Instructions from Treasurer Danby to the Customs Commissioners
made on their representation of the 13th inst. As to corn
imported at Lyme and Bristol I have referred the matter to
the Attorney General. As to the naturalization of foreign
built ships I am of opinion that all such ships so made free
ought to be registered and certified by the officer for the
Navigation Act as the law provides. But intending to move
the King herein I direct that no foreign built ships be admitted
to the benefit of freedom till the King's pleasure be known.
As to the opinion of Sir William Jones. Solicitor General, in
the case of meal and flour imported you are to proceed to the
trial of the case thereupon. As to Abraham Niblet's petition
concerning tea seized, being imported from Holland, you will
receive my particular warrant therein.

Report from Treasurer Danby to the King on the petition of
Frances, Duchess of Somerset (as by the order of reference of
Aug. 12 last on said petition) for renewal of lease of the rectory
of Austrey and mills of Fairsly in cos. Warwick and Stafford
The Surveyor General of Crown Lands has received a certificate
from four worthy gentlemen inhabiting near the premises
certifying the old and increased rent to be 120l. per an.
(105l. 11s. old rent and 14l. 9s. increased rent) and that (in
spite of the fact that at the granting of the lease in March,
1661. that sum was considered to be but a moiety of the full
improved value) the present value is 120l. per an. for the
rectory and 6l. 13s. 4d. for the mills besides the land tax which
is paid by said Duchess, "the value of lands and especially of
tithes and mills being much fallen of late years." The
Surveyor General therefore advised the new lease to her with
an abatement of the increased rent and a compensation for her
losses which are like to increase by the fall of things of this
nature. The premises are in the Queen's jointure and cannot
be granted by your Majesty (save in reversion of the Queen's
interest) unless the Queen's Council be induced to surrender
the premises for some equivalent. I approve the Surveyor
General's report "and do humbly inform your Majesty that
in some cases your Majesty hath been pleased to take lands out
of the Queen's jointure recompensing Her Majesty by the
addition of other lands in lieu thereof."

Warrant from Treasurer Danby to the Auditor of Excise to make
up two distinct accounts of the London Excise, one for the
duty due by covenants on the old farm to June 24 last, the
other for the New Duty due by agreement with the King at the
rate of 54,000l. per an. to same date, taking care that upon
the quarter's advance on the new duty you allow no interest if
it appear that the Farmers have always had in their
hands a greater sum than their advance. These accounts are
to be ready for declaration by the first day of Michaelmas term,
so that a due course may be taken for the recovery of sums
appearing due thereupon. All by reason as follows, viz. : the
state of the old and new duty of Excise as presented to me on
the 17th inst. charged the late London [Excise] Farmers with
140,000l. per an. for the old duty and 54,000l. per an. for the
new duty, and showed 30,000l. due from them on the new duty
and a considerable sum on the old duty. "Whereupon the
said Farmers being present did pray that they might not be
charged after the rate of 54,000l. per an. for the new duty,
they never having taken any lease thereof under the Great
Seal but were willing to account for what they had received
thereof, and pay so much as should be found unpaid upon
such account. But it appearing to me upon the books now
remaining in my office that there was a contract made for
54,000l. per an. for the said Additional duty and that one
quarter's rent, after that rate, should be advanced ; and Sir
Stephen Fox, then present, attesting that the sum of 13,500l.
was accordingly advanced, and you having orders from the late
Lord Treasurer [Clifford] to state their accounts after that
rate, and they having quietly received the said Additional
duty during the whole time of their farm and paid above
100,000l., part of the said rent, although they sued not out
letters patent thereupon, and the said Farmers confessing
that some of them did make such agreement and the other did
not then oppose the same, but that it being only by parole and
no letters patent sued out, they conceived they were not bound
by the same but only by the clause in their letters patent
relating to an increase of the duty by Act of Parliament ; and
being attested by the Attorney General, who declared his
opinion that they having received the duty during the whole
term upon that contract ought to be bound thereby although
no letters patent were sued out, I judged it unreasonable they
should expect to become accomptants, having received the
duty upon a certain contract, nevertheless if they would
account as well for the old duty as the new during the said
term I conceived it suitable to His Majesty's clemency that
they should not be loosers upon the whole, and would represent
such proposal to His Majesty. But they refusing the same I
judged it reasonable and just that the account should be carried
on in the same method it has been ever since their entry upon
the said farm."

Instructions from Treasurer Danby to the Customs Commissioners.
As to the several queries [from you] as to the
importation of corn I herewith send you the opinion of
Sir William Jones, Solicitor General, on the case, and
you are hereby directed to give special directions to the
collectors in all the ports of the kingdom to observe
same. As to your first query whether the certificate
of the clerk of the market or chief magistrate of the town
shall be a rule to the Collector to receive the duty notwithstanding
the general price was otherwise than [as] certified or
whether proof of the general price ought not to be the rule
within the intention of the Act of Tillage and what proof is
necessary in the case ; to this Sir William Jones gives his
opinion that the certificate is no rule but proof must be
made by witnesses to a jury (if an action be brought) what was
the general price.
To the second [query, viz. :] (that the words of the Act being
general, viz. the price at the place of importation without
mentioning the markets, whether the words should not include
the quay or any other place of the city or town where corn is
sold, and whether the greater part of the corn sold within
that city or town shall not be intended [as] the price [of the
place] within [the meaning of] the said Act of Parliament).
Sir William Jones is of opinion that the general price of the
place must be the guide and for as much as most corn is sold in
the market the general market price is most likely to be the
price of the place.
To the third query (if the merchant tender only the lesser
duty upon corn according to the Act of Poundage whether the
Collector may receive the same), Sir William Jones thinks the
Collector may refuse it.
To the fourth query (if the merchant shall upon such
tender without the Collector's acceptance proceed to the
landing of his corn whether or no by the words of "custom
and poundage" in the said Act of Tillage, by which the duty
in question comes in lieu of that charged by the Act of Tunnage
and Poundage, it is not liable to seizure) : this question
Sir William Jones confesseth to be of some difficulty, because
the Act of Tillage doth not say this new duty shall be paid
under the penalty of the Act of Tunnage and Poundage : but
yet he thinks, seeing that by the said Act of Tunnage and
Poundage there was a duty payable upon corn imported, and
this Act doth only increase that duty, and the duty here given
doth involve and comprehend the duty given by that Act, that
therefore there shall be like remedy for this as for that. And
there are many cases in law where the addition to a thing
given by a former Act shall be within the remedy of that
former Act. The consequence will be if this additional duty, or
rather change of the duty, be within the remedy of the former
Act then may the officer seize if the whole duty be not paid.
And seeing the matter is so probable he thinks fit a seizure
should be made to bring the matter to a legal determination.
As to the fifth query (if the King's Collector shall
accept of the tender of the lesser duty with a further demand
of the greater, with a declaration that he doth not receive it
in satisfaction of the Customs, whether the King has not a
remedy for the recovery of the residue) Sir William Jones is
of opinion such acceptance will not bar the King of his right.
This answers your sixth query also.
To the seventh query (that if it should be advised that an
information of seizure will lie for the greater duty due by the
Act of Tillage and the seizer or informer should be nonsuited,
whether such person shall be liable to damage for detainer of
the corn) Sir William Jones thinks the seizer would be liable
but the damage would be less when the matter is so doubtful.
To the eighth query (if the King shall bring his action of
debt or information for the recovery of his duty, whether such
action or information is local and to be tried in the proper
county or may be tried in Middlesex, as [are] other informations
for the King in Customs cases) Sir William Jones says
if the action or information be brought for the King for the
Customs it may be brought in what county the King pleases.

between him and Richard, Visct. Ranelagh, has surrendered
said patent to be cancelled. At the request of said Visct.
Ranelagh said 1,500l. per an. is hereby granted to said Ranelagh
in consideration of his many faithful services : to be
charged on said hereditary Excise of co. Yorks, Derby,
Leicester, and Nottingham and city of York for 21 years from
Lady Day last. (Treasurer Danby's subscription, dated Aug. 14,

thought fit to agree to give same to him upon his late marriage
"to our daughter the Lady Charlotte" in dower with her :
to be paid out of the first moneys that shall be received of
the second 200,000 patacons to be paid to us by the States
General pursuant to the late Articles of Peace. Warrant to
be given to Edward Backwell (receiver of the said moneys) so
to pay same. "And whereas by our letters of privy seal,
bearing date the 27th day of July, 1673, we have been pleased
to direct you to cause the sum of 2,000l. per an. to be paid to
... Sir Stephen Fox for our secret service," the said
payment of 2,000l. per an. is to cease as soon as the abovesaid
18,000l. be paid in regard the same is by us intended towards
the present maintenance of the said Earl and our said daughter.
