East India Company to be heard against it.
Upon reading the Petition of the Governor and Company of the Merchants of London, trading to The East Indies; praying, "That they may be heard, by their Counsel, at the Bar, against the Bill, intituled, An Act for the Importation of Salt-petre for One Year:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners shall be heard, by their Counsel, as desired, or any others for or against the said Bill, on Friday the Three and Twentieth Day of this Instant March, at Ten of the Clock in the Forenoon.
Bp. Exon versus Hele in Error.
After hearing Counsel, at the Bar, to argue the Errors assigned by Jonathan Lord Bishop of Exeter and Gawen Hayman, Plaintiffs in a Writ of Error brought into this House, the Two and Twentieth Day of February, One Thousand Six Hundred Ninety three, to which Sampson Hele is Defendant, upon a Judgement given in the Court of Common Pleas for the said Sampson Hele, and the Affirmation thereof in the Court of King's Bench:
After due Consideration had of what was offered by Counsel thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Judgement given in the Court of Common Pleas for the said Sampson Hele, and the Affirmation thereof in the said Court of King's Bench, shall be, and is hereby, reversed.
The Tenor of which Judgement, to be affixed to the Record to be transmitted, is as followeth; (videlicet,)
"Postea, scilicet, Vicesimo Secundo Die Februarii, Anno Regni Domini Will'i et Dominæ Mariæ nunc Regis et Reginæ Angl. &c. Sexto, Transcript. Parliamenti, visis et per Cur. ibidem diligent. examinat. et plenius intellect. tam Record. et Process. præd. ac Judic. super eisdem reddit. nec non Affirmation. ejusdem Judicii, quam præd. Causis pro Error. superius assignat. et allegat. maturaque Deliberatione inde habit. pro eo quod videtur Cur. Parliamenti præd. nunc hic quod in Record. et Process. præd. nec non Redditione Judicii præd. ac in Affirmatione ejusdem Judicii, manisest. est Errat.; considerat. est per eandem Cur. Parliamenti, quod Judic. præd. nec non Affirmatio ejusdem Judicii, ob Error. præd. et al. in Record. et Process. præd. existen. revocentur, adnullentur, et penitus pro nullo habeantur; et quod præd. Ep'us et Gawinus ad omnia quæ ipsi Occasione Judicii præd. ac Affirmation. ejusdem amiser. restituantur, &c. Ac superinde Record. et Process. præd. per Cur. Parliamenti præd. in prædict. Cur. dict.
