a bill of imprest to be made forth by the officers of
the Ordnance for said 300l. to Holmes on account
for fortifications and other services in said island.
On his endorsing the said bill, as a receipt, the
receipt which he gave to the collector, and which
is in the hands of the Secretary to the Treasury,
shall be delivered up to him. Care will be taken
that the Treasurer of the Ordnance shall be charged
with the like sum in the Exchequer. |

the 375l. arrear due to him up to 1684, Christmas, on

North (which office was granted to him in 1660 for
life with said salary as payable out of the Crown
revenues in co. Yorks, and when same became no
longer so payable by reason of the sale of fee farms
it was by a privy seal of 27 Car. II made payable
out of the Exchequer, whereupon it has so been
paid up to 1677, Lady day, with 12l. 10s. 0d. in part
of the succeeding half year): the payment of said
arrears on the above privy seal being obstructed by

Commissioners of Excise and Hearthmoney have
presented me a paper containing several objections
made by Justices of the Peace in several counties
touching the receiving and levying of the Hearthmoney with the answers of said Commissioners
thereto. They desire same to be communicated to
the Justices of Assize to be by them mentioned in
the respective charges at the assizes so that the
Justices of Peace may take note thereof and the
revenue be with less trouble collected for the future.
The Attorney General conceives that the said
answers are according to law and that it would be
to his Majesty's service that the Judges in their
several circuits either on the Bench or in their
Chambers should call the Justices of Peace before
them and acquaint them therewith. I enclose said
paper and desire you to do as above within your
circuit. (The like letter to Baron Gregory and
Justice Levings for the Oxford Circuit and to Baron

that said Office of General Receipt of the Customs be
hereby continued and shall extend to the Customs
generally as renewed to the present King by the Act
of 1 James II, c. 1, and also to the new duties on
wines and vinegar as by 1 James II, c. 3, and the
new duties on tobacco and sugar as by the Act of
1 James II, c. 4, and the new duties on French
linens etc. as by 1 James II, c. 5; and likewise to
extend to the receipt of the Four and a Half per
cent. duty in Barbados and in the four islands
commonly called the Leeward Islands, viz. Nevis,
Antigua, Montserrat and St. Christopher, settled
by the law made in Barbados in 1663, and by four
several Acts passed in 1664 in the said several
islands; and likewise to extend to the receipt of the
Coinage Duty as revived by the Act of 1 James II,
c. 7, and to the receipt of all other Customs.
whatsoever except the duties on any strong waters,
brandy, aqua vitae and spirits. The said office to
be kept in the Custom House, London, and to be
open daily till 4. He to pay his receipts weekly into
the Exchequer every Tuesday, keeping the moneys
of all the above five heads distinct and separate. He
to present to the Lord Treasurer every week on
Tuesday an account of his receipts and payments
and remains which is to be attested by the Comptroller of the Customs: all with the salary of 1,000l.
per an. as from Christmas last: he to detain 500l.
in his hands for the half year thereon to June 24
last. He to present a yearly account of the Customs
at Michaelmas or within three months thereof: with
exemption from juries etc. to him and his clerks.
And whereas the said Richard Kent and Charles
Duncombe have lent several considerable sums to
the late King and may hereafter lend to the present
King it is hereby declared that all such moneys
shall be well and truly repaid upon their tallies for
the same upon the Customs other than the abovesaid new duties on linens and coinage duty which
are appropriated by Parliament: together with
6 per cent. interest for same. "And to the end it
may be in our power from time to time during the
continuance of the said Richard Kent in the said
employment to have in our hands by way of credit
or loan to us upon our said revenue of Customs the
sum of 40,000l. of the moneys of the said Richard
Kent and Charles Duncombe or of the proper moneys
of him, the said Richard Kent alone, or so much
of the said sum as we shall from time to time think
fit for the supply of our occasions and to be a further
and better security for the said Richard Kent's due
performance" of his trust herein the said Kent is
hereby to covenant that as soon as he and Duncombe
are satisfied the debt now due to them by tallies
on the Customs, or when less than 40,000l. shall
remain due to them thereon then Kent will advance
on the Customs any further sums for the supply of
his Majesty's occasions to the amount of 40,000l.

Instructions by same to same in reply to their
memorial of the 30th inst. (1) There is
a doubt as to the duty on French linen, viz.
whether the new Act meant only to double
the duty on French linen or whether they ought to
pay double the duty over what they paid before
"the former being supposed to be according to the
sense of the House of Commons." Upon a
prudential consideration you are to collect only
double what they paid before. (2) By a clause in the
Act for the duty on tobacco and sugar the duty is
to be levied on consumptions thereof in this kingdom,
that is to say, it is to be paid by the importer if he
be a shopkeeper, retailer or consumptioner upon
the importing the goods. Hereon you state a case:
a shopkeeper dealing in tobacco and sending a
ship to Virginia and bringing thence 50 tons of
tobacco which cost there about 500l. is liable to the
whole new duty in ready money which, with the
former Custom included, amounts to 2,500l. which
sum he is not able to pay. If you take the goods
into the King's store the King's warehouses will be
filled with tobacco and only such little proportions
of money will be received as the retailer shall have
occasion to dispose of his goods, and besides the
great loss of duty by damage and decay of the goods
this practice will be subject to great charge, corruption and deceit and this is likely to prove a
common case in Bristol and other ports. You
offer as an expedient that whoever shall import 10
hogsheads or upwards shall be deemed an importer
and give security as a merchant importer. I
approve thereof and you are hereby to take security
for the duty accordingly in all such cases. (3) By
the same Act it is provided that every merchant or
importer that is not a retailer shall give security in
double the value of the duty not to dispose thereof
before the duty be paid or if he shall not sell or
export same in 18 months from the importation,
that he will pay the duties. You inform me that
many seamen import tobacco in bulk and cannot
pay the old Custom of 2d per lb. or find security to
pay the new duty of 3d. per lb. when it falls due: that
a merchant is willing to buy this tobacco of the
several seamen, to pay down the old Custom and
give security for the new duty as if be had been the
importer. In such case, which frequently happens,
you are to admit the merchant so to do. (4) Several
merchants, importers of tobacco, desire to pay this
new imposition in ready money provided they may
have an allowance or rebate for the time given by
the Act. You are hereby to give them a rebate of
2 [sic for 10] per cent. per an. which is the usual
rebate in other parts of the revenue. |
