manor of Carnunton, co. Cornwall (a manor of ancient
demesne of the Crown and not of the Duchy of Cornwall), and
all free and copyhold rents (amounting together to 52l. 8s. 4d.
per an.) &c., thereof, lands, tenements, courts, royalties,
privileges, fines and other casual profits (valued at about 7l.
per an.). &c., for 99 years free of rent during the life of the

the present grant to be in consideration of the many loyal

|
Treasurer Danby to the Treasurer of the Navy. I am informed
that there is a present want of hemp in the Navy, and if a
quantity be not bought now the market is like to rise, but the
merchants are unwilling to sell without ready money or [else
only] at extravagent prices. You are to buy the said hemp with
ready money, which I will supply to you in part of the 100,000l.
on the Customs designed for stores. But Visct. Brouncker is of
opinion it will be best for the credit of their [the Navy] Board
to have a contract there signed at such a price as if the said
hemp were really bought and to be paid for as they deal with
other merchants for other goods, and (that these dealers may
not know otherwise) that the money for said hemp be paid by
your hand without the present assignment of the Board, and that
what is saved of the price contracted for may be made good to
the King by your charging yourself there with on the front of
your next ledger. I consent hereto and desire you to pay the
bill of imprest granted by the [Navy] Board for the said hemp
by way of advance to the merchant, paying him no more than
he weighs each day, at a price not exceeding 25l. 10s. per ton.
On the delivery of the whole parcel you are to take up the bill
passed for the whole money signed by the [Navy] Board, the
merchant delivering up the bill of imprest to be cancelled as
is usual.

and appointed by the Society and Corporation of Brewers of
the city of London for the use and benefit of all the trading
brewers of London, Westminster, Southwark, Middlesex and
Surrey, who should before July 18 next ensuing subscribe and
accept their share of the profit and loss of the farm herein),
the King granted to them the farm of Excise of London,
Westminster, Southwark, Middlesex and Surrey, except South
Mimms, together with the Excise Office in St. Bartholomew
Lane, behind the Royal Exchange, then in the occupation of
Sir John Robinson, Francis Sone. John Rives, Richard
Westcombe and John Wedder, to hold the above from St. John
Baptist next ensuing [sic means 1665] in trust as above for
said trading brewers, paying a rent of 44,250l. from said St.

1666, Sept. 20, between the King of the one part and Thomas

Freeman, John Forth, John Breedon, Geo. Dashwood, Thomas
Forth and William Bucknall of the other part, in consideration
of the advance of 30,000l. the King granted to them the farm
of the Excise of London, Westminster, Southwark, Middlesex,
and Surrey (except South Mimms) and the abovesaid Excise
Office, then in the possession of the afore-recited trustees, to
hold as from 1666, June 24, for two years at the rent of
140,000l. per an. by monthly payments. By indenture of 1668,
April 1, between the King of the one part and William
Bucknall, Ph. Jemmett, William Dashwood, John Breedon,
Griffith Owen, George Dashwood, Dannett Forth and John
Forth of the other part, the King granted them the abovesaid
Excise and Excise Office from St. John Baptist ensuing
for three years at the rent of 140,000l. for the first 2
years thereof, and 35,000l. for the last half year. By
indenture of 1668. May 16, between the King of the one part
and the above last recited Farmers of the other part the King
demised to them for the same three years the Excise of Kent,
Essex, Norfolk, Suffolk and Bucks (except the part of Newmarket
lying in Suffolk) at the rent of 54,780l. per an. and also thereby
granted to them the duty arising by brandy (alias strong
waters), mum (alias foreign beer), or any excisable foreign
liquors imported into England, Wales and Berwick, except
London, Westminster, Middlesex and Surrey) for the same
period at the rent of 2,000l. per an. for the said three years
and 1,250l. [for the preceding period] from 1667. Nov. 25,
to 1668, Jan. 24. Further from the said date, 1668, June 24,
the last recited Farmers were employed to collect and receive
the Country Excise, in which employment they continued for
the said three years and have fully paid all sums by them
received thereon. By indenture of 1670, Sept. 1. between the
King of the one part and William Bucknall, Dannett Forth,
John Forth Phillip Jemmett, John Breedon and George
Dashwood of the other part, the King granted them all the
above recited premises for three years from 1671. June 24. at
140,000l. per an. rent for the first 2 years thereof and
35,000l. for the last half year. Further, by royal order, the
said last recited Farmers collected the Additional Excise
granted for six years from 1671, June 24, in London, Westminster,
Southwark, Middlesex and Surrey (except South
Mimms from 1671, June 24, to 1674. June 25, and have paid
and satisfied into the Exchequer all sums arising thereon and
all the rents due by the several leases aforementioned. At
the petition, therefore, of the said Sir William Bucknall,
Dannett Forth, John Forth, William Dashwood. Phillip
Jemmett, John Breedon. George Dashwood, James Walker,
John Collins. Michael Arnold, John Freeman, Richard Hammond
and Thomas Forth these presents are to release and quit
claim them of all rents and collections due as above and of all
the covenants of said agreements and to absolutely acquit and
discharge them, their heirs, lands, &c., from all further
accounts and demands thereon.
Appending :Reference, dated Oct. 5, of the above draft to the
Attorney General : together with : the opinion of Sir William
Jones, Attorney General, to the effect that such a discharge
may be granted if the King is fully satisfied of all rents and

Callaghan, Earl of Clancarty. Said petition shows that by
tallies of 3 April, 1663, forfeited and undisposed lands in the
barony of Muskerry, to the value of 600l., were settled on
Charles, Viscount Muskerry, petitioner's brother, which was
confirmed by Act of Parliament. The whole estate so granted
has been valued at 1,966l. per an. ; whereof ds is allotted to
the proprietors, 695l. 4s. 0d. ; the quit rent is 758l. 8s. 11d. ;
Capt Owen McCarty detains 366l. per an. ; the ancient chiefrys
amount to 88l. 3s. 2d. and the interest of petitioner's mortgage
on these lands 106l. 11s. 9d., making in all 2,014l. 7s. 10d. ;
so that petitioner is by the grant a loser to the amount of
48l. 7s. 10d. per an. and has paid 900l. for acreage money and
800l. for the yearly value, besides other great charges, and
therefore prays a lessening of the quit rents and discharge of
the arrears thereof. In his report of Sept. 14 last hereon the
Lord Lieutenant confirms the above statements and thinks an
abatement should be made.

been imported into your colony not being laden in England,

issued our royal proclamation for the prevention of such
unlawful and evil practices for the future. You are to publish
same in the colony of Roanoke and punish offenders. We are

Royal warrant to the Attorney General for a bill to pass the
Great Seal of England for a grant and demise to Sir James
Shaen et al. (ut supra p. 823) of the King's revenue in Ireland,
great and small, ordinary and extraordinary, certain and
casual, whatsoever or of whatever kind or nature, from Dec.
26 next to 1682, Dec. 25, viz., for seven years, all as follows,
and in consideration of an advance of 60,000l. and of the rents
and covenants as follows (the present farm by John Forth et al.
of the great branches of the revenue in Ireland and the contract
with Visct. Ranelagh and his partners for other branches of
the said revenue, certain and casual, both terminating on the
25th Dec next). The present hereinnamed new Farmers to enjoy
the abovesaid revenues in as full and ample manner as the
King, the said John Forth and partners and the said Visct.
Ranelagh and partners have or might : with proviso for saving
to the said Forth and partners and Ranelagh and partners any
arrears they may be lawfully entitled to, with proviso also
that Kinsale shall be a free port, under rules to be approved
as in pursuance of Rule 13 of the Act for tonnage and
poundage, and likewise under proviso that no reliefs shall be
levied by them, the said new Farmers, but if such shall be
levied they are to have the benefit thereof ; with proviso,
further, for reserving to the Crown the power of pardoning
offences, forfeitures upon penal laws and other particulars
within the survey of the Greenwax, which are to be managed
by the King's officers as formerly (said forfeitures being
nevertheless accounted as part of their rent) ; and, similarly,
reserving power to the Crown to pardon and discharge any
arrears of the said revenue before the commencement of said
new farm and to the Lord Lieutenant the power of dispensing
(without the said Farmers consent) with the statutes of 11
and 13 Eliz. as to licensing the exportation of wool and wool
fells into England as formerly "so as the subsidies and
poundages by law due unto us over and above what is usual
unto our Lord Lieutenant may be preserved and paid unto the
said Farmers" : without the consent of the Lord Lieutenant
the Farmers not to dispossess tenants in order to the recovery
of quit rents nor do anything in violation of the Acts of
Settlement and Explanation : the Farmers not to obstruct the
Crown confirming any person or corporation in the possession
of lands and hereditaments in Ireland : "saving the Prizage
and Butlerage to James, Duke of Ormonde, and the Aulnage
to Richard, Earl of Arran, and the duty of 5s. per tun on
French shipping to Sir George Carteret, other than the growing
rents reserved upon the several grants of the said duties" and
the forfeitures thereon : the Farmers to allow the usual
instalments for the payment of First Fruits of twentieth
parts and shall be concluded as to the value thereof by any
valuations of any Commission under the Great Seal : the
Farmers to allow bills of store according to the Book of Rates
and beer and other provisions for their voyage to outward
bound ships and a bounty of a tenth part of Customs for the
first two voyages to new built three deck ships with 30 guns,
and to permit re-export, Customs free, within 12 months for
natives and within 18 months for merchants' strangers : the
apparel of persons licensed to go beyond sea, buff coats
licensed by the Lord Lieutenant to be imported for the soldiers
there, presents of honour from the King to foreign princes
are to be Custom free. The rent for the premises to be
240,000l. per an., payable as follows, viz. : 5,000l. end of Feb.
5,000l. end of Mar., 10,000l. end of April, 20,000l. end of
May, so forwards by 20,000l. a month. Further, the Farmers
will pay at the end of the [said] seven years (besides the said
240,000l. per an.) five-sixths of whatever surplus they shall
receive above 288,000l. per an. one year with another [such
extra payment] "to be bestowed upon such public uses for the
benefit of our subjects in Ireland as the said Farmers shall
humbly recommend." Defalcations to be hereby permitted
for the following particulars, viz. : 10 per cent. interest on
60,000l., and an allowance not exceeding 4,000l. for repairs and
new buildings to be deducted by 1,000l. per month out of the four
last monthly payments. The Farmers to advance any further
sum not exceeding 20,000l. on three months' notice, which they
are to be repaid by deduction with 10 per cent. interest. For
security of repayment of the advance of 60,000l. and of the
abovesaid further conditional advance said Farmers are hereby
granted all the Crown and quit rents of Ireland for seven
years from the end of their farm on condition to be void on
repayment of said advance money and interest at the rate of
exchange current at the time of such repayment. The King
may, out of his bounty, abate or reduce 1,000l. per an. of quit
rents without allowing any defalcations for same. "If we
shall think fit to moderate the quit rents upon the most coarse,
barren and insolvent lands, so as to encourage plantations and
answer the intention of the clause in the 37th page of the Act
of Explanation, the Farmers being to be heard by the Lord
Lieutenant concerning the values of the said respective lands
whereof the quit rents are to be moderated, as also in all other
transactions concerning quit rents so to be moderated, we shall
allow no defalcations [to said Farmers] for 4,000l. per an. of
such quit rents so to be moderated [to the owners of such
lands], and which are now charged on the most coarse, barren
and insolvent lands, wherein the lands belonging to Sir
William Petty and Robert Marshall, in the barony of Iveagh,
Dunkerron and Glanarought, are to be in proportion moderated
and comprehended." If any monthly instalment of said rent
of 240,000l. per an. be 30 days in arrear the Farmers to
forfeit one month's interest of their 60,000l. advance. If
same be another 40 days in arrear then the King may seize the
farm and make same void after repaying the balance of advance
money due. The major part of the Farmers shall be always
resident in Ireland and once every week admit two Commissioners
(to be appointed by the King) to sit with them to see
what said revenue has produced. If any foreign war arise
during the farm so many years shall be added to the term of
the farm as such war shall last and the above days of grace
may be enlarged as the king think fit. "the said Farmers being
to have no other defalcations or allowance for or by reason of
such foreign war." The Farmers are to enjoy the mean profits
of all forfeited and other lands belonging to the Crown (except
the King's castles, fortresses, houses and parks), "who are to
dispose of and improve the same according to law to the best
advantage so long as they continue in our hands and until the
next feast of St. Michael the Archangel or the Annuntiation
of our blessed Lady then next after they shall be granted away
and then our said Farmers are to have the rents reserved.
which are not to be less than the quit rents unless the Farmers
consent thereto ; provided that the Farmers shall make lease
during their term to the nominees mentioned in and according
to the intent of our letter bearing date the day of ,
1674, of the respective lands whereof the custodium was
intended to be granted unto them [said nominees] at a rent

of your desire to account distinctly for all money
received from the present Farmers of Excise. I have acceded
to this notwithstanding my former order to the Auditor [of
Excise] to make one account only, and that with Mr. Kent,
from year to year, for the whole time of that farm, beginning
from 1674, June 24. Give your accounts to the Auditor
forthwith so that I may have his statement, not only of all
moneys by you received from the beginning of this present
farm to the time Mr. Kent received the said money, but also
Mr. Kent's account for the remainder of that year, ended June
24 last, "not comprehending in your said accounts any money
by you received from the Country Commissioners or otherwise,
for which your account ending 29 Sept., 1674, is now before
me, but that the 900l. and odd depending upon you, upon the
foot of that account, be by you presently paid" into the
Exchequer and a tally for the same brought to the said Auditor.

first two of the four subsidies granted in 15 Car. II., and who
did not during his lifetime, by himself or by Richard Mellish,
his sub-collector, render any account thereof, and remains in
arrear thereupon to the above amount. Power is hereby given
for Exchequer process to enforce such payment from the
