An Ordinance for making Mr. Robert Wilkinson Vicar of Aclife, was read, and passed; and ordered to be sent to the House of Commons for their Concurrence.

Answer from the H. C.

Dr. Bennett and Sir Edward Leech return with this Answer from the House of Commons;

That they agree to these Particulars:

To all the rest, they will send an Answer by Messengers of their own.

L. Forbes and Col. Kempson.

Upon reading the Petition of the Lord Forbes:

It is Ordered, That the said Lord Forbes shall be released from his present Restraint; giving an Assignment to Colonel Kempson for so much as his Debt comes to, out of the Money which the State owes to the Lord Forbes.

Impeached Lords to put in their Answers.

That the Six Lords impeached by the House of Commons shall peremptorily put in their several Answers, to their several and respective Charges, this Day Three Weeks; and that all future Addresses to this House shall be made from them by Way of Petition.

Sheriff of Oxon to execute the Office, at his Peril.

Ordered, That the High Sheriff of the County of Oxon shall presently, upon Sight hereof, take the Office of Sheriff upon him, according to the Order of both Houses of Parliament, upon his Peril, and such further Punishment as shall be inflicted upon him.

General Order for Sheriffs.

Ordered, That this Order shall be general for all Sheriffs.

Message from the H. C. with Orders and Ordinances;- and with an Establishment for Officers of the Army.

A Message was brought from the House of Commons, by Sir Walter Erle Knight, &c.; who brought up divers Particulars, wherein they desire their Lordships Concurrence:

1. The Ordinance for giving Leave to the Sheriff of Warwickeshcire to (fn. 1) live out of the County, with an Alteration. (Here enter it.)

2. The Ordinance for giving Leave to the Sheriff of the County of North'ton to live out of the County. (Here enter it.)

Agreed to.

3. An Establishment for the Officers of the Army.

4. An Order for Sir Francis Willoughby to have Interest for Seven Hundred Pounds, out of Gouldsmithes Hall.

5. An Order for Dr. Josua Hall's Sequestration [ (fn. 2) to be] discharged. (Here enter it.)

6. An Order for Mrs. Mary Foliott to have One Hundred Pounds, out of Haberdashers Hall.

7. An Order for Mrs. Martha Pigott to have Two Hundred Pounds, out of Haberdashers Hall.

8. An Order for One Hundred Pounds (fn. 2) out of Haberdashers Hall, to Tho. Cave.

9. An Order for One Hundred Pounds out of Haberdashers Hall, to Rich. Elliott.

Sackvile to be Sheriff of Cambridge.

Resolved, upon the Question, That this House adheres to their former Vote, of Mr. Sackvill Wade to be High Sheriff of the County of Cambridge.

That this House agrees to the Alteration in the Two Ordinances for the Sheriffs of the Counties of Warwicke and North'ton to live out (fn. 2) of their Counties : To all the rest of the Particulars of this Message, their Lordships will take them into Consideration, and will send an Answer by Messengers of their own.

E. of Stamford, Leave to come from Scotland.

Ordered, That the Earl of Stamford hath Leave to return out of Scotland, about the latter End of April next, to go to The Bath, about recovering of his Health.

Message from the H. C. with a Declaration in Answer to some Papers of the Scots Commissioners.

A Message was brought from the House of Commons, by Sir Wm. Armyn Knight; who brought up a Declaration, being an Answer to some Papers of the Scotch Commissioners, wherein they desire their Lordships Concurrence.

Order to suspend the Privilege of Peers from those who left the House.

Ordered, That the Ordinance concerning Privilege of Peers to be dispensed with for a Time, shall be taken into Consideration To-morrow Morning, the First Business.

Papers from the Irish Committee:

The Earl of Northumb. reported divers Papers from the Committee at Derby House; which were read, as followeth:

For Ordnance to be sent to Ireland;

At a Committee of Lords and Commons for the Affairs of Ireland, at Derby House.

"Ordered, That it be reported to the Houses, That the Great Battering-piece now at Stafford, with its Equipage, may be sent into Ireland, to Colonel Jones, as also those at Chester."

Approved of; and ordered to be sent to the House of Commons for their Concurrence.

for Gen. Sterling and Marshall to be released;

"The Report concerning Colonel Sterlinge and Major Marshall to be discharged of their Service in Ireland, and that they also be discharged of their Imprisonment, and further Attendance here."

Ordered, That this House approves of this Report; and that it be sent to the House of Commons for their Concurrence.

and for Hawkins to be Commissary General for Ireland.

An Ordinance concerning Sir Jacob Astley, was read, and approved of.

Paper concerning the King's Children.

A Paper was presented to the House, by the Earl of Northumb. concerning the King's Children; and, being read, was approved of, and ordered to be sent to the House of Commons. (Here enter it.)

Clogie to be instituted to Wigmore.

Ordered, That Doctor Heath do give Institution and Induction unto Alexand'r Clogie Clerk, Master of Arts, unto the Vicarage of Wigmore, in the County of Hereford, void by the Resignation of the last Incumbent; salvo Jure cujuscunque: Presentation under the Great Seal of England.

Andrews, Sheriff of North'ton Leave to reside out of the County.

"Whereas Richard Andrewes Esquire is nominated and appointed High Sheriff of the County of North'ton, and is enjoined and required, by a certain Clause in the Oath to be taken by him the said Richard Andrewes for the Execution of the said Office, ["That he shall reside and be dwelling, in his own proper Person, within his Bailiffwick, for the Time that he shall be in the said Office, unless he be otherwise licensed by the Lords and Commons in Parliament :"] Be it therefore Ordered and Ordained, by the Lords and Commons in Parliament assembled, That the said High Sheriff shall have, and hereby hath, full and free Leave and Licence, and is permitted, to be absent from his Bailiffwick, and to dwell and reside out of the said County of North'ton."

Verney, Sheriff of War. Leave to reside out of the County.

"Whereas Grevill Varney Esquire is nominated and appointed High Sheriff of the County of Warwicke, and is enjoined and required, by a certain Clause in the Oath to be taken by him the said Grevill Varney for the Execution of the said Office, ["That he shall reside and be dwelling, in his own proper Person, within his Bailiffwick, for the Time that he shall be in the said Office, unless he be otherwise licensed by the Lords and Commons in Parliament :"] Be it therefore Ordered and Ordained, by the Lords and Commons in Parliament assembled, That the said High Sheriff shall have, and hereby hath, full and free Leave and Licence, and is permitted, to be absent from his Bailiffwick, and to dwell and reside out of the said County of Warwicke."

Pardon for Prisoners on the Oxford Circuit.

"The Lords and Commons assembled in Parliament do order and agree to the Pardon signed by Mr. Baron Atkins and Mr. Serjeant Clarke, for pardoning divers Prisoners, remaining in the several Gaols of Berks, Oxon, Salopp, Staff. and Wigorn; their Facts being some of them small, and their First Offences, and others the Evidence doubtful; whom the said Judges spared from Execution, certifying them to be fit Subjects of Mercy."

Sequestration taken off the Temporal Estate of Dr. Hall, late Bishop of Norwich.

"Ordered, by the Lords and Commons in Parliament assembled, That the Sequestration of all the Temporal Estate of Doctor Josua Hall, late Bishop of Norwich, and Elizabeth his Wife, be forthwith discharged: And all Committees of Sequestrations, Sequestrators, Solicitors, and others whom it may concern, are hereby required and enjoined to take Notice hereof; and to render full and speedy Compliance and Obedience hereunto."

Report from the Irish Committee, for Mr. Hawkins to be Commissary General for Provisions for Ireland.

Die Martis, 15 Februarii, 1647.

At the Committee of Lords and Commons for the Affairs of Ireland, at Derby House.

Ordered, That it be reported to both Houses, That it is the Opinion of this Committee, That there be a Commissary General of the Victuals continued for the Kingdom of Ireland, to be resident there, the better to reduce the Accompts of all Provisions to Order, and a certain Way of charging the same; and that, out of his Fee and Allowance, which by the Establishment is Twenty Shillings a Day for himself and Five Shillings for Two Clerks, he shall maintain One Deputy or Clerk in Connaught. Our Opinion also is, That Mr. Hawkins, appointed to that Service by the Lord Lisle, is a fit Man for that Place; and that his own Salary shall begin from the passing of his Ordinance, according to the Offer which he voluntarily makes, and be allowed him out of the Rebels Lands or Houses in Ireland, at such Time, and in such Manner, as both Houses of Parliament shall appoint, for Payment of Public Debts, or the Arrears of the Kingdom.

Paper from the E. of Northumb. desiring the Allowance for the King's Children may be duly paid, or that they may be otherwise disposed of.

The Allowance assigned by both Houses of Parliament for the Maintenance of the King's Children being very often behind and unpaid, by reason of divers Payments charged upon the King's Revenue, more than it can bear; my humble Request unto the Houses is, That either some Course may be taken for the certain Payment of those Allowances, or else that I may receive what is due unto me (thereby to discharge the Engagements that are upon me for the Service of the King's Children); and that they would be pleased to think of disposing of them some other Way; I not being able, in the Condition that my Fortune is, long to defray so great an Expence.

Swan's Ordinance to be Rector of Wells cum Ickham.

(fn. 3) Passed H. C. 15° Instant.

Whereas the Rectory of Wells cum Ickham, in the County of Kent, is become void, by the Death of William Kingsley Doctor in Divinity, late Incumbent thereof, the original Patronage of which Rectory did belong to the Archbishop of Canterbury: The Lords and Commons in this present Parliament assembled (to the End the said Parish and Rectory may be supplied with a learned, godly, and orthodox Divine) have Ordered, Ordained, and Appointed, and hereby do order, ordain, and appoint, John Swan Master of Arts, a godly, learned, and orthodox Divine, to be Minister of the said Rectory of Wells cum Ickham, in the County aforesaid; and that he shall and may have, hold, possess, and enjoy, the said Rectory and Parsonage-house, with the Appurtenances, and all the Glebe Lands, Tithes, Rents, Stipends, Pensions, Profits, Commodities, and Emoluments whatsoever, to the Rectory belonging, or in any Wise appertaining, in as large and ample Manner as the said Doctor Kingsley, the late deceased Incumbent thereof, or any other, lawfully or of Right hath had, or ought to have had, the same: Provided, That the said John Swan shall pay such Tenths, First Fruits, and other Duties, as ought to be paid for or in regard of his Incumbency there: Saving to all Bodies Politic and Corporate, and all other Person and Persons, all such Right and Title as they, or any of them, have unto the Patronage of the said Church and Rectory of Wells cum Ickham aforesaid, other than the Archbishop of Canterbury. And the Commissioners of the Great Seal are hereby authorized to pass under the Great Seal of England, unto the said John Swan, a Presentation unto the said Rectory, according to the usual Form."
