The Treasury Lords to the Customs Farmers. Sir R. Long informs us that you do keep back a considerable part of the moneys of your farm which are to be paid into the Exchequer on the 16,000l. [of the Customs farm rent] for June last, out of which the Judges ought to have been paid their salaries yesterday. Please pay it in. And do not presume at any time to place any payment made by you or any tally struck upon you (for any payment to be made by you to any person at the Custom House) upon any other month than that which we direct. The Treasury Lords to the Lord Keeper to take oare that Thomas Foley (Folie) obtain no pardon, without their consent, for the great spoil and waste to the King's timber and bark committed by him to the value of 36,000l. to supply his iron works in Salop and Stafford, as appears by the petition and informations of Peter Mead and Tho. Humphry: "His Majesty having declared to us his pleasure that nothing do pass us for the stopping any legal proceeding in that kind but that the laws have their course and effect whereby others may be deterred from the like offence." Report from same to the Lords of the Committee for Trade and Plantations on the reference of the Earl of Kinnoul's case concerning his pretensions to the Caribbee Islands. We have made the best enquiry we could into that matter but cannot find that any part of the revenue of those islands has been applied to the satisfaction of the Earl of Marlborough or the Earl of Kinnoul, nothing thereof appearing in the accounts of the late or the present Lord Willoughby, now Governor of those islands: as appears from the certificate of Bartholomew Beale, one of the Auditors of imprests, to whom those accounts have been exhibited. [?] Treasury warrant to the King's Remembrancer to stay process against Henry Nicoll, he alleging in his petition "that he having contracted with you [the said King's Remembrancer] for weighing all the wrecks in the river Medway within six months, for which he was to have several flyboats and other necessaries allowed him, the same to be sufficiently fit and useful for that service, but the petitioner alleging that through the defects thereof and the negligence of those appointed to repair the same he is prejudiced to the value of 1,000l. and upwards, and further alleging that notwithstanding the petitioner's address to you for satisfaction he hath never yet received any, but is now prosecuted by you in an action of 2,000l. as having not performed his part of the said contract." July 2 The Treasury Lords to Sir Hugh Cholmly and the rest of the alum farmers conveying the King's consent to the Earl of Mulgrave's proposition of receiving 1,200l. per an. out of the alum farm. Therefore desire said farmers to forthwith pay in their rent which is in arrear. Warrants Early XXII. p. 40.
Royal warrant for a new privy seal [to replace the money warrant of June 11 supra, p. 229], for 9,400l. to Sir Robert Vyner in full of 25,000l., formerly supplied to Sir G. Carteret by Sir Thomas Vyner and Robert Vyner now Sir Robert Vyner, for the use of the Navy, for repayment of which loan said Carteret gave them assignments to that amount on the Hearth money assigned to him on his privy seal of 1662, July 26: the sum of 15,600l. having been repaid to them out of the said Hearth money paid into the Exchequer: but no more having been repaid out of that fund by reason the Hearth money was posted for security to the city of London for loans thereon: so that 9,400l. still remains due to said Vyner of the abovesaid moneys. Lincoln and Nottingham: pending the decision of my Lords as to the discharge of the supers set on them in their respective accounts, they having been required by an order of the Exchequer Court of the 6 inst. to attend my Lords hereon. and my Lords having heard them on the afternoon of the same day, but having seen no reason for the present to discharge said supers "conceiving that the said Receivers are by their bonds liable to levy all that was levyable by the Acts of Parliament relating to the said revenue of Hearth money in their time of being Receivers, and they not having made any return of the persons now in super in two years' time as the law directs." Report to the King from the Treasury Lords on the petition of Roger Osborne, Lady Tynte, and Henry Tynte. By report of the Council of Ireland find that Robert Tynte did lend the 6,011l. as stated and was only repaid 1,000l. Report to the King from the Treasury Lords on the petition of Charles Earl of Ancrum, praying a grant of such remaining part of that tin which was some years since cast away near Ostend as shall be recovered and gotten out of the sea at petitioner's charge. We have a large treaty with Alderman Backwell by which your Majesty was to have a moiety of all tin recovered and free of charge: but Mr. Custis, a merchant in Zealand, having proferred 1,000l. over and above said moiety in case 120,000lbs. weight of said tin should be fished up and so proportionably for what shall be recovered more or less, we have written to Sir William Temple to make a final agreement with said Custis. There are 1,199 blocks of said tin remaining in the sea and we have good cause to hope that a considerable part thereof may yet be recovered. Copy of an order of the King in Council concerning the paper of William Bucknall's enumeration of all the particulars which he intends to have comprehended within his proposal for farming the arrears of the King's revenue in Ireland: said order referring said paper for consideration to the Lords of the Treasury, together with the Lords of the Council of Ireland appointed a committee for what relates to the revenue of Ireland the Principal Secretaries of State, and the Attorney and Solicitor General. Appending:— Copy of said Bucknall's paper of particulars as follow as due to the Crown from 1659–60, Mar. 20, to 1667–8, March 20:—" Which I humbly expect in the covenants upon the agreement made with your Majesty upon the 18th of June last," this paper of particulars being now made by Bucknall in obedience to an order of Council of the 26th inst. All moneys due upon recognizances, statutes, contracts, agreements, records, specialities or otherwise, for any matter or cause soever, excepting all penalties upon the penal statutes where there is no duty arising to the Crown for which the penalty is enjoined: and in these and all other cases of this nature to have the like covenants as are granted to John Forth and William Bucknold et al. in the grant as abovesaid.
8. Prize goods and ships except the Genua ship and the goods at Galway, embezzlements of such goods and ships, seizures of goods exported or imported, preemption money, 5s. per ton upon French shipping, impropriate tithes, Clare and Connaught rents and decrees.
With liberty to the contractor to amend, enlarge, explain, &c., any of the aforesaid enumeration so as may be most suitable to this agreement and not oppressive to the people.

"And it is further directed that especial care be taken that all sheriffs in these cases be striotly apposed upon their process before the Barons of the Exchequer, that where the charge is good the money may be levied or the debtor's lands seized: and where the charge is short or uncertain it may be amended by the Auditor as is warrantable from the record. And it is further directed that where a rent is charged to be in arrear for eight years last past or since the general pardon that then the Auditor do certify by way of memorandum when, in time before, such rent was answered." Report to the King from the Treasury Lords concerning the case of Sir Thomas Strickland, Farmer of the duty on Scotch and foreign salt for 21 years at 1,800l. per an., who by order of Council of March 5 last is admitted an accomptant for the said duties for the year 1667, Sept. 29, to 1668, Sept. 29. His accompts, as stated, shew receipts of 1,869l. 11s. 3¼d. for that year. But for the same period the Customs officers of London port charge him to have received 27l. 12s. 0d. for the old farm and 1,341l. 13s. 11d. for the new farm and similarly the Surveyor of the Customs in the outports charges him to have received 1,021l. 16s. 7d. within the same time, making 2,391l. 2s. 6d. in all, which is a matter of 529l. 11s. 2¾d. more than said accomptant charges himself with. In reply hereto Strickland says that the 27l. 12s. 0d. of the old farm was due to old farmers of said duty and that he paid it to Sir Ralph Delaval et al., said old Farmers. For the rest he says that he had the King's directions to receive only 8s. 4d. a wey of Scotch salt until further order and to take bond for the remainder of the duty, and that betwixt 1667, Sept. 29, and 1608, April 29 he accordingly only received 8s. 4d. a wey for 975 weys and for the remainder took bond in 500l. of one James Cockburne. Strickland complains that as the trade stands at present between the two kingdoms this duty will not bear 1,800l. rent. But one Nathan Eldred. on behalf of the salt manufacturers of Shields and other parts of England has proffered, if the present farmer shall refuse to collect the duty laid by Act of Parliament on Scotch salt and to hold his patent on the present terms, that they will give good security for 1,800l. a year rent for that duty without defalcations.
