Report to the King from Treasurer Danby on the
report dated Dublin Castle July 21 last from the
Earl of Essex, then Lord Lieutenant of Ireland,
on the petition of John, Lord Berkeley, as by the
order of reference of June 11 last referring said
petition to the Lord Lieutenant : the said report
from the Earl of Essex being as follows. By patent
of 1671, Sept. 15, said Lord Berkeley was granted
a pension of 1,200l. per an. during pleasure. By
great seal of 1674, Dec. 4, the arrear of 3,000l.
owing thereon was ordered to be paid as to a moiety
thereof out of the Customs and imported Excise
of Ireland between 1675, Dec. 25, and March 25
following and the other moiety out of same between
1676, March 25, and 1677, June 24. But as the
moneys of said Customs and imported Excise
of Ireland were wholly applicable to the charge
of the present establishment of Ireland and the
said pension was omitted out of the same, I was
as I conceive restrained from allowing the petitioner
the benefit of said great seal. So no part of said
pension has been hitherto paid to said Lord nor
is there any fund on which same may now be placed
unless it be placed on the surplus which will hereafter
arise on the revenue of Ireland above the
present establishment thereof. The abovesaid
report being referred to Treasurer Danby Sept. 21
last, Treasurer Danby hereby reports that the said
surplus of the revenue in Ireland has since been
fully charged "so that it doth not appear to me
that the said arrear can be satisfied unless your
Majesty shall think fit to direct the payment thereof
some other way."

Mr. Whitfield, Clerk of the Estreats, is informed that
one Mr. Legge is suing for a reversion of his [Whitfield's]
office after Peer Williams his [Whitfield's]
predecessor, who had once a patent for his [said]
office at the King's restoration, but held it [only]
by Treasurer Southampton's fiat when the said
Earl of Southampton was Treasurer. But said
office was always before that patent granted by the
Lord Treasurer's fiat and so [by that tenure]
Mr. Whitfield holds it now and [therefore] desires
that this new grant (which Legge petitions for
and which is referred to the Attorney General's
consideration) may not pass till he be heard.

the Elizabeth, of Jersey, for having transgressed

Danll. Jauvrin, et al all his Majesty's subjects [being]
the master, merchants and others calling themselves
owners of said ship, begging to be heard in Council

detailed. This day Thomas Templeman, master
of the ship Mary, now going out, attended and
being called in with his counsel together with two of
his employers and freighters, Mr. Lionel Craftes and
Mr. Henry Rumsey, who affirming that the ship
was not designed for any part of Africa to the
prejudice of the Royal Africa Company, the King was
pleased to order that said Crafts and Rumsey
enter into bond of 500l. each not to permit or suffer
said ship to touch at Guinea or any part of Africa
to the prejudice of said Company, either in going or
returning : and then the stop of said ship to be
taken off : which the said person having done,
said ship is hereby ordered to be discharged [of
the stop on her].

frequented : all by reason that the said
Company complains of many interlopers intruding
upon the said trade and passing goods without
