Bill for Relief of those who did not take the Oaths within the limited Time.
The Bishop of London reported from the Committee the Bill for Relief of such as have not taken Oaths within the Time limited, as fit to pass, with some Amendments.
Which, being read Twice, were Agreed to; and the Bill ordered to be engrossed, with those Amendments.
Long versus Neltrop.
Upon reading the Petition and Appeal of Nathaniell Long, complaining of several Proceedings and a Decree of the Court of Chancery, on the Second Day of July last past, when it was ordered the Cause should go before a Master, to see what was due for Interest on the Bond of Four Hundred Pounds, and to tax the Costs at Law and in the Court of Chancery, and other Things in the Petition set forth; and praying the said Decree and Proceedings may be reversed; and that James Nelthrop, Defendant herein, may appear, and answer the same:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said James Nelthrop may have a Copy of the said Appeal, and be, and is hereby, required to put in his Answer thereunto the 18th Instant, at Ten of the Clock in the Forenoon; and that, in the mean Time, all Proceedings in the Court of Chancery shall be, and are hereby, stayed; whereof the said Nathaniell Long is to cause timely Notice to be given to the said James Nelthrop, to the End he answer accordingly.
Countess Dowager of Winchilsea versus E. of Winchilsea & al.
Upon reading the Petition of Elizabeth Countess Dowager of Winchilsea, Relict and Executrix of Heneage late Earl of Winchilsea, deceased; shewing, "That the Lady Maidston, with the now Earl of Winchilsea her Son, and Mr. Leopold Finch, and their Accomplices, did, in an illegal Manner, and in Breach of the Privilege of Peerage, enter the Possession of the Petitioner;" as in the Petition, amongst other Things, is suggested:
After hearing what could be said by John Ayre, Samuell Hoyle, and Thomas Dade, at the Bar; it having not been made appear upon Oath, "That the Person of the Countess Dowager of Winchilsea hath been restrained from her Liberty" (as in the Petition is set forth); this House is of Opinion, That there hath not been any Breach of the said Countes's Privilege of Peerage committed by the Persons complained of in the said Petition.
Belbin versus Malden.
Upon hearing Counsel this Day, at the Bar, upon the Petition of Nicholas Belbin Gentleman; complaining of a Decree made by the Lord Jefferyes, the 25th Day of July, 1688, and other Things in the Petition set forth; as also upon the Answer of John Malden, Thomas Hawkes, Jeremia Dodson Clerk, William Freeman, Peter Shary, William Howard Esquire, William Wilkins, Richard Bowles, John Perkins, Francis Thredgold, William Searle, Anne Meakins, Susan Good, and Elizabeth Mills Widow, Defendants, put in thereunto:
After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition of Nicholas Belbin Gentleman, complaining of the said Decree, be, and is hereby, dismissed this House; and that the Decree made in the Court of Chancery, from which he appealed to this House, be, and is hereby, affirmed.
Message from the King, with Papers concerning L. Griffin's Commitment.
The Earl of Shrewsbury acquainted the House, That, pursuant to their Commands Yesterday, he had waited on His Majesty, with the Address of this House concerning the Lord Griffin's Commitment; and that, in Answer thereunto, His Majesty had ordered the Papers to be brought to the House, and they were in the Clerk's Custody:"
It is ORDERED, That the Papers sent to this House by His Majesty's Command shall be read To-morrow, at Ten of the Clock in the Forenoon, the First Business.
Mutiny Bill, Leave to bring in.
It is ORDERED, That his Grace the Duke of Bolton hath Leave given him to bring in a Bill for reviving the Act for punishing Mutineers and Deserters in the Army, and to prevent false Musters, and punish them that make them.
