Ordered, That Mr. Serjeant Whitfield hath Leave to be absent from his Attendance on this House for Four or Five Days; and go to his House in the Country.

Pettus versus Bancroft and Aylett.

Upon reading the Petition of Katherine Pettus; shewing, "That, according to the Order of the 10th May last, she hath demanded the Monies thereby directed to be paid and secured unto her, but cannot receive the same, or get the Order obeyed, as by Affidavit appeared; therefore she humbly prays, she may enter upon the Lands formerly sequestered in Chancery for her Use, and confirmed by both Houses, and receive the Rents, Issues, and Profits thereof, until the Order of the 10th of May shall be obeyed and performed in all Points."

Hereupon this House Ordered, That the Defendant shall have a Copy of this Petition, and make Answer to the same by Thursday next.

Mrs. Roch's Petition.

Upon reading the Petition of Mary Roch: It is Ordered, That the Counsel desired in her Petition is hereby assigned to be of Counsel for her; and that the Escheator shall attend this House this Day Fortnight, to give an Account concerning the Office which should have been taken by him.

Mr. Aiske's Ordinance.

Next was read Once an Ordinance brought from the House of Commons, for making Mr. Ric'd Aiske (fn. 1) Coroner and Attorney of the King, in the Court of King's Bench.

Col. King and Capt. Rous.

Ordered, That Captain Rous and Colonel Kinge shall be brought (fn. 2) to this Bar on Monday Morning next, to have their Judgements pronounced against them.

Mr. Elliot's Ordinance.

An Ordinance concerning John Elliott Esquire was read the First Time.

Ordinance for cutting Wood on Mr. Hacon's Estate.

An Ordinance for cutting down some Trees upon Mr. Hacon's Grounds, in the County of Suff. was read the First Time.

Ordinance for associating Pembroke, Cardigan, and Carmarthen.

An Ordinance for associating the Counties of Pemb. Cardigan, and Caermarthen, was read Twice, and committed to the Consideration of these Lords following:

Any Three, to meet this Afternoon, at Three a Clock.

Ordinance for cutting Wood on Mr. Hacon's Estate.

The Ordinance for cutting down Mr. Hacon's Woods was read the Second Time; and Ordered to be committed to the former Committee, and to consider of it presently.

Ordinance for Col. Browne to command in Oxon, Bucks, &c.

The Lord Wharton reported the Ordinance concerning Colonel Browne to be Serjeant Major General of the Forces in the Counties of Bucks, Oxon, and Berks; which the Committee having considered of it, have thought it fit to offer some Alterations therein.

The Alterations were read, and approved of, and Ordered to be sent to the House of Commons, to desire their Concurrence to these Alterations.

Order for Thirty Pounds Worth of Books to Mr. Hexe.

The Order for giving Mr. Hexe Books to the Value of Thirty Pounds was read, with the Amendments made by the Committee; and it was Resolved, upon the Question, That this Order shall pass with the Amendments.

Message to the H. C. with it, and Colonel Browne's Ordinance; and concerning the Countess of Cleveland's Business.

A Message was sent to the House of Commons, by Sir Rob't Rich and Mr. Page:

To desire their Concurrence to the Ordinance concerning Colonel Browne, with the Alterations; and to desire Concurrence to the Ordinance for giving Thirty Pounds Worth of Books to Mr. Hexe, a plundered Minister, with the Alterations; and to desire them to call upon the Report concerning the Countess of Cleveland's Business.

Ordinance concerning a Pardon for the Prisoners in Newgate.

The Ordinance brought from the House of Commons, concerning a Pardon for the Prisoners in Newgate, was read, and committed to these Lords Consideration:

Any Three, to meet.

Ordinance for cutting Wood on Mr. Hacon's Estate.

The House was adjourned during Pleasure; and the Committee took into Consideration the Ordinance for cutting down Woods of Mr. Hacon, to the Value of Fifteen Hundred Pounds.

And the House being resumed;

The said Ordinance was read the Third Time.

And it being put to the Question, it was Resolved, To pass in the Affirmative.

Ordinance for associating Pembroke, &c.

The House was adjourned during Pleasure, to consider of the Ordinance for associating the Counties of Pembrooke, Cardigan, and Caermarthen.

The House being resumed;

The Committee (fn. 3) reported to the House, "That the said Ordinance was fit to pass, with some Alterations;" which Alterations being read, the House agreed to the said Ordinance, with the Alterations:

Ordinance for cutting Wood on Mr. Hacon's Estate.

"It is this Day Ordered and Ordained, by the Lords and Commons in Parliament assembled, That Mr. Thomas Southerton of Helsden, and Mr. Robert Woods of Howe, Two of the Committees for the County of Norff. shall and may, and are hereby required and authorized to enter upon the Grounds, Lands, and Possessions, in the Counties of Suffolke and Norff. belonging to Mr. Hacon, of Mutford, in the said County of Suff. a Popish Recusant, whose Estate is within the Ordinance of Sequestrations to be sequestered, and forthwith to fell and cut down, or cause to be felled and cut down, so many Timber Trees as do not exceed the Value of One Thousand and Five Hundred Pounds, and the same also forthwith to sell to the best Profit and Advantage that may be made thereof; and the Money due upon the Sale thereof to pay to Sir Walter Earle Knight, Lieutenant of the Ordnance, who is to receive the same upon Accompt, and to issue the same for the satisfying of several Debts due to Mr. Beresford, for Gunpowder by him provided for the Public Service of the State, and appointed by several Orders of the House of Commons to be paid unto him; and the said Thomas Sotherton and Robert Woods are to cause the Bark and Tops of all such Timber so felled to be likewise sold for the best Advantage; and they are to give Accompt in Writing unto the Standing Committee for the County of Norff. sitting at Norwich, who are to transmit a Copy thereof to the Committee of Accompts, and to the said Sir Walter Erle, how many Trees they so fell and cut down, and to whom the same is sold, and what Sum of Money is or shall be due for the same; and the said Thomas Sotherton and Robert Woods are hereby required, that they use their best Care and Diligence, that such Timber be selled and cut down as is of full Growth, and most fitting to be felled and cut down.

And it is further Ordered, That the said Thomas Sotherton and Robert Woods, and their Servants, or such as they shall employ in this Service, are to be saved harmless and indemnified, by the Power of Parliament, for all Acts done by them in Pursuance of this Ordinance; and that no Person do molest them in the Execution of this present Ordinance."
