Dymond discharged from being Sheriff of Camb.; and to be considered for his Losses.
Upon reading the Petition of Trystram Dymond, High Sheriff of the Counties of Cambridge and Huntingdon, shewing, "That he hath, to his great Charge, (fn. 1) kept Three Assizes, though Mr. Sackvill Wade was appointed by both Houses to be Sheriff for this Year:"
It is Ordered, That this House thinks it fit that he be discharged of his Office of Sheriff, and Recompence had of his Losses; and the Concurrence of the House of Commons to be desired herein.
The Earl of Warwicke reported a Paper from the Committee of Derby House; which was read, as followeth:
Instructions to be sent to the Commissioners in Scotl. about Berwick being surprized by some Malignants.
"Die Jovis, 4 Maii, 1648.
"At the Committee of Lords and Commons, at Derby House.
"Ordered, That it be reported to both Houses, That Instructions may be sent to the Commissioners of the Parliament now residing in Scotland, to signify to the Parliament of Scotland, That the Town of Barwicke is surprized by some Malignants, who were lately in that Kingdom; and, as we are informed, it is by some of those that were demanded from the Parliament of Scotland."
Ordered, That this House agrees (fn. 2) to this Report; and that it be referred to the Committee at Derby House, to draw the Instructions, and to present them to the Houses; and the Concurrence of the House of Commons to be desired herein.
Baker, for arresting Colebech.
Ordered, That if Baker do not proceed to trouble Ric'd Colebecke in his Action, Servant to the Earl of Dorsett, then he shall not be further questioned by this House for the same.
Ordinance to cancel Leonard's Bonds in the Court of Wards.
An Ordinance was brought in, for taking out some Bonds out of the Court of Wards, belonging to Mrs. Leonard; and being read, was passed, and ordered to be sent to the House of Commons for their Concurrence.
Message to the H. C. with it; for Dymond to be discharged from being Sheriff of Camb. and for Wade to act;—and about the Instructions for the Commissioners in Scotland.
A Message was sent to the House of Commons, by Sir Edward Leech and Mr. Page:
1. To deliver to them the Petition of the Sheriff of the Counties of Cambridge and Huntingdon; and desire their Concurrence, that he may be discharged for being any longer Sheriff, and Recompence to be made him for his Losses; and that Mr. Sackvill Wade may be enjoined to execute the said Office.
2. To deliver to them the Ordinance concerning Mrs. Leonard, and desire their Concurrence therein.
3. To deliver to them the Report from Derby House read this Day; and desire their Concurrence, that it may be referred to the Committee at Derby House to draw up Instructions to be sent to the Commissioners in Scotland, and report the same to the Houses.
Fisher and Blaithwayt.
Ordered, That the Cause between Fisher and Blathwaite shall be heard, this Day Sevennight, at this Bar, by Counsel on both Sides.
Draper and James.
This Day, Mr. Justice Rolls and Mr. Justice Pheasant being present, the Petition of Roger Draper, and the Answer of George James to the same were read.
And hearing the Opinion of the said Judges therein:
It is Ordered, That the Business is left to the Trial at Law; and that the Orders of the 24th of April, and of the 4th of May Instant, are hereby revoked.
Rawleigh and Vivers.
Upon reading the Petition of George Rawleigh; complaining, "That he is sued at Law, by Robert Vivers and others, for Matters done merely as a Soldier of the King's Party:"
It is Ordered, That the former Order of this House, of the 16th of June, 1646, is hereby revived, and be in Force; and that the Business shall be heard, at this Bar, by Counsel on both Sides, this Day Three Weeks.
Grigg and Rawtrey.
Upon reading the Petition of Mr. Grigg:
It is Ordered, That Mr. Wrawteray shall have a Sight of this Petition; and both Parties to be heard, by Counsel on both Sides, at this Bar, on Monday Morning next.
Eltonhead and Cockayne.
A Petition of Wm. Cockayne was read, wherein Mr. Eltonheade, One of the Masters of the Chancery and an Assistant to this House, is concerned.
It is Ordered, That the said Eltonheade shall have a Copy of this Petition, and put in his Answer on Monday Morning next.
Preaches at the Fast.
Ordered, That Mr. Vynes and Mr. Strong are appointed to preach before the Lords in Parliament, the next Fast-day, in the Abbey Church in Westm.
