When the Parliament of the Commonwealth of England was violently and illegally interrupted, the twentieth of April, one thousand six hundred fifty three (notwithstanding the great and Chargeable War this Nation was then necessitated to be engaged in abroad) then were the Armies and Navies of this Commonwealth well provided for and paid, and the publique Treasure then in a readiness, far exceeding the Debts owing to, or for either of them. And when it pleased Almighty God wonderfully, the seventh of May last, to restore the Parliament, they found this Nation (through the evil Government and Management of affairs in the time of the said Interruption) engaged in a War with the King of Spain, and also the Land and Sea Forces and Navies at a vast (if not unnecessary) charge employed in Foreign Parts, and the Publique Debts contracted within the time of the aforesaid Interruption by the best Estimat that can yet be made, did amount unto two millions of pounds sterling and upwards: Whereby, and by other Exorbitances incident to (if not unavoidable in) Monarchical Government, a general discontent did arise, the which by false Brethren in conjunction with Papists, old Enemies-in-Arms, and other seduced persons, was fomented, as the fittest means for the effecting their wicked and trayterous designe of bringing in Charls Stuart, whom they had proclaimed to be King of England, hoping thereby to advance themselves, enslave the people of this Commonwealth, and to put again upon their necks and Consciences, the iron yoke of Tyrannie and superstitious Worship, having already to that purpose raised a new War, whereby the Parliament hath been necessitated to raise many new Regiments and Troopes, as also to Equippe many more Ships of War for the defence of this Commonwealth against those Rebels and Traytors, and thereby are (although otherwise very unwilling) necessitated for the ends aforesaid, and that the taking off Free-quarter and other mischiefs and inconveniences may be prevented to raise Moneys upon the People of this Commonwealth, as is hereby and here after set forth.

£100,000 monthly rate for 6 months on England, Scotland, and Ireland, for maintenance of Armies and Navies.; What proportion on England, Scotland, and Ireland respectively; Proportion of rates on several counties, etc., in England.

Be it therefore Enacted by this present Parliament, and the Authority thereof, And it is hereby Enacted and Ordained, That for and towards the Maintenance of the Armies and Navies raised and continued, and to be raised and continued for the defence of this Commonwealth, and for other the necessary and urgent occasions thereof, the Summe of One Hundred Thousand Pounds by the Moneth for six Moneths (that is to say) from the five and twentieth Day of December, One thousand six Hundred fifty nine, unto the four and twentieth day of June, One thousand six hundred and sixty, shall be Assessed, Taxed, Collected, Levyed, and Paid in the several Counties, Cities, Burroughs, Towns and Places of England, Scotland and Ireland, as is hereafter expressed, that is to say, There shall be Assessed, Taxed, Collected, Levyed and Paid as part of the aforesaid One hundred thousand pounds by the Moneth, for every of the said six Moneths, the sum of Three score and ten thousand Pounds in the several Counties, Cities, Boroughs, Towns, and Places within England. And there shall be Assessed, Taxed, Collected, Levyed and Paid as part of the aforesaid one hundred thousand pounds, by the moneth, for every of the said six moneths, upon the several and respective Counties, Cities, Boroughs, Towns, and Places in Scotland, the sum of twelve thousand pounds; And there shall be Assessed, Taxed, Collected, Levyed, and paid, as part of the aforesaid one Hundred Thousand Pounds by the Moneth, for every of the said six moneths, upon the several and respective Counties, Cities, Boroughs, Towns and Places in Ireland, the sum of Eighteen thousand pounds, by the several sums and according to the several Rates and Proportions, and in such manner as is hereafter expressed; that is to say, For every Moneth of the said Six Moneths upon the several and respective Cities, Boroughs, Towns and Places in England, as is hereafter set forth, that is to say,

Upon the County of Bedford, for every moneth of the said six moneths, the sum of nine hundred thirty and three pounds, six shillings and eight pence.

And be it further Enacted by the Authority aforesaid, That the Commissioners appointed by the Parliament for the Management of the Affairs of Ireland, or any two or more of them, shall be and are hereby Authorized forthwith to Nominate, Constitute and Appoint such Commissioners within Ireland for this Assessment, as they shall think meet, necessary and convenient.

Commissioners' first general meeting.

And be it further Enacted, That the severall Commissioners in this Act appointed, or by vertue thereof to be appointed for the several and respective Counties, Cities, Burroughs, Towns and Places aforenamed, shall meet together at the most usual and Common place of meeting, within each of the said Counties, Cities and Burroughs, Towns and places respectively, on or before the tenth day of February, One thousand six hundred fifty nine. And the said Commissioners, or so many of them as shall be present at the said First General Meeting, or the major part of them, are hereby authorized and required to put this present Act in Execution according to the best of their Judgments and discretions, and shall then subdivide and distribute themselves so into lesser Numbers, as two or more of the said Commissioners may be appointed to the service of each Hundred or other Division, and as may best induce to the carrying on of the publique service by this Act required. And for the more effectual performance thereof. Be it Enacted, That the Commissioners at the aforesaid first General Meeting, or the Major part of them, shall agree and set down in writing, who and what number of the said Commissioners shall Act in each of the said Divisions, or Hundreds, to the end that there be no failer in any part of the due execution of the service by this Act required.

Assessors.; Assessment to be by pound-rate.; Copy of assessments to be delivered to Commissioners.; Sub-Collectors.; How assessment to be collected, and to whom and when paid in.

And be it Enacted by the Authority aforesaid, That the Commissioners within the severall Divisions or Hundreds, or any two or more of them, are hereby authorised and required to cause the said several proportions, charged on the respective Divisions, and on every Parish and place therein for the whole six Moneths Assessment, to be at once equally assessed and taxed. And to appoint two or more Assessors in each Parish or Place for the perfecting thereof, who are hereby required with all care and diligence to assesse the same equally by a pound rate as formerly, according to all Estates both reall and personal within the Limits, Circuits and Bounds of their respective Parishes and places. And for the Compleating of the whole sum charged upon the same, and to the end the aforesaid sums charged upon the several and respective Counties, Cities, Burroughs, Towns and Places may be equally and indifferently assessed according to the true intent of this Act, and the money duly collected, and true accompt thereof made, The said Assessors are hereby required to deliver one copy of their respective Assessments fairly written and subscribed by them unto the said Commissioners. And the said Commissioners, or any two or more of them, are hereby ordered and required to sign and seal two Duplicates of the said Assessments, and the one of them to deliver or cause to be delivered, to one or more honest and responsible Person or persons, to be Sub-Collector or Sub-Collectors, which the said Commissioners are hereby authorized to nominate and appoint for each Parish or place, with warrant to the said sub-Collector or sub-Collectors, to collect the first three moneths of the six moneths Assessment together and at once, so as the sum may be fully paid in to the Head-Collectors, to be nominated and appointed by the said Commissioners to receive the same so timely as the full sum of the said three Moneths Assessment charged upon each Hundred or Division, Parish or place, may be wholly paid in and compleated to the Receiver-General at or before the tenth day of March, 1659. And to collect the other three Moneths Assessment, so as the same may be fully paid in to the said Head Collectors, and by them to the Receiver General, to compleat the whole Six Moneths Assessment at or before the tenth day of May, 1660. at the furthest. And the said Commissioners are hereby required to deliver or cause to be delivered, the other of the said Duplicates, of each Parish or place to the Receiver General of each County, City, Town, or place respectively, to be by him the said Receiver General, transmitted to the Treasurers at War, which the said ReceiverGeneral is required to perform accordingly.

Head-Collector.

And be it Enacted, That the said Commissioners in the respective Divisions or Hundreds, or any two or more of them, shall and are hereby impowred to nominate and appoint under their Hands and Seals, an honest, able and responsible person to be Head-Collector, unto whom the Moneys received by the sub-Collectors within the said Division or Hundred, shall from time to time be duly paid; and the said Head-Collector is hereby required upon the receipt thereof to pay the same forthwith to the Receiver-General of each County respectively.

Receiver-General.; Receiver-General to pay in moneys to Treasurers at War.; His salary on clearing his account.; Sub-Collectors salaries.; Head Collectors' salaries; Commissioners' Clerks' salaries.

And be it further Enacted, That the said Commissioners for each County respectively in this Act named or by vertue thereof to be appointed, or the major part of so many of them as shall be present at the first General Meeting, are hereby authorized to nominate and appoint an honest and responsible Person, of whom sufficient Security shall be taken by the said Commissioners, to be ReceiverGeneral of the whole Assessment due from each County, City and Town respectively; and the particular Collectors and sub-Collectors are hereby required to pay in all and every the sums so received by them, to the said Receiver-General, aforesaid, who is hereby required forthwith to transmit or cause to be paid the Moneys by him received, unto the Treasurers at Warr, or where or to whom they shall appoint to receive the same: And the said Treasurers at Warr are hereby authorized to allow the said Receiver-General, in case he hath returned up to them a Duplicate of the Assessment of each Parish or place in County, City or Town for which he is appointed ReceiverGeneral, a Salary for his pains, not exceeding one penny in the pound, upon the cleering of his Accompt. And it is hereby Enacted, That the sub-Collectors of each Parish or Place which shall be appointed by vertue of this Act, shall upon the Collection of the whole sum appointed to be collected by them, and payment thereof as is hereby and before appointed, have and receive for their pains in collecting and paying the Moneys, one peny in the pound, which the said severall Head-Collectors are hereby authorized to pay unto them. And the several Head-Collectors which shall be appointed by vertue of this Act, shall upon the payment of the whole sum, due from their Hundred or Division, to the Receiver-General of each County, have and receive for their pains in receiving and paying the said Moneys, one peny in the pound, which each Receiver-General is hereby authorized to pay and to allow unto them accordingly. And also upon the receipt of the whole Assessment of the County, City or Town for which he is appointed Receiver General, in case he hath received the severall Duplicates of each Parish or Place, therein and not otherwise to allow and pay according to such Warrant as shall be in that behalf given by the said Commissioners or any three of them, one penny in the pound to the Commissioners Clerks for their pains in fair writing the Assessments, Duplicates, and Copies.

Proviso concerning Head-Collectors

Provided, That no Head-Collector shall be appointed for any City or Town which is by this Act particularly charged with the payment of any sum towards the Assessment hereby to be levied, and for which a Receiver-General is to be appointed, excepting within the City of London.

Distress or refusal to pay.; Assistance.; Commissioners to settle differences between distrained and distrainers.; Where no distress, offenders to be imprisoned and estates sequestered.; Tenants to pay rates and deduct landlords' share from rent.

And Be it Enacted, That if any Person shall refuse or neglect to pay any sum of money whereat he shall be rated or assessed, That then it shall and may be lawful to and for the said Collectors, subCollectors, or any of them (who are hereby authorized and required thereunto) to levy the sum assessed by distresse and sale of the goods of such persons so refusing or neglecting to pay, deducting the sum assessed, and reasonable charges of distraining, and restore the over-plus to the Owner thereof; and to break open in the day time any House, Chest, Trunk or Box, or any other thing where any such goods are, and to call to their Assistance the Constable, Tithingman, Headborough, and any of the Forces next adjacent to or within the Counties, Cities, Towns or Places, where any refusal, neglect, or resistance shall be made; which said Officers and Forces are hereby required to be aiding and assisting in the premisses, as they will answer the contrary at their perills. And if any Question or difference happen upon the taking of such distress between the parties distressed or distraining, the same shall be ended and determined by the said Commissioners, or any two or more of them. And if any person or persons shall neglect or refuse to pay his or their assessment, and convey his or their Goods or other personal Estate, whereby the sum of money so assessed cannot be levied according to this Act, then the respective Commissioners, or any two or more of them, are hereby authorized to imprison the person, and sequester the Estates of every such person for the advancement of the said Service, wheresoever the same may be discovered and found, And that the said Sequestration do continue, until the money so Assessed, and the Charges for bringing in the same be paid and satisfied, and no longer. And the several and respective Tennants or Tennant, of all Houses and Land, which shall be rated by vertue of this Act, are hereby required and authorized to pay such sums of money, as shall be rated upon such House or Land, and to deduct out of their rent so much of the said rates, as in respect of the said Rents of every such House and Land the Landlords should or Ought to pay and bear. And the said Landlords, both mediate and immediate, according to their respective interests, are hereby required to allow such deductions and payment upon the receipt of the residue of their rents.

Such tenants discharged from further payment.; Commissioners may settle differences between landlords and tenants.; And may relieve persons over-rated.; Directions for new assessment in places unassessed, etc.

And Be it Enacted, That every Tenant paying the said Assessment, shall be acquitted and discharged, for so much money as the said Assessement shall amount unto, as if the same had bin actually paid unto such person or persons, unto whom his rents should have been due and payable. And if any difference shall arise between Landlord and Tennant, or any other concerning the said rates, the said several Commissioners, or any two or more of them, in their several Divisions, shall and have hereby power to settle the same as they shall think fit. And if any person or persons shall finde him or themselves agrieved, in that the Assessors have over-rated him or them, and shall within six days after demand made of the summe of money assessed on him or them, complain to the Commissioners, who signed or allowed his or their Assessment, the said Commissioners, or the major part of them, who signed or allowed such Assessment, shall have and have hereby power within the said six dayes after the demand of the Assessement as aforesaid, to relieve such person or persons, and to charge the same on such other person or persons, as they shall see cause. And in case the Proportions set by this Act, upon all and every the respective Counties, Cities, Towns and Places, shall not be fully Assessed, levied, and paid, according to the true meaning thereof, or that if any of the said Assessements shall be rated and imposed upon any person, not being of ability to pay the same, or upon any empty or void House or Land where the same cannot be collected or levied, or, that through any other wilfulnesse, negligence, mistake or accident, the said Assessment charged upon each County, City, Town or Place by vertue of this Act, happens not to be paid to the said Treasurers at Warre as in this Act is directed, That then in all and every such Cases, the several and respective Commissioners, Assessors and Collectors aforesaid, and every of them respectively, are hereby authorized and required to Assess or Re-assess, or cause to be Assessed or ReAssessed, Collected, Levied and Paid, all and every such summe or summes of money, upon the respective Counties, Cities, Towns and Places, or upon any the Divisions Hundreds and Parishes therein, as to the said Commissioners, or such number of them, as by this Act are authorized, to cause the first Assessment hereby required to be made, shall seem most agreeable to Equity and Justice, the said new Assessment to be made, collected and paid, in such maner, and by such means, as in this Act for this Assessment is declared and directed.

Fines for neglect of duty in execution of Act.; Limit of fine.; To whom to be paid.

And Be it further Enacted by the Authority aforesaid, That if any person or persons shall wilfully neglect, or refuse to perform his or their duty, in the due and speedy Execution of this present Act, the said respective Commissioners, or any three or more of them, have hereby power to impose on such person or persons so refusing or neglecting their duties, such Fine or Fines, as to them shall be thought fit, and to cause the same to be levied by distresse and sale of his or their goods. Provided, That no Fine to be imposed by any of the said Commissioners, shall for any one offence exceed the summe of twenty pounds, And that all Fines that shall be imposed by vertue of this Act, shall be paid to the respective Receivers-General, and by them unto the Treasurers at Warre.

Receivers, Collectors, etc. detaining moneys to be imprisoned and their estates sequestered.; Commissioners may call general meeting for disposal of such estates.

And it is further Enacted, That if any Receiver General, Collector or Sub Collector, that shall by vertue of this Act be appointed for the receipt of any summe or summes or money, thereby to be assessed, shall neglect or refuse to pay any summe, or summes of money which shall be by him so received as aforesaid, and not pay the same, as in and by this Act is directed, and shall detaine in his or their hands any moneys received by them, or any of them and not pay the same as by this Act is directed, the Commissioners of each County, City or Towne respectively, (or any two or more of them in their respective Divisions), are hereby authorized and impowred to Imprison the Person, and seize, secure and Sequester the Estate, both real and personal of such Receiver-General, Collector, or Sub-Collector, their Heires, Executors, and Administrators, wherever the same can be discovered and found. And the said Commissioners who shall so seize, secure, and Sequester the Estate of any Receiver General, Collector or Sub-Collector, shall be, and are hereby impowered to appoint a time for the General meeting of the Commissioners of such County, City or Towne, at the common and usual place of meeting in each County, City and Towne, and thereof cause publique notice to be given at the place where such meeting shall be appointed tenn dayes at the least before such General meeting. And the Commissioners present at such General meeting, or the major part of them (in case the moneys deteined by the Receiver General, Collector or Sub-Collector, be not paid and satisfied as it ought to be, according to the Direction of this Act) shall, and are hereby impowred to sell, and dispose of all such Estates, which shall be for the causes aforesaid seized, and Sequestred, and satisfie and pay such County, and place, the summes that shall be so detained, in the hands of such ReceiverGenerall, Collector, or Sub-Collector, and return the over-plus to such Receiver-General, Collector, or Sub-Collector, their Heirs, Executors, and Administrators.

At expiration of six months Commissioners to assure themselves by examination of Collectors, etc., of full payment of assessment,; And to cause all arrears to be levied and paid.

And it is hereby further Enacted, That at the Expiration of the time in this Act prescribed for the second and full payment of the said Six Moneths Assessment, the severall and respective Commissioners, or any two of them, within the Division and Hundred, shall and are hereby required to call before them the Chief Collectors and Sub-Collectors within each respective Division and HunHundred, to examine and assure themselves of the full and whole payment of the particular summe and summes of money charged upon the said Division, Hundred, and every Parish and Place therein, and of the due return of the same into the hand of the ReceiverGeneral of the said County, City, Town, and Place respectively, and by such Receiver-General to the Treasurer at War, to the end there may be no failer in the payment of any part of the Assessment by vertue of this Act to be assessed and paid, nor any arrears remain chargeable upon any the said Counties, Cities, Towns, or Places respectively. And in case of any failer in the premisses, The said Commissioners, or any two of them, are hereby to cause the same to be forthwith levied and paid according to the true intent and meaning of this Act, and the Powers given them therein.

Determination of differences among Commissioners.

And it is hereby Enacted, That in case any controversies arise concerning the said Assessments, or the dividing, apportioning, or payment thereof which concern any of the Commissioners by this Act appointed, That the Commissioners so concerned in the said Controversies shall have no voice, but shall withdraw at the time of the Debate of any such Controversie, untill it be determined by the rest of the Commissioners.

No exemption of privileged place or person,; or of feefarm rents, annuities, etc.; Tenants of such rents and annuities to pay rates.; Indemnity to such tenants from further payment thereof

And be it hereby Enacted, That no Priviledged Place or Person, Body Politique or Corporate within the Counties, Cities, and Towns aforesaid, shall be exempted from the said Assessments and Taxes, but they and every of them, and also all Fee-Farm Rents, and other Rents of the late Kings Revenue, all Rents and other summs reserved by the late Court of Wards out of any Wards, Infants, or Lunatiques Estates, and all other manner of rents, payments, and sums of moneys and annuities issuing out of any Lands within any City or County, shall be lyable towards the payment of any sum by this Act to be taxed and levied: And all the Tenants of any Fee-Farm Rent, other Rent, sums of Money or Annuities aforesaid, are hereby directed and authorized to pay them proportionably according to the rates and assessments by this Act appointed and directed: And all such Tenants shall be hereby saved and kept harmlesse by Authority of Parliament, from any further payment of such portion of any such Rent, Rents, Sums or Annuities, either to the Exchequer, or to any other person or persons to whom any such Rent, Rents, Sums of money, or Annuities as aforesaid, should or ought to be paid to all intents and purposes whatsoever, as fully and as amply, as if they had paid the same in to the Exchequer, or to any other person or persons to whom the same is reserved and become due.

Double assessment on persons dwelling beyond the seas (merchants excepted).

And it is hereby further Enacted, That all such Persons who have left the Commonwealth and removed themselves beyond the Seas, to inhabit (except Merchants, whose Affairs do necessarily call them abroad, or such other Persons as are or shall be by Order of Parliament or Council of State, licensed thereunto) shall be assessed a double proportion upon the Lands, Stocks and Chattels, of what others for the Lands, Stocks and Chattels of the like value shall be assessed.

Colleges, hospitals, etc., exempted from assessment.

Provided also, That nothing conteined in this Act shall be extended to charge any Master, Fellow, or Scholler of any Colledge of Winchester, Eaton, or Westminster, or in any other Free-schools, or any Reader, Officer, or Minister of the said Universities, Colledges, or Schooles, or of any Hospitall, or Almes-Houses, for, or in respect of any stipend-wages, or profit whatsoever arising, or growing due to them, in respect of the said severall places, and Imployments in the said Universities, Colledges, Schooles, Hospitalls, or Almes-houses, nor to charge any of the Houses or Lands belonging to Christs Hospitall, Bartholomew, Bridewell, Thomas and Bethlehem- Hospitalls, in the City of London, and Burrough of Southwark, or any of them, for, or in respect of any Rents, or Revenues payable to the said Hospitalls, being to be received, and disbursed for the immediate use and relief of the poor in the said Hospitalls.

Tenants of said hospitals to enjoy no exemption.; Persons inhabiting City of London that dwell in one parish and have their business in another to be charged where they dwell.

Provided, That no Tenants who hold or enjoy any Lands or Houses by Lease, or any other grant from any of the said Hospitalls, do claim or enjoy any Freedome, Exemption or Advantage by this Act, but that all the Houses and Lands which they so hold, shall be rated and Assessed for so much as they are yearly worth over and above the Rente reserved and payable to the said Hospitalls.

Persons not inhabiting City but having their business there, likewise. No abatement by this Act.

Provided also, That where any person Inhabiting within the City of London, hath his dwelling-house in one of the Parishes or Wards therein, and hath any Office, goods or Merchandize, in one or more of the other Parishes or Wards within the same, That then such Persons shall be Charged, Taxed, and Assessed, for such his Office, Goods, or Merchandize in the Parish or Ward where he dwelleth, and not elsewhere in the said City.

Provided also, That where any person, Inhabiting without the City of London, hath any Office within the said City, That then such Person shall be taxed and assessed for such his Office in the place or Parish where he dwelleth and not elsewhere.

Commissioners accountable to Council of State.

Provided neverthelesse, That no Clause or Proviso in this Act, shall extend to the lessening or abatement of the full sum, by this Act appointed, to be taxed, leavied, and paid, but that the same be fully assessed, taxed, levied, collected and paid in the severall and respective Counties, Cities and Towns aforesaid, in such manner and form, and to such uses, as is herein before mentioned and declared: And that the several and respective Commissioners, and every of them, shall from time to time, give a true and perfect Accompt of all their doings and proceedings in the Execution of this Act, to the Councill of State, or to such other persons as the Parliament shall appoint.

Free-quarter forbidden.

And for as much as the moneys raised by vertue of this Act, are intended for the necessary maintenance and supply of the Armies and Navies, and other the necessary and urgent occasions of this Commonwealth, and to prevent the great inconveniencies, and burthen of Free-quarter, which otherwise would unavoidably fall upon the people of the Commonwealth; Be it Enacted by the Authority aforesaid, That no Officer, or Souldier whatsoever, may or shall presume to take or demand Free-quarter, or to quarter in the dwelling house of any person, or persons, except Inns, Taverns, Ale-houses, or other Common Victualling-houses, duly paying his or their Assessments, without his or their Consent first had and obtained.

Penalty for officers and soldiers that offend herein.; Damages to persons aggrieved.; Cashierment on second offence.

And in case any person or persons, whether Officers or private Souldiers, shall be offending herein, upon complaint and sufficient proof upon oath made thereof before two or more of the Commissioners for the monethly Assessments within such County, City or Town, where the Offence shall be committed, (who are hereby impowred to administer an Oath for that purpose) and upon Certificate of the same from them to the Committee of the Army, or other person or persons for that purpose appointed or to be appointed by the Parliament, within the space of fourty dayes next after the Offence committed, the said Committee, or other person or persons appointed for that purpose as aforesaid, are and shall hereby be authorized to defaulk out of the pay which either is or shall become due to the person or persons offending, treble the damage sustained by the party or parties agrieved, and to allow unto them the same; And in case any Officer or Officers, private Souldier or Souldiers, shall commit a second offence of this nature, he or they so offending shall be forthwith cashiered the Army.

Commissioners may alter manner of assessment where prejudicial

Provided alwayes, and be it hereby Enacted, That in case the way or manner of assessing by a pound rate, shall prove any way prejudiciall or obstructive to the speedy bringing in of the Assessement, or any part thereof appointed by this Act, That then, and in all such Cases, the respective Commissioners, or any two of them, are hereby Authorized to order and direct the respective Assessors (who are hereby required to proceed accordingly) to assesse the respective sums charged upon the respective Counties, Cities, Burroughs, Towns and Places mentioned in this Act, according to the most just, and usuall way of rates, held and practised in such Counties, Cities Burroughs. Towns or places respectively. Any thing in this Act to the contrary thereof contained in any wise notwithstanding.
