The Earl of Rochester reported, "That the Committee had considered the Bill for enabling Trustees to sell certain Lands of Richard Cooke, deceased, to pay Debts, and to raise Portions for his Daughters; and, having heard all Persons concerned, have made some Amendments therein, which the Committee offers to the Consideration of the House."

The Amendments were read Twice, and Agreed to; and the Bill is ordered to be engrossed, with the Amendments.

D. Norfolk, et al. and Lady E. Russel's Bill.

Hodie 2a vice lecta est Billa, "An Act to discharge the Duke of Norfolke and other Trustees, upon Payment of certain Sums of Money unto Dame Elizabeth Russell, Wife of Bartholmew Russell Esquire."

Papists who will take the Oath of Fcalty, Toleration Bill.

Upon Report from the Committee for the Bill, intituled, "An Act for exempting Their Majesties Popish Subjects from the Penalties of certain Laws:"

It is ORDERED, That the said Bill be re-committed, in order to the drawing Clauses as followeth, to be added:

"A Clause to make the Bill temporary, That, instead of filling the Blank with the Fourth of May, a Clause be brought in, to empower the Justices of the Peace to tender the Oaths to all the Papists in and about the Town; and that the Papists be forced to attend the Justices, to take the said Oaths.

"That a Clause be added, That the Oaths being tendered to the Papists, upon their Refusal to take them, they shall, by a Penalty, be forced immediately to go out of the Town, and not go above Five Miles from their Houses."

ORDERED also, That the said Committee do meet on Thursday next, at Nine of the Clock in the Forenoon.

ORDERED, That Mr. Justice Dolben and Mr. Baron Nevill do attend the Lords Committees, appointed to consider of the Bill, intituled, "An Act for exempting Their "Majesties Popish Subjects from the Penalties of certain Laws," on Thursday next, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers.

Thwaites versus Deye et Ux.

The House being moved, "That a Day may be appointed for hearing the Cause, wherein James Thwaits is Plaintiff, and John Deye and his Wife are Defendants:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Wednesday the Eighth of January next, at Ten of the Clock in the Forenoon; whereof the said James T'waites is to cause timely Notice to be given to the Defendants, to the End they attend with their Counsel accordingly.

Wainwright versus Lilly, et al.

Upon hearing Counsel this Day at the Bar, upon the Petition of James Wainwright, complaining of some Proceedings of John Lilly and Christopher Yates, and Henry Glover; as also upon the Answers of the said John Lilley and Christopher Yates put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED, That the said Petition of James Wainwright be, and is hereby, dismissed this House.

Dod versus Burrows.

Upon reading the Petition of Thomas Burrowes Gentleman, praying a longer Time for answering the Petition and Appeal of Anne Dod Widow, and others:

It is ORDERED, That the said Thomas Burrowes hath hereby Time given him for answering to the said Appeal, until Tuesday the 14th Day of January next, at Ten of the Clock in the Forenoon.

Coke versus Fountain.

The House being moved, "That the Cause appointed to be heard To-morrow, wherein Andrew Fountaine is Plaintiff, and Edward Coke Esquire Defendant; and also the Cause whercin Edward Coke is Plaintiff, and Andrew Fountain Defendant, may have another Day appointed for that Purpose:"

It is ORDERED, That this House will hear the said Causes, by Counsel on both Sides, at the Bar, on Tuesday the Seventh Day of January next, at Ten of the Clock in the Forenoon.

Adjourn.
