Oct. 7 Circular letter from Treasurer Southampton and Lord Ashley forwarding the additional act for the better ordering the fire hearth money for their observance of the directions therein contained for a review and certificate of the said duty; and especially to appoint some well affected persons to call on the petty constables, high constables. and others, to perform their duties that so a just return of the books and rolls required by the Act may be transmitted: and recommending effectual means to prevent the petty constables and sheriffs' under officers detaining the moneys in their hands. Oct. 8 Treasurer Southampton and Lord Ashley to [the Mayor of Leicester], concerning the complaint from the Commissioners and Farmers of Excise for that county as to the case of one David Clay, a common brewer of Leicester town, who has been a person very refractory and opposite to the law in not making his entries and paying his duty of Excise, and one that stood it out to the utmost with the said Commissioners and Farmers, until distresses were taken and his person imprisoned: notwithstanding which the general sessions for the peace held in the borough of Leicester for that town have vacated the Commissioners' judgment against him as to the double duty and discharged him of the fine due to the King for his contempt, and have likewise awarded the farmers no charges in this troublesome suit but only their bare duty. "Now this being His Majesty's revenue settled by law upon him he expects that those into whose hands execucon of the law is committed should doe him right therein. And therefore wee have thought fit before we acquaint His Majestie and his Councell with this illegall proceedinge to require you again to reconsider this buisines and to doe them [the Farmers] justice therein; the consequences of such an ill example being very destructive to that part of His Majesties revenue." Treasurer Southampton and Lord Ashley to the Commissioners for the 18 months' assessment in co. Somerset concerning the arrear of between 9,000l. and 10,000l. on said assessment in said county, and the no small inconvenience to His Majesty's service caused by the remiss execution of their powers and duty herein: therefore desiring them to proceed forthwith to the assessing of what is not yet assessed if so be, and also to call to account the sub-collectors and high collectors. Treasurer Southampton to Sir Robert Long. Mr. Alderman Backwell has advanced for the King's service 30,000l. for Ireland, for which there will be a Privy Seal in the name of the Earl of Anglesey, 50,000l. to the Treasurer of the Navy, who is to charge same upon some of his Privy Seals, 1,200l to Lord Holles on his entertainment as Ambassador in France, which is to be charged on said Lord's Privy Seal, 6,400l. for the Grooms of the Bedchamber. 6,000l. to Sir Edward Griffin, Treasurer of the Chamber, to be charged on such Privy Seals as Sir Edward hath to warrant same, 3,333l. 6s. 8d. advanced to the Russian Ambassador as a debt due from the King to Emperor of Russia, and 200l. paid to Mr. Chiffinch as money put into a lottery, for which a Privy Seal likewise is to be procured, viz., in all 97,133l. 6s. 8d., which he is promised, and by the King's command is to be repaid him out of the moneys arising by the four subsidies: all which he is to demand by formal warrants and to produce the acquittances of the several persons who were originally to receive same whereby the exchequer may be justly discharged thereof. "But in the meane time he having for these important services supplied these large summes, upon his desire I acquaint you therewith and require you to give him such dispatch in the transaction of all these perticulars as is suitable to the nature of this affaire." Oct. 14 Warrant from Treasurer Southampton to John Coltman to be waiter and searcher for uncustomed and prohibited goods in London port and the outports, with power to enter any ship, house or place soever, to search for and seize same: the East India Company having prayed the Lord Treasurer in order to the better discovery of such goods to so authorise said Coltman. By his letters patent of the 3rd instant the King in return for the loan of 50,000l. from the city has constituted you Receiver of the two last of the four subsidies for certain counties, named, Whereas you have already advanced to Stephen Fox the greater part of said loan, these are to authorise you to pay him the remainder, he being appointed to be paid the whole of said loan, as Paymaster of the Guards. Burley for one year on her pension and to continue it according to the letters patent; 20l. to Henry Thomas for half a year on his pension of 40l., and to continue it as above; 20l. to Elizabeth Carey for half a year on her pension and to continue it as above; Elizabeth Hudson 50l. upon her pension and to be continued as above. "Though the King hath given me direccons for these poore persons to be paied under his hand yet I think it will breed both His Majesty and my selfe trouble if they be allowed as pencons. And therefore conceive it fit rather to direct that upon the old Privy Seale dormant [for 2,000l. for royal bounty] you draw orders for these several sumes as for reward of service and doe you take privately some acquittance may be made use of hereafter to discharge their pencons of soe much."
