Present : Lord Treasurer, Chancellor of the Exchequer.
Mr. Davis, receiver of the Chimney money in Herefordshire, has
incurred a debt of about 1,600l. Davis pretends to have paid the
greater part of this money to Mr. Cornwall, on whom process is
stopped by warrant from the Lord Treasurer. The Chancellor of
the Exchequer is of opinion that this man is a great sufferer and
that the others have gone away with the money. A letter to be
written to Mr. Edwd. Cornwall and Mr. Herbert Aubrey to appear
in 14 days before the Lord Treasurer upon Mr. John Davis's
account, who is a prisoner. And in case of failure [to comply herewith]
a messenger to be sent for them. Mr. Cornwall lives at
Mockas, near Hereford : [the letter] to be left at the Swan and
Falcon in Hereford.
Mr. Griffin to have a quarter assigned [for the Chamber] from
Lady Day last.

The Lord Treasurer will speak with the Attorney General and
some of the Excise Commissioners concerning Mr. Kent's warrant.

The petition of the King's preachers in Lancashire is granted.
Mary Richardson's husband's debt of 107l. 9s. 8d. [is ordered] to
be considered.

The new royal foundation [of the King's mathematical boys at

Present : Lord Treasurer, Chancellor of the Exchequer, Attorney
General.
The Attorney General represents to the Lord Treasurer the
several mistakes that are found in the commissions issued out for
seizing two [thirds] parts of Recusant's estates. Mr. Bernard, the
Remembrancer's deputy, answers my Lord that he hopes no such
errors (as are complained of) will appear when the Commissions
are returned, and lays the greatest fault on the Clerks of the Peace.
The Lord Treasurer charges him [to act] with diligence for the
future and that no neglect be made on his part. Mr. Bernard says
the errors will be found in the schedules and not in the Commissions.
The Lord Treasurer directs Mr. Bernard to examine the
Commissions and assist in the returns.
The Solicitor General and Mr. Johnson called in as counsel for
Mr. Henry Fanshaw concerning the grant of the office of Remembrancer,
upon the question whether the young Visct. Fanshawe, an
infant, ought to be the first of the three lives or not. The Solicitor
General says it is doubtful whether it may not be void in law, and
instances in several cases. Mr. Sawyer differs from the Solicitor
General's opinion. The Attorney General believes a grant to an
infant to exercise by a deputy is good, especially if the infant be
above 12 years old. But he thinks it more prudential to take it
otherwise. The Lord Treasurer, upon hearing the whole matter,
will receive the King's pleasure therein to-morrow morning.
Mr. John Barker, one of the Custom House officers at Gravesend,
is recommended to my Lord's favour by the Attorney General. My
Lord to be put in mind of him particularly.
Mr. Pyle and Mr. Wiseman to be paid each 256l. 13s. 4d. upon
warrants lately signed. In the margin : Done [meaning : direction
accordingly sent to the Auditor of the Receipt].
Ordered that 100l. per week be paid to the officers of the Works
till 1,400l. be paid : upon the old arrears of materials. The like
marginal note. Also 50l. a week more is directed for the payment
of the poor workmen of Scotland Yard till Sir Humphry Hooke's
money be recovered or 1,500l. be paid. The like marginal note.

against papists, and against illegal exaction of money, &c., are to
be brought to the Treasury Chambers at 4 in the afternoon on
Monday next, when [for which time] another meeting is appointed.
Query : Whether Sir Robert Howard ought to deliver in [to the
House of Commons] the old anticipations on the Customs as
well as the new. The Attorney General is of opinion that the
anticipations ought rather to be delivered in by any other hand
than Sir Robert Howard's.
Agreed : that all anticipations as well old as new [on the Customs]
be delivered in by Sir Ro. Howard.
Major Huntington and Capt. Kingdon to attend on Monday
concerning the brewing of beer without malt.
Mr. Fillingham to attend the same time about the smiths' forges.
