Smith & al. versus Coleby.
After hearing Counsel at the Bar, in the Cause upon the Petition and Appeal of Alexander Smith, Anthony Fothergill, and Thomas Lambert, from a Decree made in the High Court of Chancery, wherein they are decreed to reconvey Lands, by them purchased, to one Alexander Coleby; as also upon the Answer of the said Alexander Coleby put in thereunto:
After due Consideration had of what was offered by Counsel on either Part thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Appeal of the said Alexander Smith, Anthony Forthergill, and Thomas Lambert, be, and is hereby, dismissed this House: And it is further ORDERED, That the Decree made in the Court of Chancery, from which they appealed to this House, be, and is hereby, affirmed.
King's Answer to Address for High Steward, &c.
The Lords with the White Staves reported, "That they have attended His Majesty, to desire that a Place may be prepared in Westminster Hall, where this House may fit for the Trial of the Earl of Stamford; and also to desire His Majesty to give Order for a Commission for a Lord High Steward, in order to the Trial of the said Earl of Stamford. And His Majesty hath given Order for them both."
Sir George Crooke's Bill.
Hodie 2a vice lecta est Billa, "An Act for vesting the Lands of Sir George Crooke Knight deceased, in Trustees, to be sold for the Payment of his Debts."
ORDERED, That the Consideration of this Bill is committed to these Lords following:
Their Lordships, or any Five or more of them; to meet To-morrow Morning, at Nine of the Clock, in the Prince's Lodgings; and having heard all Persons therein concerned, are to report the same to the House; their Lordships have Power to adjourn from Time to Time, as they shall see Cause.
Eaton & al. versus Lane, in Error.
Whereas this House had appointed to hear Counsel at the Bar on both Sides this Day, for George Eaton and others, Plaintiffs in a Writ of Error brought into this House, wherein John Lane is Defendant, upon the Errors assigned, and Diminution alledged by the said George Eaton and others Plaintiffs; upon hearing Counsel for the Defendant John Lane, and the Plaintiffs George Eaton and others not appearing, nor any Counsel for them:
It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgement of the Court of King's Bench, given for the said John Lane, recited in the Transcript of the said Writ of Error, be, and is hereby, affirmed; and that the said Transcript be remitted to the Court of King's Bench, to the End the said John Lane may have Execution of the said Judgement, as if no such Writ of Error had been brought into this Court: And their Lordships do further adjudge, That the said George Eaton and others, Plaintiffs in the said Writ of Error, shall pay, or cause to be paid, unto the said John Lane, the Sum of Ten Pounds for his Costs, by reason of his bringing the said Writ of Error into this House.
Williams versus Mellish.
This House being moved, on the Behalf of Edward Mellish, "That Nicholas Treevanion, William Delawood, Charles Blackhall, and Stephen Dearecroft, may be summoned to attend as Witnesses, at the Hearing of the Cause wherein Walter Williams is Plaintiff, and he Defendant:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Nicholas Trevanion, William Delawood, Charles Blackhall and Stephen Dearcroft be, and are hereby, required to appear at the Bar of this House on Monday the 23th of November Instant, at Ten of the Clock in the Forenoon; and hereof they may not fail.
