Viscount Mountjoy by way of custodiam the lands or estates of the
several persons as in the schedule below: to be during the King's
pleasure at the improved rents: all by reason that the said Viscount
has petitioned for a grant of 1,000l. per an. or of forfeited lands to that
value, in consideration of his sufferings and faithfulness to the King's
interest: his petition having been referred to the Treasury Lords
and thence to the Lord Deputy and thence to the Attorney-General,
Ireland, which last referee has reported that it appears by the certificate
of the provost and burgesses of the borough of Strabane that they
were eyewitnesses of petitioner's frowardness and fidelity, several of
them having been employed under his command in the Regiment
which he there raised for the defence of the Country and for the King's
interest; and by other affidavits it appears that the Irish army
burned and destroyed the castle of Newtown Stewart and likewise
the castle and town of Ramelton [Rathmelton] and wasted all the
petitioner's estate: further that several of the persons in the annexed
list stand outlawed for high treason; and further on application from
the said Attorney-General to the Commissioners for Inspecting and
Managing Forfeitures in Ireland it appears that there were no inquisitions as yet found in the Province of Connaught where the estates
of the said forfeiting persons lie and therefore they can give no account
thereof until commissions of enquiry are returned but that upon return
of such commissions a grant as desired may be made. |

With this opinion of the Attorney-General the Lord Deputy is in
agreement but conceives that for the present it may be convenient
to grant a custodiam of such forfeited lands during pleasure. |
