L. Hereford's Bill.

The Earl of Berkeley reported, "That the Committee for the Bill to enable the Lord Viscount of Hereford to make a Marriage Jointure, in regard of his Minority, have heard all Parties concerned; and their Lordships are of Opinion, That the said Bill is fit to pass as it is, without any Amendment."

To which the House agreed; and ordered the said Bill should be engrossed.

E. of Abingdon, Leave to be absent.

ORDERED, That the Earl of Abingdon hath Leave to go into the Country, for his Health.

Dodd versus Dawson.

Upon hearing Counsel this Day at the Bar, upon the Petition and Appeal of Tymothy Dodd, from a Decree in the Court of Chancery, made the Sixth Day of July, 1689, in a Cause wherein the said Tymothy Dodd and others are Defendants, at the Suit of William Dawson Complainant, complaining of the said Decree by the Lords Commissioners of the Great Seal of England; as also upon the Answer of the said William Dawson put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decree made by the Lords Commissioners of the Great Seal of England, from which the said Tymothy Dodd appealed to this House, be, and is hereby, reversed; and that the Order or Decree, mentioned in the said Petition to be made the Fifteenth Day of April, 1687, do stand, and is hereby confirmed.

Brooke versus Borman.

Upon reading the Petition and Appeal of Sir Robert Brooke Baronet and Dame Martha his Wife, Relict and Administratrix of Christopher Tomlinson deceased; shewing, "That George Borcman exhibited his Bill against Christopher Tomlinson, in the Court of Chancery, for an Accompt of the Profits of the Ballast-office, and the Accompt was stated; and complaining, that upon several Hearings in the said Court, charged them with Twelve Pence per Ton for Ballast, which they conceive they ought not to have done; and that the Court of Chancery hath let into the said Cause Sir Charles Porter, for a Demand of Fifty-three Pounds per Annum out of the said Office, as in the Petition amongst other Things is set forth; and praying Relief herein; and that the Defendants, Edward Crispe, Mary Marshall, and Anne Bourman, may answer thereunto:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Edward Crispe, Mary Marshall, and Anne Bourman, may have a Copy of the said Petition; and be, and are hereby, required to put in their Answer or respective Answers thereunto, in Writing, on Friday the 13th Day of December Instant; whereof the said Sir Robert Brooke and Dame Mary his Wife are to cause timely Notice to be given to the Defendants, to the End they answer accordingly.

Beake versus Berney.

Whereas there is an Appeal depending in this House, wherein Elizabeth Beake is Plaintiff, and Richard Berney Defendant; the House being this Day moved, on the Behalf of the Defendant, "That a Day may be appointed for hearing the said Cause:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Tuesday the Seventeenth Day of this Instant December, at Ten of the Clock in the Forenoon.

Adjourn.
