and seized
with 14 butts of currants ut supra p. 173, the ship being a prize taken
from the French and condemned in the Admiralty and manned all
with English and the currants being the product of Zanté and not
of the Ottoman Empire and therefore (the said owners aver) importable in such prize ships manned with English and being a point
never before controverted; the Customs Commissioners having
thereon reported that the importation of all currants is restricted
to English shipping or the shipping of the country of growth but
in the present case it is only a small part of the lading and taken
up by accident at Leghorn and as aliens Customs have been paid
they consider that a reasonable satisfaction to the officers who
seized will be a sufficient burden on the importers to discourage
any practice of the same kind for the future. Warrants not Relating
