Ordered, That Wednesday come Sevennight [ (fn. 1) is appointed] for hearing the Committee of the House of Commons to sum up their Evidence against the Archbishop of Canterbury.

Ordered, That Notice shall be given to all the Lords, to (fn. 2) attend the House on Wednesday next come Sevennight.

A Message was sent to the House of Commons, by Dr. Aylett and Dr. Heath:
To let them know, that this House hath appointed Wednesday next come Sevennight for the hearing the Committee of their House sum up the whole Evidence against the Archbishop of Canterbury.

A Message was brought from the House of Commons, by Mr. Whitlocke and others; which consisted of these Particulars, wherein their Lordships Concurrence is desired.

That this House agrees to the Ordinance for allowing Two Thousand Pounds a Month for Arms, &c. and to the Ordinance for Alderman Hoyle to be Lord Mayor of Yorke: To the rest of the Particulars of the Message, their Lordships will send an Answer by Messengers of their own.
Message to the H. C. that the Lords agree to the Committees for Oxon, &c. and to the Deputy Lieutenants for Rutland;
A Message was sent to the House of Commons, by Serjeant Whitfield and Dr. Heath:
To let them know, that this House agrees to the Persons to be added to the Committee for the Three Counties of Oxon, Bucks, and Berks; and desire that the Earl of Pembrooke, the Lord Viscount Say & Seale, the Lord Wharton, John Selden Esquire, and John Blagrave Esquire, be added to that Committee.
2. That their Lordships do agree in naming those Persons brought up this Day for to be Deputy Lieutenants for Rutland; and desire that Sir James Harrington and Colonel Waight be added to be Deputy Lieutenants of that County.
and for Committees to meet, to settle Differences between Commanders in Chief and Committees in several Counties.
3. To let them know, that the Lords, taking Notice of the great Differences between the Commanders in Chief and the Committees in several Counties, have nominated a Committee of Ten Lords, to consider of a Way for regulating the said Differences, and preventing Inconveniencies which may happen; and do desire the House of Commons would nominate a proportionable Number, to join with them; and to have Power to meet and adjourn from Time to Time:

Order for 2000 l. per Mensem from the Excise, for Arms, &c.
"It is this Day Ordered, by the Lords and Commons in Parliament assembled, That in regard of the great Necessity of making Provisions of Arms and Ammunition for the Public Stores, that the Commissioners of Excise be required and enjoined to comply punctually with the Ordinance for issuing of Two Thousand Pounds per Month to the Lieutenant of the Ordnance, for making of Provisions of Arms and Ammunition for the Public Stores; and that they do abate the said Monthly Sum of Two Thousand Pounds out of other Assignments, rather than this so necessary Service should fail."
"An Ordinance of Lords and Commons assembled in Parliament, whereby Thomas Hoyle Esquire, One of the Aldermen of the City of Yorke, and One of the Members of the House of Commons, is appointed to exercise the Power and Authority of the Mayor of the City of Yorke, until a new Mayor be there elected according to the Usage and Charters of the City.
Ordinance for Mr. Hoyle to be Lord Mayor of York.
"Whereas Sir Edmond Cowper Knight, One of the Aldermen of the City of Yorke, was heretofore (that is to say, upon the 15th Day of January, in the Year of our Lord God 1641) elected Mayor of the said City, from the Feast of Blase then following, for One whole Year then next ensuing; but, in the Year following (that is to say, upon the 15th Day of January, in the Year of our Lord God 1642), when the Election of a new Mayor should have been made, the same was interrupted and hindered by Force and Arms, so that no Election could be made according to the Usage and Charters of the said City; yet the said Sir Edmond Couper, howbeit his Office of Mayoralty did, according to the said Usage and Charters, determine upon the 3d Day of February, called Blase's-day, which was in the Year of our Lord God 1642; yet he the said Sir Edmond Cowper hath ever sithence, till this present Time, exercised the Place and Authority of the Mayor of the said City, which he hath so done without any just Ground or Warrant: Therefore the said Lords and Commons do Declare, That the Office and Place of the Mayor of the said City of Yorke is actually void; and that the said Sir Edward Cowper is not in Truth Mayor of the said City; and because there is no Mayor for the present there; and for that it is most fitting and necessary for the good and peaceable Government of the said City, that some able and faithful Person be trusted with the Power and Authority of the Mayor of the said City, until a Mayor be chosen there according to the Usage and Charters of the said City: The Lords and Commons, being well assured of the Ability and Fidelity of Thomas Hoyle Esquire, One of the Aldermen of the said City, and a Member of the House of Commons, hold him a Person fit to be intrusted with the said Place and Authority: Therefore the said Lords and Commons do hereby appoint and ordain the said Thomas Hoyle to exercise the Place, Office, and Authority of the Mayor of the said City of Yorke, until a Mayor be chosen there according to the Usage and Charters of the said City: And the said Lords and Commons do further Ordain, That he the said Thomas Hoyle shall exercise the Place and Authority of the Mayor there, and all and every Thing and Things as Mayor to do, which the Mayors of the said City, by Charter or any lawful Usage or Prescription, have done, or might do; and shall have, receive, and take, all the Profits, Advantages, and Emoluments, belonging, or in any Wise appertaining, unto the Mayor of the said City for the Time being, in as large, ample, and beneficial Manner, as any Mayor of the said City for the Time being heretofore had, used, or enjoyed the same; and do hereby will and require all and every the Citizens of the said City, and all and every other Person and Persons, that they give Obedience to the said Thomas Hoyle, as to the Mayor of the said City for the Time being, until a Mayor be chosen there, according to the Usage and Charters of the said City: And the said Lords and Commons do hereby give Leave to the said Thomas Hoyle, to take upon him the Trust and Charge of the said Office: Provided always nevertheless, and it is hereby Ordained, That the said Thomas Hoyle shall still continue a Member of the said House of Commons; and Provided also, and it is further Ordained, by the said (fn. 4) Lords and Commons, That this present Ordinance, nor any Matter or Thing therein contained, shall not in any sort whatsoever (fn. 5) be prejudicial, for the Time to come, to the Rights, Privileges, and Franchises, of the said City of Yorke, or of any of the Citizens thereof, in the Election of a Mayor within the said City; but that all and every Time and Times hereafter, when and as often as a new Mayor is to be elected there according to the Usage and Charters of the said City, the said Citizens or such Number of them to whom by Usage or Charters the Right of the said Election doth or shall appertain, may proceed to the Election of a new Mayor there, and may have, use, exercise, and enjoy, all their other Rights, Franchises, Liberties, and Immunities therein, in as free and ample Manner, to all Intents and Purposes, as they or any of them have at all Times heretofore held, used, exercised, or enjoyed the same; any Thing in this present Ordinance contained to the contrary hereof in any Wife notwithstanding."
