Treasury warrant to the Surveyor General of Crown Lands for a particular of the [fee farm] rent of 66l. 13s. 4d. reserved on the grant 1602, Dec. 23, to Sir Robert Cecil of the great and little Parks of Brigstock, co. Northampton, in order to a grant thereof to Francis, Earl of Bradford, for the sum of 916l. 3s. 4d. to be paid to the King. Ibid, pp. 411–13.
Prefixing: said Surveyor's report on said Earl's petition for same, ut supra, p. 959. The grant of 1602 made said rent payable after the death of George, Lord Hunsdon, and Eliz. his wife, who then had the custody of herbage and pannage of said parks by grant dated 1591, April 6, made to him by the name of George Carey, esq. The 1602 grant was confirmed 1611–12, March 2, with liberty to the Earl of Salisbury to enclose, dispark etc., notwithstanding the premises were theretofore accompted within the forest of Rockingham “ and declared the premises to be thereby totally de-afforested.” They have been enjoyed ever since by the Earls of Salisbury, but the Auditor cannot find that the said rent was ever in charge in his office or in the Pipe. The Parliament Survey of 1650 makes no mention of this rent, but it notices a grant 10 James I of the manor of Brigstock to one Linton for 60 years at the rent of 66l. 13s. 4d., and this manor rent is now part of the Queen Dowager's jointure. If the fee farm rent is not expressly granted since 9 James I it appears to be a concealment and may be granted, having not been paid for 40 years before the Act for Sale of Fee Farms, 22 and 23 Car. I, c. 6. If a good discovery the premises are chargeable with arrears of rent from 1660, June 25, “ which at Lady day, 1695, amounts to 2,333l. 6s. 8d.” The rent itself may be valued at 20 years' purchase, making 3,666l. 13s. 4d. in all. But petitioner is to maintain the Crown's title against the Earl of Salisbury.

Royal warrant to the Lords Justices, Ireland, for a patent to pass the great seal of Ireland for a grant to Sir Christopher Wandesford, his heirs etc., of all the Crown title in the legacies forfeited by the attainder of the persons as follows by the name and quality of Brenans: it appearing that said Wandesford's grandfather had a title to the territory of Idough, co. Kilkenny, and did on the 2 Oct., 1640, being then Lord Deputy of Ireland, make his will, giving legacies to several native Irish who were his then tenants and were part of the Sept called the Brenans; that in 1641 the said Sept possessed themselves of all his estate and stock and destroyed all his buildings to the value of many thousand pounds, murthered many of his English tenants and enjoyed the greatest part of his estate for 10 years; that several persons of that name, pretending to be the posterity of the said Brenans, obtained a decree in the Chancery of Ireland against Sir Christopher's father for the performance of the said will, but the said will and decree do not affect Sir Christopher in regard the term of years for raising said legacies expired before the estate came to him; that the said Sept being still very numerous are a great terror to the English inhabitants there and frequently commit many great robberies and murthers and were in arms for the late King James, and as Sir Christopher was early in arms for King William they persuaded the Earl of Tyrconnell to seize his estate and again possessed the same for a considerable time; that Sir Christopher at his own expense procured their outlawry for treason; that since by a Commission of enquiry touching the forfeitures in co. Kilkenny and by an inquisition had thereon the Crown is found entitled to the benefit of the said decree by reason of the outlawries of the said Brenans: as to all which statement in Sir Christopher's petition the Solicitor General of Ireland, Sir Richard Levinge, has reported, reciting parts, here detailed, of said will (” whereas also the natives of Idough called Brenans who have for many years possessed the same have several times refused such proffers of benefit as I thought good out of my own private charity and conscience to tender unto them, not that I ever believed by law or equity I could be compelled to give them any consideration at all for their pretended interest, I will . . that John, Lord Bishop of Deny, Sir John Osborne, Major Norton and William Wandesford forth of the demised premises of Castle Calmer shall pay and satisfy unto so many of them and their children as by a commission to be directed out of the Court of Chancery shall be found to have been reputed possessors and term tenants of the land at the time of the office of Idough dated 21st of May, 1635, so much money severall as a lease for 21 years of the moiety of those lands so in their possessions respectively shall be by the said Commissioners valued to have been worth unto the said possessors at the time of finding the said office after the common course of bargaining”) and further that one Charles Brenan and 22 others of that name claiming under that will exhibited a bill in Chancery in Trinity term, 1679, against Sir Christopher Wandesford, father to the now Sir Christopher, which cause was heard 1686, June 10, and decree passed that the will ought to be performed in reference to the legacies and Commissioners were ordered to enquire as to the legatees' title and their ancestors' holdings at 1635, May 21: that up to the time of said Sir Christopher's death in 1686–7, Feb. 26, no proceedings thereon appear, but in 1687, June 4, some of the Brenans exhibited a bill of Revivor against the present Sir Christopher in the same Court, to which he pleaded that the 41 years limited by his grandfather for satisfying the said legacies had expired in 1681 and that three settlements of the estate had intervened, viz. of 1640, Sept. 30, by his grandfather and 1652 by his father (on his marriage with Hellen daughter of Sir John Lowther) and of 1683 on the present Sir Christopher's marriage with Elizabeth daughter of George Montague: and further that the following persons all of the Sept of the Brenans and all or most of them plaintiffs in the said suits were outlawed of high treason for the late rebellion, viz.: John Brenan, late of Lovin [Luffany] co.
