Dec. 17. Reference to the Customs Commissioners of the petition of Robert Culliford and Elizabeth Rought, relict of the late Searcher at Southampton, same showing that two years since Robert Murrey, deputy Searcher at Cowes, seized 20 todds of wool and two dickers of hides which Treasurer Danby ordered to be discharged, but they [petitioners] have discovered false package in the said goods, and therefore pray Treasurer Danby's direction whether they shall prosecute the same to condemnation as forfeit by law, or deliver them. Warrant from Treasurer Danby to same to permit the export to Holland by Dr. Cox, Chaplain to the Princess of Holland, of certain trunks of clothing, a trunk of books for the Princess of Orange's chapel matted and directed to Dr. Lloyd, three boxes filled with books and a leather hat case. Ibid.
Same from same to same to deliver to the Earl of Dunbarton, Customs free, the following goods belonging to him and now in the Customs Warehouse, London port, viz., clothes, a paste board packet written for Lady Poultney, a packet directed for Mr. Kemble, a muff, essences, gloves, etc. Ibid, p. 394.
The like for delivery, on payment of Customs, of the following goods belonging to Lady Hamilton and now in the Warehouse, London port : viz., a muff, Indian stuff, gloves, ribbon, point sleeve, point cuffs, a point cornet, laced hoods, black hoods, false lace for a petticoat, fans, two boxes with pictures. Dec. 18. Cave that no docquet pass for a grant of the estate of Capt. Thomas Boothe forfeited to the King by his conviction until Mr. Abraham Stock, father of Abraham Stock and Susannah Stock, executor and legatee of the will of Capt. Charles Bertie to "Good Cousin" [Sir Robert Howard, Auditor of the Receipt] to levy tallies on the Excise (and same to the Receivers of Excise to pay said tallies) for 212l. 10s. 0d. grown due to Sir William Killegrew at Michaelmas last on his pension of 500l. per an. Out Letters (General) p. 191.
Same to same to pay off Mr. John Lawrence's order of Nov. 9 last for 73l. 15s. 0d. by him expended about the Trial of the Pyx June 14 last : to be paid out of [moneys in] the Exchequer [arising out] of [sheriffs'] proffers. Ibid.

Dec. 19. Warrant from Treasurer Danby to the Customs Commissioners to discharge the seizure of the ship Patience, of London, with her lading of wines from France as petitioned for by Sir Patience Ward, said ship having returned to London from Rochelle with wines and navigated by the master and five English, two Scots and one Greek : it appearing that by reason of the sickness of one of the men whom the master sent home, he was necessitated to employ two Scots, yet so that he paid them no wages but brought them out of charity, though thereby he served his own occasions of bringing home his ship. Constitution and authorisation by same of Francis Carpenter, of London, gent., for six months to search of for ships and goods seizable under the Acts relating to Navigation and Trade. Ibid, pp. 395-6.

Same on two orders for Samuel Pepys as Treasurer for Tangier, viz., one of Oct. 30 last for 13,858l. 5s. 11d. in part of 14,300l. for last Sept. 29 quarter's establishment for said garrison ; the other of same date for 3,050l. 14s. 0d. in part of an arrear of 22,767l. 6s. 3d. to same : both to be hereby satisfied ut supra. Money warrant for 1,766l. 13s. 4d. to Samuel Pepys as an advance of pay to the Earl of Inchiquin, Governor of Tangier : to be defalked, etc. ; as by the privy seal of the 12th inst., supra, p. 791 : before issue is made hereof said Auditor is to take into his possession a bond dated the 10th inst. given by said Earl to the King to make good the said advance money out of his proper moneys in case of removal, death or otherwise. Said bond is to be lodged safely with the imprest to be made use of as there may be occasion.

Privy seal for such sums not exceeding 20,000l. in all to Isaac Legouch, the King's Jeweller, as the Lord Chamberlain, or in his absence the Vice Chamberlain of the Household shall by letter under his hand signify to the Lord Treasurer to be the price of such jewels (with 6 per cent, interest thereon if by agreement interest be to be paid) as he shall from time to time furnish for the King's service : to be without account, imprest or other charge. And if it shall happen that there are more moneys due to the said Isaac Legouch (for which orders have been already drawn) than any privy seal already passed will bear, then such surplus and the money warrants for same shall be warranted by the present privy seal. Royal warrant for a privy seal as follows. Upon surrender of Visct. Hawley we conferred upon Sir John Berry, Kt., the command of Deal Castle, commanding him to pay said Visct. Hawley 800 guinea pieces of gold, upon our royal word [promise] to repay it to him [Berry]. Said Berry has besought us to repay same and in order thereto has proposed to prosecute Nicholas Girlington, of Lancaster, late Receiver of Hearthmoney for said county for the moneys due from him to the King and thereout to receive said 800 guineas if Girlington's debt will amount to so much. Said Berry is hereby to be empowered to sue for and prosecute said debt due from Girlington and to compound for same with said Girlington and to receive thereout such sums as the Lord Treasurer shall think fit and direct in satisfaction of said 800 guineas, the interest thereof and the charges of recovery. Same for a same for a grant to St. John Booth, John Booth, two of the sons and Elizabeth daughter of Sir John Booth (at the humble suit and nomination of said Sir John Booth and Sir Richard Haddock) of all the goods and chattels, real and personal, leases, mortgages, bonds, bills, debts and money of Capt. Thomas Booth, who was lately convicted and executed at Yarmouth for murder whereby his personal estate became forfeit to the King. Same to the Attorney or Solicitor General for a great seal for a grant of the office of Clerk of the Irons in the Tower and Surveyor of the Melting Houses there, to James Cardrow and William Hastings the survivor of them and the heirs of the survivor of them for and during the life of William Evans, son of George Evans, gent., and no longer : to take effect after the determination of the said George Evans's interest in said office. Royal warrant to the Clerk of the Signet for a privy seal for an annuity or yearly pension of 200l. per an. to Ralph Widdrington, Esq. : payable quarterly during pleasure : the first payment to be at Christmas next : and to be received without account. Same to the Attorney or Solicitor General for a great seal for a grant of the office of Clerk of the Treasury in the Court of Common Pleas to Sir Thomas Gerey, Kt., to him, his executors, administrators and assigns for the full term of 31 years immediately from and after the death of John, Lord Berkeley, and the change or removal of the present Lord Chief Justice of the said Court, or other sooner determination of the present interest therein : with like fees, perquisites, profits, powers, etc., as said John, Lord Berkeley or any other hath had. Same to the Clerk of the Signet for a privy seal for such sums not exceeding 275l. 19s. 0d. to Sir Thomas Armstrong as have been by him disbursed for hackney coaches, post horses and other horse hire and contingent charges for the Prince of Orange ; upon a bill thereof to be allowed by the Duke of Monmouth. And further for such sums not exceeding 385l. 7s. 7d. to Richard Nevill, Esq., Knight Harbinger, as he hath dibursed and is to pay for lodgings and other extraordinaries for the retinue of his said Highness ; upon a bill to be signed by the Lord Chamberlain : "and such other sums as they shall disburse [in fees at the Exchequer upon the paying of said moneys, and for the cost of the present privy seal] in order to the receiving of the said moneys : to be received without account. Warrant from Treasurer Danby to the Sheriff and Receivers and Auditor for co. Wilts and the Clerk of the Pipe to cause due payment to be made to Dr. William Sancroft, Dean of the Cathedral church of St. Paul, London, of so much of the rent of 12l. per an. for the manor of Fittleton, co. Wilts, as became due at Lady day last, he having contracted to buy same and paid the purchase money into the Exchequer before Lady day last, but the deed by which said rent (among others) was conveyed to him by the Trustees for Fee Farms did not bear date until May 30 last and no direction was therein given for payment of said rent to him for said time. Same from same to the King's Remembrancer to issue forth a Commission to John Ramsey, Nath, Bladen, Barth, Fillingham, Esqrs., Nath., Castleton, John Barnard and George Evans, gent., to enquire and seize the house and premises lately built in Channel Row, Westminster, by the husband of Sarah Hawkes which he now holds by lease, but by reason of his being an alien the same is or will be forfeit to the King : as appears from the petition of said Sarah Hawkes setting forth that her husband built same with borrowed money, and praying that the King's interest in same may be settled to some person for relief of her and her children. Warrant from Treasurer Danby to Thomas Agar and Charles Strode, Surveyors of Woods, Trent South, and to the rest of the officers of Dean Forest to permit John Wade, gent., quietly to take away 30 tuns of old timber, he having as one of the King's Commissioners about the inclosures in Dean Forest in 1669 received no recompense for his service therein, but process has issued against him out of the Exchequer for 20l. as the price of said timber sold to him by said Agar, and which said Wade has not yet removed : the King being pleased to remit said purchase price to him.

Same from same to same to deliver to Henry, Earl of St. Albans, the following goods lately imported in the Charles yacht, Capt. Faizby commander, from Calais : viz., 7 French hats, 6 codebecks [Caudebec roughed hats], 5 muffs, 2 cheeses for the King, 1 ditto for Treasurer Danby, 1 ditto for the Earl of St. Albans, 5 sherings. Same from same to same to permit stores and provisions of war as in the annexed schedule [missing] and laden on board the Mary, of London, Stephen Penny commander, to be exported, Customs free, for the service of the garrison of Tangier. Ibid.
Treasurer Danby to the Commissioners appointed to take care of the rebuilding of St. Pauls. Upon hearing the officers of the Works for Windsor Castle who claim 250l. 7s. 6d. part of the Greenwax money grown due (and in Sir Thomas Fanshawe's hands for the King) before the [date of the] privy seal which directed the payment of the moiety of the Greenwax money towards the rebuilding of St. Paul's Church, and upon hearing the Bishop of London and others in favour of the grant to the said church, it appeared to me that the said 250l. 7s. 6d. grew due in the time that the King had appointed that [Greenwax] money for the repairs of Windsor Castle, and that the later direction did not in any sort contradict the same otherwise than by appointing the moiety of what should thereafter accrue to be for rebuilding the said church. I therefore thought it just that said sum should be paid to the Receiver for the Works at Windsor, but inasmuch as the same cannot be done upon the later privy seal without your concurrence herein, I desire you to give directions to your Treasurer to pay 125l. 3s. 9d. (out of the order now drawn for your moiety of the Greenwax) to William Roberts, the Receiver for the Honor and Castle of Windsor. This is the moiety of the order now drawn for your share of the said Greenwax money and with what is contained in the order for the Windsor share will be entirely satisfy the said sum of 250l. 7s. 6d. and will prevent all further charge and trouble of making any alterations in the present privy seal or accompts of that [Greenwax] revenue. Dec. 21. William Prestcott, of London, merchant, living in Angell Court in Throckmorton Street, having a petition depending before Treasurer Danby for payment of 80l. with interest and charges out of Sir Richard Bulstrode's ordinary [viz., as] for so much advanced to him [Bulstrode by said Prestcott] at Brussels ; and Sir Richard on notice of this petition having by his letter agreed that the same be paid viz., one moiety out of his next payment and the rest out of the next ensuing payment, Cave that care be taken hereof when his [Bulstrode's] warrant is signed. Dec. 24. Privy seal for 500l. to Lemuis (Lemuel) Kingdon as imprest to be by him paid over to Col. William Stapleton, Governor of the Leeward Islands, to be by him employed and expended in building and furnishing a fort at the place called Cleverly Point for the defence of the island of St. Christopher ; it having been thought necessary for the strengthening of said Colony to raise some considerable fort, and said Cleverly (Cliverly) point being thought most convenient for the safety and protection of shipping ; the King being informed "that the islanders will willingly contribute their labour and endeavours threeunto, so that if we furnish 500l. towards the building thereof they will supply the rest." Royal warrant to the Clerk of the Signet for a privy seal for a grant to William Killigrew, his administrators and assigns, of the personal estate of William Toms, late of Tewkesbury, co. Gloucester, who was at the assizes lately held at Gloucester, convicted of high treason for coining and afterwards executed whereby his personal estate became forfeit to the King : with full power to said Killigrew to prosecute for and recover said estate. [?] Royal sign manual to Treasurer Danby to pay (out of the 10,000l. dormant privy seal) 140l. to Latitia Biggs and Grace Peirson or their assigns for their interest in a certain field and garden situate near our royal citadel at Plymouth and containing by estimation 4 acres 3 rods 17 perches, bounded with the lands now or late of John Rashleigh, Esq., on the west, the ground called the Beacon Haw on the south, the lands now or late of John Davis on the east, and the lane leading to the old mills on the north, part whereof is in lease to said Biggs, relict of Abraham Biggs, and said Peirson, his daughter, for the life of George Bagg, Esq., aged about 50 years, under the rent of 1l. 6s. 8d. per an. payable to the mayor and commonalty of Plymouth to whom the inheritance thereof belongs : which said premises with the house thereon having been valued at 20l. per an., the Surveyor General has rated the interest of said Biggs and Peirson at 140l., which sum the King has agreed to pay to them for such interest and for the damage they have sustained by demolishing the premises or making use of the same for the benefit of the citadel at any time before date hereof. Before any payment be made hereon they are to assign their interest by conveyance to be approved by the Attorney General. (For money warrant hereon see under date 1678, June 1.) Dec. 24. Treasurer Danby's subscription of a docquet [of a privy seal] for the discharge of the baronet fee of 1,095l. due to the King from George Wharton. Letter of direction on 5,884l. 5s. 9d. as the remainder of an order dated Dec. 1 for 54,550l. to William Ashburnham for the Household whereon 48,665l. 14s. 2d. was directed the 8th inst. Warrant from Treasurer Danby to the Customs Commissioners to deliver, Customs free, a coach lately brought from Holland and belonging to the Envoy from Brunswick Luneburg. Out Letters (Customs) III. p. 398.
Same from same to same to pass outwards, Customs free, the equipage and baggage of Don Carlos de Borgia, viz., a coffer, a case and some portmanteaus. Ibid.
Same from same to the sheriffs of London and Middlesex to deliver forthwith to William Freeman, of London, merchant, so many of the malefactors within mentioned [schedule thereof missing] as are at present in your custody without requiring any fees of him for the same, he giving bond for conveying them to Saint Christopher : and that from time to time hereafter you deliver such transportable malefactors as you shall have in your custody to complete the number [of 300 as below] to such merchants or planters as I shall give you notice of, viz., without fees and upon such bond [as above]. For satisfaction of the prison fees due for the said malefactors the Clerk of the Pipe is hereby to allow on your accounts 1l. 11s. 0d. per head for the malefactors you shall so deliver. And whereas it is likely that you will be in surplusage upon your accounts hereafter, I intend for the future to issue my warrants for charging the same by record of surplusage on the sheriffs of any other counties who shall be indebted on their accounts.
Prefixing : Order of the King in Council dated Whitehall 1677, June 1. The Lords Committees for Trade and Plantation this day reported to the board that in order to a further supply of inhabitants of the colony of St. Christopher they had discoursed with some merchants touching the transportation thither of such malefactors as by law might be transported, and said merchants declared that they would willingly take off and transport considerable numbers provided they might not be obliged to pay for them at the gaols in regard of the great fees demanded by the keepers : and that thereupon the said Lords considering the advantage which might accrue to the King by having the said island supplied as aforesaid, did advise with Sir John Shorter, Kt., then one of the sheriffs of London, to know how far the charges of the gaol relating to each malefactor might be reduced, whereby they found that the said charge might be brought to 1l. 11s. 0d. per head, which for 300 malefactors (which is the number the merchants were willing to take and thought requisite) amounts to 465l. Said Lords further proposed that said 1l. 11s. 0d. be allowed to the sheriffs in their accounts as above ; and further that the merchants or planters who received the said malefactors free from the gaol might enter into bond before the Recorder of London for their safe conveyance to St. Christopher. All which the King hereby approved and ordered the Lord Treasurer to direct the performance thereof.

Warrant from Treasurer Danby to the Surveyor General of Crown Lands to give order to the steward of the manor of Ryme to pass to Henry Kymer an estate [of a copyhold in said manor] by copy of Court roll according to the Custom of said manor for three lives to be nominated by said Kymer : without fine and under the ancient rent and services.
Prefixing : note of said Kymer's petition as referred to said Surveyor General, July 10 last ; and of said Surveyor General's report dated July 13 thereon, proposing a grant in reversion for three lives at a fine of 30l. "for that the widow has not repaired the premises as she ought to have done."

Royal warrant [to the Attorney or Solicitor General] for a great seal for a grant to Richard Folyard of the fee of 100l. per an. during pleasure in consideration of his good service done and to be done in attending our person as our barber in extraordinary : to be payable quarterly, commencing the first payment from 1676, Michaelmas. Charles Bertie to the Customs Cashier to bring in with respect to the weekly payments (and same to the Auditor of the Receipt to issue) 18l. 5s. 6d. to Andrew Lawrence for half a year's wages of 2s. a day as Surveyor of the King's highways, etc. Out Letters (General) p. 195.
Warrant from Treasurer Danby to the Customs Commissioners from time to time upon certificates to you from the Master of the Ordnance to permit the export, Customs free, of such quantities and kinds of ammunition, stores or provisions as he shall so certify to be for the supply of the Plantations and Colonies beyond the seas or for ships in the King's service abroad ; same being frequently so shipped and for want of despatch in clearing or passing the ships or vessels it may sometimes happen that the King's service may be retarded. Dec. 29. Warrant dormant from same to the Customs Cashier to pay the annuity of 2,000l. to Prince Rupert as same is already grown due or shall hereafter grow due. Money Book (General) p. 176.
Warrant from same to same to pay to the executors of Richard Gregory, deceased, 3l. 13s. 4d. for his services in attending [the Lord Treasurer as Messenger for] the affairs of the Customs from June 24 last to July 15 following, being 22 days at 3s. 4d. a day : it appearing by certificate of the Curate and Register of the parish of St. Giles in the Fields that said Gregory died on said 15th of July.
Followed by : Treasurer Danby's allowance of the like fee for 21 days to same for his attendance on the Lord Treasurer for same time. Money warrant for 1,000l. to Sir Robert Vyner for one year on his annuity as by the patent of 1671, Sept. 15 : to be by tallies on the Customs. (Together with warrant from Treasurer Danby to the Customs Cashier to take wine bonds from Phillip Marsh to abovesaid value and to deliver same to said Vyner in settlement of said tallies : with the usual clause for reckoning and allowing the merchants' 10 per cent. discount on such bonds.) Same from same to William Richardson keeper of the King's gaol of Newgate. You have lately apprehended William King and Henry Clayton suspected to be two highway robbers, and you found in their possession 5 geldings, 2 mares, 1 silver dressing box and 2 silver powder boxes, which remain now in your custody. You are to keep same safely until the trial of said prisoners, and if same accrue to the King by their conviction, you are not to depart therewith to any persons till the King's pleasure be known therein. Same from same to the King's Remembrancer to issue a Commission under the Exchequer seal to Giles Dunstar and Anthony Ettrick, Esqrs., John Sansom, Robt. Jones, John Willy, senr., and Henry Flory, gent., to enquire concerning several abuses that have been committed in the landing uncustomed and prohibited goods in the port of Poole and the members, creeks and districts thereof to the great prejudice of the Customs. Dec. 31. Privy seal for 240l. per an. to Phillip Packer, Paymaster of the Works, to be by him paid to Leonard Gurle as gardener and keeper of the royal garden in St. James's Park between St. James's Park House and the Spring Garden wall, said Gurle being thereto appointed for life, loco John Rose deceased, commencing the first payment from Sept. 29 last : same to be for said Gurle's wages for keeping said garden : and further to pay him 320l. a year as by his agreement for maintaining the charge of keeping said garden as was formerly paid to the late John Rose on the like agreement, as by the privy seal of 1676, Aug. 31 : same to be for paying all workmen, labourers and weeders, for procuring and paying for all dung, for raising of melons, making hotbeds for sollading, melon glasses, waterpots, wherebarrows, waterbarrows, watertubs, spades, rakes, houghs, dung forks, lines, reels, shears, nails, leathers, scythes, rubbing stones, hedging irons, pruning hooks, pruning knives, poles for hedges, seeds for pannels, shells for the walks, stone and wooden rolls, fruit baskets for our table's service, silk and paper to tie the fruit down, seeds for sallets and other herbs for our kitchen and for paying all other charges relating to the keeping of the said garden in as fair and ample manner as same has been ever kept excepting the wages of said Gurle and [excepting also] all alterations, new erections or other additions which we may command to be made in said garden. The said agreement and the said 320l. per an. to be during pleasure. Further as said John Rose and his administratrix have been at the charge of maintaining said garden till Sept. 29 last the said 320l. per an. is hereby to be paid to his said administratrix up to Sept. 29 last and no longer. Privy seal for a grant to Sir Gilbert Talbot of an annuity or yearly pension of 400l. payable at Lady day in every year out of the moneys which shall yearly accrue to the King or his successors and be payable into the office of the Jewel House for presents made by noblemen usually called New Year's gifts : with power to said Talbot to retain in his hands the said sum out of the said presents yearly : for life : the first 400l. hereon to be by him detained at Lady day next : such detentions to be allowed to him upon all accompts by him to be made for the said New Year's gifts : all in regard of the long and faithful services of said Talbot to the King and Charles I.
