Treasurer Danby to the Earl of Bath, Lord Warden of the
Stannaries. By your letter of the 20th ult., enclosing copies
of your letter to the [tin] convocators and their answers [to
you] I perceive your great care and their averseness to what
has been reasonably proposed for His Majesty's service. It is
fit to put them in mind how for their sakes only the King has
been contented for eight years past to leave that valuable
part of his revenue almost wholly neglected ; and that he
should scarce yet have required it, but that he found reason to
believe that a longer indulgence might hazard the prerogative
right herein which His Majesty's ancestors had always carefully
preserved : and yet [His Majesty] resolved to do it so
favourably as not to interrupt their trade by imposing a pre-emption
or confining them strictly to the few requirable
coinages but caused this Convocation to be summoned and left
it to them to propose some expedient by increase of duty to
buy off the right of pre-emption or by a moderate farm prevent
the inconveniences of it. But how little they have contributed
to promote His Majesty's gracious intentions I am sorry to see
for 'tis too apparent that after a year spent in trifling they have
proposed a price so far beyond the price current as that they
themselves cannot expect they should be thereby otherwise
understood than only as wholly regardless of any accommodation.
This return of His Majesty's goodness might reasonably
provoke him to exact and put in execution all his prerogative
rights and powers in that matter. But considering it might
bring inconveniences to the trading and adventuring tinner the
King is pleased as yet to suspend the same and once more to
attempt their settlement by again proposing to take an increase
of duty in lieu of pre-emption, or to take all their tin for 10
or 21 years at 4l. per cwt., which is more than the best mercat
price. But if after intimation hereof they shall not think the
matter deserves a more solemn and temperate consideration I
think you would do best to adjourn the convocation to such
time as I may return you the King's further pleasure.

Warrant from Treasurer Danby to the Receipt. Under an order
for 1,500l. drawn in the name of Jeremiah Bonnell, gent.,
which with interest thereon amounted at the day of payment to
1,847l. 6s. 0d., a letter of direction was written Sept. 19 last,
ordering it to be paid by tallies on the 5s. per ton on French
shipping. A tally is levied for that sum accordingly. It falls
out that there is 700l. due from Sir William Bucknall and
Major Robt. Huntingdon on their farm of that duty ended
1671, Oct. 10, and as Bucknall is now sole farmer of said duty
he cannot pay that sum on said tally. To remedy this you are
to cancel said tally and strike two fresh ones, one for 700l. on
the late Farmers, and one for 1,147l. 6s. 0d. on the present
Farmer.

deputy upon which it was agreed that security should be given
by the said Thomas Charnock for performance of the said
articles : which articles have not been yet executed.

Doughty has received as imprest 1,134l. 6s. 0d. in Mr. Norton's
name, so that unless he brings the workmen's bills and

the money, and Mr. Doughty refuseth to bring in said bills
and acquittances. Norton therefore prays that Doughty be
ordered so to bring them in or that he [Norton] may be heard

respited till the year following but it being since represented
by said Ogilby that in regard the merchant who constantly
served him with paper is dead and the many other privy seals
of this kind supplying the rest he must be obliged to send over
a particular factor to contract for his paper which will not
answer the advantage the King intended for him unless he can

Countess of Portland as by the order of reference of Sept. 14
last. The patent in question mentions a patent of Sept. 23,
19 Car. I., to James, Duke of Richmond and Lennox, for the
shipping and lading all sorts of woollen cloths, &c., for 31
years at 100l. [per an.] rent, to be void for non-payment
thereof at the days appointed : "and that your Majesty on the
20th day of May in the 13th year of your Majesty's reign,
upon the humble request of Lodowick, Lord Aubigny, did grant
the same unto the said Lord Aubigny and Benjamin Weston"
for the same term and rent and to be void for non-payment ut
supra. In this second grant your Majesty forgave and discharged
all arrears of rent due upon the first grant. "This
honourable petitioner humbly beseeches your Majesty to shew
her the same grace and favour which your Majesty did to her
brother the Lord Lodowic : that she may have a new grant for
the same term of 31 years (18 years being unexpired of the

Treasury Danby to the Earl of Bath at Bideford. I am very
sorry to see by your several letters to me, and those to you
from the [tinners'] Convocation that the gentlemen there
convened who are persons of quality should not be drawn to a
sense of the King's and their country's interest. The King is
well informed where the obstructions lie. It is not really the
poor tinner's advantage which is intended by the demand of
this unreasonable price but that there may be no [tin] farm at
all, that thereby some persons may have the opportunity by
supplying the tinners with money before the coinage to be
(upon the matter) farmers themselves in despite of the King
and pay nothing for it. This is visible : and the King, the whole
country and the trade of this important commodity is abused
by the interest of a few persons : and I do admire the gentlemen
of the Convocation should not see it. But I have reason to
believe they are deluded by being told that within 12 months'
tin hath been sold for 4l. 2s. 0d. the hundredweight. This
may be for some small parcel. But I am well assured the
price current was not so. Yet because this is pretended it
shall not lie as an objection for I will advise the King to give
them more than they themselves even pretend they can make,
although it will make my trouble the greater in the management
of it. You may therefore divide the 10s. between the King and
them and make the price 4l. 5s. 0d. the hundred stannary weight.
By this generous proffer the Stannaries will be inexcusable if
they continue refractory and force the King to look more
narrowly into things than hitherto he has done. For they
cannot suppose the King will let this important branch of
the revenue lie dead any longer. By the next meeting of the
Convocation I hope the Stannaries will have considered that
they have put very hard terms upon His Majesty and after the
result of that meeting if they do not agree I am commanded
by the King that it is his pleasure this Convocation be dissolved.
If they agree you may continue the Convocation.
But before you return [to London] it is the King's pleasure that
you give order that the Coinages are not [to be] more frequent
nor otherwise than by their charter they ought to be. And to the
end the King be not defrauded of his Coinage duty (which I
perceive is all the profit some persons are willing he should
have) by a practice now in use of casting tin into small bars
and exporting it without the Coinage mark upon it, pretending
it was coined in the block (which is not to be disproved,
although not true, by which means the King will not only be
deprived of his pre-emption but likewise of his Coinage duty,
I am commanded by the King to direct the Customs officers to
seize all tin whatsoever that has not the Coinage mark whether
in blocks, bars, or any other form as forfeited by law. You may
give public notice hereof by proclamation or otherwise. I am
informed this practice is grown so general that some of those
who use it pretend they thought it was allowed by law. After
you have received the resolution of the Convocation on the
above proposal you may return [to London] at your pleasure.
