Ordinance concerning Mr. Gamull's Legacy.

Next, an Ordinance was read Twice, formerly brought up from the House of Commons, concerning Tho. Gamul's Legacy, and committed to these Lords following:

Captain Rous, to attend.

Upon reading the Affidavit of Walter Aylworth and John Jesop: (Here enter it.) It is Ordered, That Captain Rouse shall appear before this House To-morrow Morning, to answer such Matters as shall be objected against him; and that Lieutenant Colonel Aylworth and Captain Rouse shall attend this House at the same Time.

Message to the H. C. for Committees to hear the Judges touching Writs of Error.

Ordered, To send a Message to the House of Commons, to desire that the Committees of both Houses may meet To-morrow Morning, at Eight of the Clock, in the Queen's Court, to hear the Judges what they can propose concerning Writs of Error.

And accordingly Sir Edward Leech and Dr. Aylett were sent down.

Ld. Willoughby and Colonel King.

Next, this House proceeded to hear the Evidence concerning the Complaint of the Lord Willoughby against Colonel Kinge; and it being debated whether the Counsel of Colonel Kinge shall go on with the Defence concerning the Lord Willoughby only, without Relation to his Officers;

And it being put to the Question;

It was Resolved in (fn. 1) the Affirmative.

The Counsel (fn. 2) were called in; and the Speaker signified (fn. 3) the aforesaid Resolution of this House to the Counsel of Colonel Kinge.

Ordered, That this House will take into Consideration this Business, the First Business To-morrow Morning.

The Messengers sent to the House of Commons return with this Answer:

That they have appointed their Committee to meet To-morrow Morning, in the Queen's (fn. 1) Court, as is desired. (fn. 4)
