Royal warrant granting full power, licence and
authority to William Constable to forthwith repair
to the place [near Hispaniola] where the silver and
other riches were lately taken up (in considerable
quantity out of the sea by the Duke of Albemarle,
which was brought home in the James and Mary,
Capt. Phipps commander), with such company and
assistance as he shall think necessary; and if he
shall find that any other of the King's subjects than
the said Duke or his partners or his agents duly
authorised by the King, have or shall have taken
up any such tresure since the departure of the said
ship James and Mary and before the arrival of the
ships designed for the new voyage (in accordance
with the new contract, ut supra, p. 1426, made
with said Duke and others), then to demand and
receive for the King's use a moiety thereof as
belonging to the King in right of his Admiralty
and to use all lawful means for recovering and
securing said moiety. The said Constable's
acquittances are hereby to be a sufficient discharge.
And he and his executors and assigns are hereby
authorised to detain to his own use a tenth part
of such moiety so recovered and secured. All by
reason that said Constable has represented that it
is very probable that others of the King's subjects
have been or may go to that place between the
departure of the James and Mary and the arrival
of the ships designed for the said new voyage; and
he being willing at his own charge to sail thither
and endeavour the recovery the King's part thereof
as above. (This warrant was cancelled and a new
one drawn July 30: the only difference being that
the new warrant recites a report or certificate of
the 11th inst. made by the Judge of the Admiralty
and the Judge Advocate to the effect that by the
ancient ordinances of the Admiralty his Majesty's
part [as Lord Admiral] amounts to a moiety.) |

her lading (which ship etc. belonged to the subjects
of the States General of the United Provinces and
was taken in the last Dutch war and made prize

Ashburnham: the King's intention in the said
privy seal being that said Ashburnham's name
should be used therein only in trust for the uses
following, viz. as to 300l. thereof in trust for the
King and to be paid into the Exchequer with
preference to any other distribution of the said
moneys and without abatement or defalcation;
and as to two third parts of the residue as in trust
for Phillipp Bickerstaffe to his own use without

soke of Kirton in Lindsey, co. Lincoln, parcel of the

under the Exchequer seal to John Rayner, esq.,
for 31 years on surrender of his term in being and
at a rent of 12l. per an.: and with a clause for
granting him again for the like term the manor of
Hibaldstow at a fourth part rent and to have ten
years' time for the recovery thereof to the Crown:
also with a clause for granting him all such lands
as he shall at his own charge discover to be escheated
to the Crown within the lordship and soke of Kirton
at the like rent of a fourth part of the full yearly
profits thereof. |

Prefixing: the said Fisher's report on said Rayner's
petition for same. By a former ratal and particular
of said perquisites and profits I find that they
were to be granted to Willoughby Rooksby, esq.,
for 31 years from 1685, Lady day. There is a
covenant for the rendering of a triennial account
of the proceeds of the premises, "but this covenant
is generally neglected by all lessees," so I propose
to reinsert it in the new lease with a penal clause
as there are no other means of coming to a true
knowledge of the real value. The copyholders
within this lordship claim their fines to be certain
but they have been anciently accounted uncertain.
and so the lessee covenants to charge and levy
them. The deputy steward, who is now in town.
has given me an account thereof for the last four
or five years, from which it appears that the receipts
do not amount to double the rent. The reserved
rent is supposed to be the full value of the
premises. I therefore advise no fine. I also
advise a lease as above of the manor of Hibaldstow
(Hiberstow, alias Hybalstow), which was formerly
found to belong to the Duchy of Cornwall by inquisition taken at the Guildhall in 20 James I before
the then Lord Mayor, escheator of the said city. |

only honorary things and of inconsiderable value),
