Bernard Rust, master of the Scotch vessel called the
"Christian," of Carriden (seized by one of His Majesty's ships
under pretence of belonging to the enemy, but it appearing to
be otherwise and that she belongs to His Majesty's subjects)
to take out her lading and put same on board lighters without
paying Custom: it being only in order to his receiving
satisfaction for damage done by the embezzlement of his goods:
taking care that none of said lading be landed. |

last we directed that the Customs officers of the outports should
deliver over to the Sub-Commissioners of Prizes all such prize
ships as were come to their hands but to take care of the
Customs where bulk was broken and goods landed by said
Sub-Commissioners. In order to secure said duties you are to
grant bills at sight for landing said prize goods and to appoint
some Customs officer to attend at the landing to take the
account and contents by marks, numbers, or otherwise and to
see same safely put into warehouse, a Custom officer to keep
one key thereof and the storekeeper for prizes another key: so
that they may not be delivered till a perfect entry be made and
the duties discharged: also that when prize ships are sold the
Custom for same be paid ad valorem. |

soldiers of the regiment late under the command of Sir Tobias
Bridge whose names were in the first muster rolls and remaining

the officers thereof should be paid out of the 4½ per cent.;
but the Treasury Lords being informed that contrary to the
said directions of the King several soldiers of said regiment

that you do examine the matter speedily and certify us how
you find it. We have thought fit to give you particularly this
trouble because by a copy of a warrant issued by you for fining
the assessors, which the Receiver has transmitted to us, we
find you have already had cognizance of the matter." We

The Treasury Lords to Sir Robert Holt in Warwickshire. The
Receiver of Hearthmoney, co. Warwick, has sent us a warrant
of yours requiring Henry Hargrave, one of his deputies, to
restore a distress by him taken upon one Foster, a smith, for
the duty of his forge. We are informed you have done the like
for several others, not only after you were acquainted with the
judgment of the King's Bench in the case, but after the judge
of your circuit had at the assizes publicly made same known:
and also that you told said Hargrave that you will still so
proceed upon any appeal made to you, and that if the goods
were replevyed and a suit commenced the King will be cast if
tried in the assizes in Warwickshire. This seems so strange to
us that a person of your ability and on whom we did very much
rely in all the concerns of His Majesty's service that we
thought fit to acquaint you with it. We desire to know from
yourself before we make any further complaint [to the Privy
Council] what we may for the future expect from you. You
have given us fair warning not to venture so clear a case for
the King at a trial in your county or any other else but at
the Barr and the conveniency you have done your neighbours
is that by your proceedings we shall be forced upon supers
to issue process out of the Exchequer against them, which will
be ten times more charge. If you or any of your neighbours
are not satisfied with the result of the action in the King's
Bench we shall take it well if they try the title again. The
case is considerable to His Majesty in point of revenue, and
the law and the reason of it very clear on his side, and if the
mistake of some that are His Majesty's sworn justices shall
endeavour to take it away we are not to suffer it, and must
beg you to consider if by these undue proceedings, and after
all these fair offers, the country be put into any disorder.
