PRAYERS.

The Earl of Rochester reported from the Committee, the Draught of an Address to be presented to the King, concerning the Papists.

Which was read, and agreed to with some Amendments; the Tenor whereof followeth:

Address to the King, to put in Execution the Laws against Papists.

"To the King's most Excellent Majesty.

"We Your Majesty's most faithful and loyal Subjects, the Lords Spiritual and Temporal in this present Parliament assembled, having received Information of great Numbers of Papists who have lately left their Habitations in their several Countries, and have resorted, and daily come, to the Cities of London and Westminster, which have been found dangerous to the Peace of the Kingdom, and may be so to Your Majesty's Person and Government, and hath been occasioned chiefly, as we conceive, by the not putting in Execution the several Laws and Statutes prohibiting Popish Recusants to come to London, or within Ten Miles thereof, do, for the better Preservation of the common Safety, most humbly beseech Your Majesty, that You would be graciously pleased to enjoin a more due and speedy Execution of all those Laws which restrain Papists from coming to London, or within Ten Miles thereof; and that, in order thereunto, Your Majesty will be pleased to issue out Your Royal Proclamation, requiring the Lord Mayor of the City of London for the Time being, and all Justices of the Peace, as they will answer the contrary at their Peril, to put in speedy Execution One Act made in this present Parliament, intituled, (fn. 1) An Act for amoving Papists and reputed Papists from the Cities of London and Westminst. and Ten Miles distant from the same; and that they do vigorously proceed in the Ways and Methods therein prescribed for the better discovering and amoving of them."

Edwards & al. versus Duvall.

After hearing Counsel at the Bar on Friday last, upon the Petition and Appeal of Sir Richard Derham Knight and Baronet, and Sir John Edwards Knight, from several Decrees made in the High Court of Chancery, in a Cause wherein John Duvall Esquire and Elizabeth his Wife (commonly called Viscountess Purbecke) and others were Complainants, against the said Sir Richard Derham and Sir John Edwards Defendants, complaining of several Things, as in the Petition are set forth; as also upon the Answer of the said John Duval Esquire, and Elizabeth (commonly called Viscountess Purbeck) his Wife, put in to the said Petition:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Sir Richard Derham Knight and Baronet, and Sir John Edwards Knight, be, and is hereby, dismissed this House; and that the Decree made by the late Lord Chancellor Jefferyes, from which they appealed, be, and is hereby, affirmed.

Goodridge versus Crossman.

Upon hearing Counsel this Day at the Bar, upon the Petition of William Goodridge; shewing, "That James Crossman, Vicar of Banwell, in the County of Somersett, having exhibited his English Bill in the Court of Exchequer, against the Petitioner, for Non-payment of Small Tithes; which he not answering, Crossman exhibited another Bill against him; which being read in Court Three several Times, the Court decreed all the Suggestions in the said Bill should be taken against the Petitioner pro Confesso, and he charged in Execution for Twenty Pounds Costs of Suit;" as also upon the Answer of James Crossman, Vicar of Banwell, in the County of Somerset, put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Petition of the said William Goodridge be, and is hereby, dismissed this House.

Thwaites versus Deye & Ux.

Whereas there is an Appeal depending in this House, wherein James Thwayts is Plaintiff, and John Deye and his Wife are Defendants, to which Appeal the said John Deye is to put in his Answer on Thursday next; which he cannot do, by reason his Writings are in the Country; and desiring longer Time for that Purpose:

It is ORDERED, That the said John Deye and his Wife have hereby further Time given them, for answering thereunto, until Thursday the 19th Instant, at Ten of the Clock in the Forenoon.

ORDERED, That the Lords with White Staves do attend His Majesty, with the Address of this House, for putting in Execution the Laws against Papists.

Vernatti to be attached, and his Papers secured.

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mr. Vernatty, now in Custody, do stand committed to the Gentleman Usher of the Black Rod attending this House: And it is further ORDERED, That the said Gentleman Usher do go to the Lodging of the said Vernatti, and secure his Papers, and seal them up in his Presence, and set a Guard on his House or Lodgings.

Partridge to attend.

ORDERED, That John Parteridge do attend this House To-morrow, at Ten of the Clock.

Adjourn.
