E. Mar & al. Attainder, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to attaint John Earl of Mar, William Murray Esquire commonly called Marquis of Tullibardine, James Earl of Linlithgow, and James Drummond Esquire commonly called Lord Drummond, of High Treason."

And, after some Time spent therein, the House was resumed.

And the Earl of Stamford reported from the said Committee, "That they had gone through the Bill; and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be read the Third Time To-morrow Morning.

Judgement to be given in Westminster Hall upon the Six Lords.

Ordered, That on Thursday the Ninth Day of this Instant February, at Eleven a Clock, this House will give Judgement, in Westminster Hall, upon James Earl of Darwentwater, William Lord Widdrington, William Earl of Nithsdaill, Robert Earl of Carnwath, William Viscount Kenmure, and William Lord Nairn, who have pleaded guilty to the Impeachment of High Treason exhibited against them by the House of Commons.

Message to H. C. to acquaint them with it.

And a Message was sent to the House of Commons, by Sir Thomas Gery and Mr. Rogers, to acquaint them therewith.

Lloyd versus Burton.

The House being moved, "That a Day may be appointed, for hearing the Cause depending in this House, wherein John Lloyd Gentleman and Mary his Wife are Appellants, and Cornelius Burton an Infant, by Sarah Burton his Mother and prochein Amie, Respondents:"

It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on Thursday the Sixteenth Day of this Instant February, at Eleven a Clock.

Purcell attached, for arresting Holdaway, the E. of Portland's Servant.

John Purcell, an Attorney, Plaintiff in the Arrest of Timothy Holdaway, menial Servant to the Earl of Portland, attending (according to Order):

He was called in; and examined, at the Bar, touching the Complaint of a Breach of Privilege against the said Earl.

As was also Solomon Smith called in; and examined, upon Oath, in relation to the said Complaint.

And being withdrawn;

Ordered, That the Gentleman Usher of the Black Rod attending this House, his Deputy or Deputies, do forthwith attach the Body of the said John Purcell, for arresting or causing the said Timothy Holdaway to be arrested and detained, during the Time of Privilege of Parliament; and keep him in safe Custody, until further Order of this House: And this shall be a sufficient Warrant on that Behalf.

To Sir William Oldes, Gentleman Usher of the Black Rod, his Deputy or Deputies, and every of them.
