PRAYERS.

King's Answer concerning the Earl of Pembroke's Trial.

The Lord Treasurer reported, "That himself and the other Lords with White Staves, according to the Command of this House, attended His Majesty Yesterday, and presented to Him the Resolution passed in the Case of the Earl of Pembrooke; and humbly desired His Majesty, from this House, That a Commission of Oyer and Terminer may be issued out. And His Majesty was pleased to give Order presently to His Attorney General, to issue a Commission of Oyer and Terminer accordingly."

L. Freschevile, Precedent.

The Lord Privy Seal reported, "That himself and the other Lords waited upon His Majesty Yesterday, and presented to Him the Resolution of this House concerning the Lord Frescheville."

St. Asph Church, &c. and apropriating Rectries, Bill.

The Lord Bishop of London reported, "That the Committee had considered the Bill for the appropriating the Rectories of Llanhayder and Mouchant; and have made some Amendments therein, which are offered to the Consideration of the House."

The Amendments, being read Twice, were Agreed to; and the Bill ordered to be engrossed, with the Amendments.

The Bill concerning the Manor of Winsteed is to be read To-morrow Morning, the First Time.

The Duke of Norff. hath Leave to go into the Country for his Health.

Serjeant versus Serjeant.

Upon reading the Petition of Jane Serjeant, Widow; shewing, "That she being by Order of this House appointed to put in an Answer on Saturday last, to the Appeal of William Serjeant and Jane his Wife, from a Decree of the Court of Chancery made on her Behalf; which she could not do, by reason that Aaron Smith her Solicitor (who till within a few Days last past hath absconded himself) hath all her Papers relating to the said Cause in his Hand, and because that several Deeds necessary for the perfecting of her Answer are in the Custody of Sir Samuell Clark One of the Masters in Chancery, who cannot deliver them without Order, and therefore prayeth that she may have the Use of the said Deeds, and Time to put in her Answer till Saturday next; and that the Hearing appointed to be on that Day may be deferred:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir Samuell Clarke may deliver to the said Jane Serjeant Widow, or her Agent, the said Deeds in his Custody, taking Security for the safe Return thereof; and that the Gentleman Usher of the Black Rod attending this House (to whose Custody the said Aaron Smith now standeth committed) shall permit the said Aaron Smith, with a Keeper, to attend the said Jane Serjeant's Business, in order to her putting in her Answer to the said Appeal on Saturday next as is desired, and hearing of the said Cause; and that the Hearing then appointed to be had be, and is hereby, put off till Tuesday the 12th Day of this Instant March, at Ten of the Clock in the Forenoon, whereof the said Jane Serjeant the Widow is to cause timely Notice to be given to the said William Serjeant for that Purpose.

Nevile versus Novile.

Upon reading the Petition of Richard Neville Esquire, complaining of a Decree made in the Court of Chancery, on the Behalf of Anne Neville, on the Eleventh Day of July, 29° Car. 2di, in a Cause there depending between the said Anne Neville and John Nevile since deceased, concerning the Dower of the said Anne and other Matters therein contained, and the reviving of the said Decree against the Petitioner, and the Dismission of his Bill of Review, and praying that the said Decree may be set aside and reversed:

It is ORDERED, That the said Anne Neville may have a Copy of the said Petition, to which she is hereby required to put in an Answer in Writing on Monday the Eleventh Day of this Instant March, at Ten of the Clock in the Forenoon.

Small Tithes Bill.

ORDERED, That To-morrow the House be put into a Committee to read the Bill for the better Payment of Small Tithes.
