Treasury warrant to Thomas Agar, surveyor of woods this side Trent. and to the woodward, &c., of New Forest, for the fell ing of 200 oaks in New Forest for carrying on the building of the new ship at Portsmouth. Warrants Early XLIII. p. 348.
Instructions to the Customs Commissioners [in the form of Treasury resolutions on papers submitted by said Commissioners]. The salary of the collector for Plymouth port is to be reduced to 140l. per an. As to the matters relating to the Prizage Duty you are to take counsel of such K.C's. as Sir John Maynard, Sir William Ellis and Sir William Jones. All such prize goods as belong to the seamen ought to be entered and duty paid as for other prize goods or else to be forfeited. As for coals exported by natives in foreign-built ships made free or licensed by His Majesty we think fit that they should not pay aliens' duty. The salary to the two boatmen at Newcastle is to be 30l. per an. each. You are not to sign any clearing cocquets where the ship's master shall refuse to take sufferance cocquets (as is directed by the Act of Frauds) for passing goods coastwise, and if any action by reason hereof shall be brought against the Customs officer it shall be defended at His Majesty's charge. On perusal of your report on the case of Mr. La Pearle and the papers thereto annexed we do not think that any favour ought to be shown, but that the forfeiture of the goods ought to be taken according to law. The Treasury Lords to the King's Remembrancer to stay process against Edmond Warcup, late farmer of Excise for Wilts and Dorset; said Warcup having been very useful in His Majesty's service, both in said Excise and otherwise. Ibid, p. 350.
Same to the Commissioners of the Aids, &c., for co. Norfolk. We have yours of the 18th ult. in reply to ours of March 5 last as to your care concerning the arrears of assessments in your county. We observe a misconstruction on your part of some clauses of the Act for the Royal Aid, to which the subsequent Acts refer. In the cases of John Stafford, Richard Harmer and John Sorrell you apprehend you have fully executed your powers under said Act when you have imprisoned the person and sold the estates of such head collectors and sub-collectors as have made default and when you have paid the money arising therefrom into the Exchequer. "But if you please to compare the clause directing a reassessment beginning folio 103 of that Act printed single by itself (for the numbers of the folio there do differ from the book of Statutes at large) with the clause directing imprisonment and sale which begins folio 106," you will find that a reassessment is enjoined wherever by any means the assessment fails to be paid in time. As to the moneys alleged by you to be paid into the Exchequer from such sales in discharge of supers on such collectors we can find none so paid, so that if the money were paid it was to the Receiver before the declaring of his account so that the supers stand the same. As to the cases of Thom. Whiteing, William Gay, John Clerk and William Bell we find that process has issued out of the Exchequer for recovery of the debts, and that nichils have been returned by the sheriffs, so that the supers remain to be reassessed by you. We are enquiring as to the case of Andrew Leake, whose arrear is certified by you to be paid to Andr. Verdon, late deputy undersheriff. As to the arrear on the town of Thetford we shall send to those [local] Commissioners concerning it. But in all other cases, except Leake's and the town of Thetford, the process already issued has produced no effect. If the moneys be not speedily raised by reassessment Exchequer process will be issued against the Commissioners. Ibid, p. 351.
May 3 The Treasury Lords to the Justices of Peace of Worcestershire. By the Act of 22 and 23 Car. II., the planting of tobacco in England is prohibited, "which should the same not be strictly" observed would bee very prejudiciall to His Majesty's revenue of his Customs which wee must endeavour to preserve from being lessened by endeavouring to have the laws in that behalf duely executed." You are to take care to put same in execution and give us an account of your proceedings herein, we having information that some persons in your county have contrary to the said Act presumed to plant tobacco. Same to the Surveyors of the Customs to go into the abovesaid several counties to see that this matter be fully prosecuted according to the statute. Ibid, p. 353.
Same to the Governors respectively of Barbados, Virginia and Jamaica. We have reason to suspect that the following ships "Robert and Hester," "Hopeful Katherine," "Saphire," "Thomas and Benjamin," 'William of Bristol," "Exchange of Bristol," on pretence of going only on a coast trade to some of His Majesty's dominions in Europe intend to go to some of His Majesty's Plantations without having given bond as by law required. If any of them arrive within your Government without a certificate of having given bond you are to seize them. Ibid, p. 352.
Treasury warrant to Francis Stevens, Sergeant at Arms, to arrest Lieutenant Edwards and John Martin: it appearing by the affidavit of Peter Greene, William Davyes and William Milton, Customs officers, that they being put on board the ship "Augustine," from Virginia, as tidesmen, April 12 last, a person commonly called Lieutenant Edwards upon pretence of pressing men for the fleet with one John Martyn in his company endeavoured forcibly to take away some tobacco which the deponents opposing the said Edwards drew his sword and ran said Milton into the back and took them all away by force, threatening them to lay them in chains, notwithstanding they produced their deputations: and further that on April 15 last said Martin came on board same ship again with a dozen seamen and carried away 10 bags of tobacco in spite of deponent's efforts to hinder it. May 3 The Treasury Lords to Mr. Howland to forthwith pay into the Receipt all moneys in his hands of the late Wine Act and to pay all such moneys into the Exchequer presently from time to time as they come to his hands. Warrants Early XLIII. p. 365.
Same to the Surveyor General of Crown Lands for a particular and ratal of 20 acres of land, being a discovery and one out of several parcels of land in co. Lincoln of which Percy Church. Esq., prays a lease. As to the 80 acres anciently called Robert's lands he shall be considered when he has made good His Majesty's title thereto by a trial at law. Ibid, pp. 366–7.
Same to the Customs Commissioners to permit the servants and agents of Sir John Paul, Kt., Resident at the Court of Denmark, to put on board any vessel his coach horses, trunks and utensils in order to their transportation to Denmark. Ibid, p. 367.
Treasury warrant to Serjeant Francis Stevens to arrest Richard Marsh and John Luff, merchants in Bristol, who under colour of transires taken out at the port of Bristol for the transport of 19 tuns of French wine from Bristol to Exeter shipped no such wines from Bristol by virtue thereof, but put the same [the transires] into the custody of the master of a vessel who making his voyage to France or from some other vessel at sea taking in the same quantity of wines, imported them at Exeter and landed them there under colour of those transires as if the duty had been paid at Bristol. The Treasury Lords to Sir Francis Leeke, Governor of the blockhouse at Gravesend, and to the Customs Commissioners to allow the ship "William and John," William Shie master, to proceed on her voyage without stop, she being employed on a voyage to New England upon special service to His Majesty. Treasury warrant to the Surveyor General of Crown Lands for a particular and ratal of the tolls of the passage over the water of Aire alias Eyre at and upon the bridge called Ferrybridge and Castleford bridge, co. Yorks, of which Richard Haigh prays an extension of the lease granted to him by the late Queen Mother and her Trustees: the lessee to defend the Crown's title to said tolls, whereby they may be secured for the future benefit of the Crown. May 6 Treasury warrant to the Attorney General to prepare a grant for the Great Seal of the office of Master of the forest and Chief Warden of all the forests, chaces and warrens belonging to His Majesty in his Honor of the Castle of Bernard, commonly called Barnard Castle, and also Chief Ranger of the forest of Teesdale and chace of Marwood, Durham, to Charles Earl of Carlisle. [Trustees to the late Queen Mother] to pass a reversionary lease to Sir Richard Stydolfe of the scite of the manor of Egham with the lands, &c., usually thereto pertaining (at the rent of 12l. 7s. 8d. and 12 loads of hay for the deer in Windsor Forest, and 20 loads of hay and 15 quarters of oats for the stables at Hampstead Court: all as demised 1606–7, Feb. 15, to Thomas Marrey after the death of Thomas Stydolph, Elizabeth his wife and Francis his son) and also a confirmation of the grant to be made by His Majesty to said Sir Richard Stydolfe of the parcel of Marsh land (called Marshland) in the parish of St. Giles in the Fields, formerly part of the possessions of Burton Lazars, formerly in the possession of George Hutton, and now or late in the possession of John Walgrave, and demised by the late Queen Elizabeth, in the 40th year of her reign. to Nicholas Morgan and Thomas Horne [? Trustees of the late Queen Mother] to pass a lease to Robert Curtis of two closes called Angores, containing 20 acres, in the parish of Walton on Thames, granted by Henry VIII. to Henry Noteridge, and now annexed to the Honor of Hampton Court, and part of the late jointure of the late Queen Mother: now or late in the occupation of Thomas Boulton. May 8 Same to the Receipt for tallies to be levied for 5,000l., part of the 10,279l. 12s. 11d. remaining due to Sir Robt. Vyner of the 12,779l. 12l. 10d. ordered to him by the privy seal of Mar. 29 last for chains and medals of gold and other gold works, on which privy seal a Treasury order has been already signed for 2,500l.: the said tallies to be levied on Sir John Shaw et al. late Commissioners [of Customs and thereby Collectors] for the new imposition on wine and vinegar, upon their account for the same for 1¼ years ended 1671, Michaelmas. The Treasury Lords to the Earl of Derby. Some of the Customs officers of Liverpool port have been pressed for the fleet. This will be prejudicial to the Customs revenue. You are to give order that no such officers be pressed in future and that all such as have been be discharged. Warrants Early XLIII. p. 372.
Same to the Customs Commissioners. On consideration of your paper of the 6th you are to make allowance to the stationer for the charge of the printed deputations for the past. But for the future the charge is to be borne by the officer who benefits thereby. When you think fit, boat hire or coach hire is to be allowed to the solicitor of the Customs and the messenger is to be allowed the same reward for bringing up the certificate of the Treasurer and Comptroller as has been done formerly. Collectors who have not yet given securities are to do so by a date to be fixed. Bonds given by persons to pursue such and such voyages, for which they had passes from the Duke of York. may be delivered up when the conditions are performed and the ships returned. As for the pot ashes imported from Bremen in the ship "Golden Sun," Egbert Costar master, the Customs officers are to observe His Majesty's concession to the city of Bremen of date 1663, June 1. Therefore Aldworth is to do this and Sawyer is to deliver to him each Receivers last declared accounts, so that Aldworth may satisfy himself as to the charge and arrears of each Receiver. The Treasury Lords to the Customs Commissioners to discharge the ship "Hope," of Bergen, on which Edward Thompson et al., merchants (upon hearing of His Majesty's gracious intentions for a time to dispense with several clauses in the Navigation Act) did ship 15 pieces of Rhenish wine; which ship was seized on its arrival at Hull on the 9th inst. as forfeited by the Act of Navigation, notwithstanding the dispensation of same by the late order of Council. By order in Council of the 15th inst. the King has ordered the release of all such Dutch ships, goods and merchandises as were seized in any of His Majesty's ports before the declaration of war. In pursuance hereof the Commissioners for Prizes have ordered the discharge of the ship "Peace," of Rotterdam, Peter Williamson Stopp master, without paying any incident charges. In this and the like cases you are not to insist on the proprietors paying any charges for the attendance of the Customs officers on such ships. But this direction is to be looked on as extending only to ships discharged under the abovementioned order in Council and not to such as shall be otherwise cleared by decree of the Admiralty Court; as to which latter the directions lately given are still to apply.
