Same by same to same of the petition of Daniel Savary, shewing that being a Protestant he is come out of France for refuge and being arrived at Rye with a small barque (being a fisherman) and three or four families of his neighbours, the Customs officers there demand [the French duty or] tunnage duty for the barque and Customs on their household goods: pray to be liable for duty only on merchandises and if further numbers of them come hereafter, that they may have the same benefit. Same from same to the Customs Commissioners approving a proposal from Mr. Randolph of New England, that in regard of the many interlopers which from all parts yearly frequent that country and now more especially since the new impositions in England, there may be allowance made for a good boat and two watermen for boarding of waiters on ships coming to Boston to prevent their delivery of prohibited goods before they [said ships] come under command of the [guns of the] town. Said proposal being approved by the Customs Commissioners is hereby ordered: 20l. is to be allowed for said boat and 25l. per an. each for said two boatmen. Out Letters (Customs) X, p. 55.

When I wrote you last month to provide presents to be sent by Sir William Soames (Ambassador to Constantinople) to the Governments of Algiers, Tripoly and Tunis, Treasurer Rochester thought that Mr. Lodington was gone to Tripoly with the present formerly provided but is now informed that he is not gone but is to go with Sir William Soames. You are not to provide another present for Tripoly because Soames is to present that intended to have been sent by Lodington. Report by same to the King on the petition of Peter Walley, engineer, supra, p. 227, the town of Richmond being in great want of water and very desirous to have it conveyed to them from the Thames by petitioner's engine. The Surveyor General of Crown Lands reports that petitioner's patent dated 1682–3, Mar. 23, was for the sole use for 14 years of a new engine or pump for raising water and that the supply of Richmond is a work of public good and that petitioner may be granted licence to lay pipes through the streets and wastes of the manor (on his compounding with the respective proprietors) and for erecting conduits or receptacles for water in any convenient places; he paying some small acknowledgment of 5s. per an. to the Crown. Same to same for a great seal for a grant to Edward Randolph of the office of Surveyor of Woods in New England as follows. By the vacating of the charter of the Colony of Massachusetts Bay in New England the Province of Maine which was in that Corporation is now devolved to the King. To the intent therefore that all the King's woods, fir trees and other timber trees proper for the Navy and growing within 10 or 12 miles of any navigable river, bays, or harbours in any part of said Province may for the future be preserved from all manner of waste and spoil by any of the inhabitants or others, there is hereby granted to said Randolph the said office of Surveyor of said woods and timber upon any of the mainland, island or islands within 10 or 12 miles of any navigable river etc., within said province: with the fee or allowance of 50l. per an. payable half yearly by the Treasurer of the Navy as from Michaelmas last and to be for defraying the necessary charges and expenses arising upon viewing and surveying the said woods and timber: the said office to be exercised by him or deputy and during pleasure: which views and surveys he is hereby authorised to make at all convenient times in the year and to mark out all such trees as shall be fit for the use of the Navy and to make a register of the same and to transmit fair copies thereof to the Lord Treasurer [in England]: he to observe the directions of the Lord Treasurer or the Navy Commissioners from time to time. The 750l. reserved in the Exchequer for Mr. Skelton is to be issued to him by [way of] advance and similarly the 1,500l. reserved for the Mint Commissioners is to be issued to them by [way of] advance. Treasurer Rochester has moved the King on your presentment of the 12th inst. in which you desire that two small ships may be sent to Barbados to prevent frauds in the Customs instead of a fourth rate frigate which has usually attended that island. Same to the Board of Greencloth. The Lord Treasurer is informed by the King's Counsel that where any inhabitant has an estate certain (for life, years or by will) in any of his Majesty's houses [palaces] the Hearthmoney for same is to be paid by the inhabitant but where his possession is only and immediately for the King as housekeeper without any certainty of estate the said duty is not to be paid. Give my Lord an account of the persons that inhabit in his Majesty's houses and of their several estates therein. Ibid.

Also the delay in passing leases so long after agreement made by the tenants may be detrimental to the Crown by the possible death of some of the lives whereby the King would lose his fine, the grantee being still at liberty to name others which the Clerk of the Pipe cannot prevent "the warrants being not presently transmitted to him as in this particular case it has happened." Prefixing: said report. When I came to Tangier Major White was only town major; when he died I made Lieut. William Davis town major and dismissed him of being Lieutenant; I offered the Lieutenancy to Mr. Flyn, who said he could not take the oaths of allegiance and supremacy, which I conceived made him uncapable of being either Aid Mayor or Lieut. Major. John Hope was town major afterwards and was Lieut. of the Guards, but the Company he was Lieutenant to was in England "so I think [he was] not of a double capacity at Tangier, the pay of town major being but 10s. a day." Both the Mayors behaved themselves extreme well and took great pains in regulating that garrison. Lord Dartmouth will certify what care the latter [of them] took at the demolishing the place.

Prefixing: said report. I have repaired to Beare Forest and viewed the lodges and rails of East Walk and Creech Walk, and find repairs (detailed) needed at the East Lodge, which is the chief lodge and has 20 acres enclosed for the relief of the deer. Creech lodge is so ruinous that it must be rebuilt. This can be done for 60l. as it is a small lodge merely for an underkeeper. There is only one other lodge in this forest, the West Lodge, which is the ancientest and largest of them with 60 acres enclosed. The keeper, Mr. Watts, has kept it up at his own expense. I cannot find that any money has been granted from the Crown to any uses of this forest since the Restoration. There is a coppice ground of the King's in this forest called Mislingford Coppice, containing 60 acres heretofore enclosed as a nursery, but cut down in the rebellion and left open. It is in the King's right to enclose it and this should be done "as hath been sundry times represented to the Treasury within some years past." The forest is very thin of trees (which appertain to the King) but in Creech Walk there are young and old trees of the King among which many are unfit for shipping. "Though the forest cannot decently allow of any trees to be felled for raising money, but only for the timber there necessary to be used in the above mentioned repairs, yet for the excellent breed of deer which it produces and its nearness both to Winchester and Portsmouth" it deserves your Lordship's favourable regard. The wages of the three keepers is at most but 3l. each per an. payable out of the quit rents of Porchester, "which being very uncertain they say they seldom receive above 50s. a year a piece."

"The way of passing leases for the Duchy of Cornwall (as began and practised since the late King's restoration) is scandalously damageable to the revenue and grievous to the tenants." The ordinary fees in the many offices amount to at least 17l. or 18l., and usually to 25l. besides expedition money, attendance and solicitation of at least three months, sometimes 12 months, whereby small tenements lie ruined and untenanted and improvements in wastes by building of stamping mills and making new erections and enclosures are wholly lost and the tenant disabled and discouraged to renew their estates, the fees often exceeding the fines. It is therefore proposed for a remedy that the Treasury have always before them an exact survey of every manor and of the yearly value of every tenement and how estated and that transcripts of them being sent to the respective stewards they may have power, under limited rules, to make contracts with the tenants in the country, subject to the control of the Lord Treasurer and that upon return and approbation of such contracts a warrant for the lease may be passed without other ceremony or delays "as hath been the ancient practice": [further] that the leases be in English whereby the tenants may understand what they are obliged to do by their covenants for planting and preserving trees and other improvements which are now neglected and excused by pretence of ignorance.

If you think the said sloop wants men you are to present to the Lord Treasurer such as are necessary for that service. Sir William Stapleton, Governor of the Leeward Islands, to Henry Guy, dated London, in reply to the demand for an accompt of all public money received by him as such Governor. Whatever I have received I am ready to take oath of it, but the public accompts of those islands have been kept by a Receiver in each island, which are delivered in and sworn to by them respectively before the deputy Governor of each island. I can no more swear to any public accompts than he that was never there. I am accomptable for any seizure I ordered the Marshal or any one else to receive. Indeed were the Leeward Islands entire as Barbados or Jamaica it might be as easy for me to give an accompt upon oath as not but being remoter and more separate by sea than England, Scotland and Ireland I am as ignorant of the receipts and disbursements in the respective islands as any man. I will wait upon the Lord Treasurer and I know him so well that I believe he will impose no impossibility upon me to affirm anything upon that I am neither conscious of or ever meddled with.
