arrears grown due up to the time of the death of

surrender of said Townsend the said annuity is

surrendered his nine years' interest 1683, Nov. 22,
with a view to a fresh lease, but died before the
perfecting thereof; whereby petitioners, his
administratrix, are deprived of legal interest therein.
They have paid the rents to Lady day last. A lease
may be reasonably granted them on the terms
intended to Hutton, who was a great sufferer for
his loyalty, and his father slain in the service of
Charles I. |

The Treasury Lords to the Lord Chancellor. We
deputed George Morley to attend in the Alienation
Office (Office of Compositions on Alienations) [as a
Master in Chancery] to take the oaths of the King's
subjects and to sign the Writs of Covenant and
Writs of Entre, ut supra, p. 1344. It is necessary
for his better qualification that he should be admitted
"as one of the Masters in Chancery only to perform
this service." We are informed you make some
doubt of giving him that character. We send this
to acquaint you that in constituting this deputy
we have proceeded according to the constant usage
that hath been practised time out of mind and
conformable to that power which, as we conceive,
doth belong to us [as Farmers of the Alienation
Office]. To satisfy you we enclose you a copy of
the like deputation made 50 years since by the then
Bishop of London and Lord Treasurer, and the
Lord Cottington, then Chancellor of the Exchequer.
Another was signed by the Earl of Southampton,
Lord Treasurer, and the Chancellor of the Exchequer
in 1660. A third was signed by the Duke of
Albemarle and the other Treasury Lords in 1668,
and we believe no instance can be given to the
contrary. As to the right of the King, it is an office
which concerns the revenue; we are farmers thereof
by patent under the great seal and the enabling
Morley to administer oaths only for the better
ascertaining that revenue is a matter wherein the
revenue is concerned. We therefore hope you
will cause him to be made one of the Masters of
Chancery to attend in the said Office only. |
