Liberties of the Subject.

THE House was adjourned, ad Libitum, to the End their Lordships might freely debate how to proceed in the Business concerning the Liberties of the Subject, demanded by the Commons.

Resumed;

Message sent to the House of Commons, by the Lord Chief Justice of the Common Pleas and Mr. Baron Trevor:

Message to the Commons, for a Conference touching this Point.

That the Lords desire a Conference, at Two this Afternoon, in the Painted Chamber (if it may so stand with the Occasions of that House), between a Committee of both Houses, touching that great Matter which they have presented to the Lords, concerning the Liberties of the Subject; at which Conference shall be shewed unto them the Passages thereof in this House. And for this great Business their Lordships desire that such * whom they shall appoint to that Purpose may come, prepared to answer any Objection or Doubt that shall arise herein.

Answer.

Answered:

The Commons will be ready to give Meeting to this House, at the Time and Place appointed.

The King's Learned Counsel withdrew, to prepare themselves for this Conference; and Mr. Attorney received from the Clerk all the Papers and Copies concerning the same.

E. of Devon's Bill.

Hodie 3a vice lecta est Billa, An Act concerning the Inheritance, Freehold, and Possessions of William Earl of Devon.

Put to the Question, and generally Assented unto.

Lamplugh's Petition.

The Earl of Bridgewater reported to the House, That Anthony Lamplagh, Esquire, hath exhibited a Petition, to be relieved here, touching an Injunction granted by the Lord Bishop of Lincoln, late Lord Keeper, for Stay of his Proceedings at the Common Law, against the Warden of The Fleet, touching an Escape of a Prisoner from thence: That the Lords Committees for Petitions have considered thereof, and their Lordships do not find any Imputation laid on the said Lord Bishop of Lincoln, in the said Petition. But they found the same to be unjust and scandalous against the Lord Keeper that now is, for which they left the Petitioner to the Judgement of the House. And as touching the dissolving of the said Injunction, the said Committee are of Opinion, that the same be referred to the Chancery, according to the Merits of the Cause, as it shall appear upon the Hearing.

The House, taking this into Consideration, did Order, That, for the dissolving of the Injunction, Complaint of it is left to the Lord Keeper, to proceed as he shall find Cause, upon the Merits of the Cause, upon hearing thereof; and, upon further Debate of the said Petition, their Lordships found an unjust Imputation laid upon the said Lord Bishop of Lincoln also, and that the said Petitioner deserves to be censured for them both; which Censure was agreed on, in this Manner:

His Censure.

"The Censure of the Lords Spiritual and Temporal against Anthony Lamplugh, Esquire:

"1. That the said Anthony Lamplugh, shall stand committed to The Fleet, for exhibiting an unjust and scandalous Petition to the House, against the Lord Keeper, and against the Lord Bishop of Lincoln.

"2. That he shall acknowledge here at the Bar, that this said Petition is unjust and scandalous against the said Lords, and that he is sorry for it, and shall ask them Forgiveness for the same.

"3. That he shall be brought to the Chancery Bar, on the First Day of the next Term, and there shall make the like Acknowledgement, and ask the like Forgiveness, and then be discharged."

Ordered, If any presume to come to this Conference who are not of the House of Commons, they are to stand committed to The Fleet.
