Tales de Circumstantibus.

Hodie 1a vice lecta est Billa, An Act for granting of a Tales de Circumstantibus, in Trials of Assizes.

Lord Delawar's Privilege.

Willoughby arrested.

This Day, according to the Order of the 22d of this Month, Thomas Willoughby, Servant to the Lord Delawarr, was brought before the Lords, upon His Majesty's Writ of Habeas corpus cum causa, etc. directed to the Marshal of the King's Bench. The said Writ and Return being read, and Willoughbye's Petition, and the Petition of Cole (at whose Suit the said Thomas Willoughby was arrested), being also read; it appeared to their Lordships, That the said Willoughby was arrested presently after the Dissolution of the last Parliament, at the Suit of his own Bail, and was divers Days afterwards prayed in Execution by the said Cole, for a Debt of Two Hundred Pounds; for which the Lords did not think fit to punish the said Cole, but discharged him of his further Attendance; and the Lords were willing to have delivered the said Willoughby also, by Privilege of Parliament: But, for that it appeared that, after Willoughby was arrested, and in Prison, contrary to the Privilege of Parliament, divers other Debts and Executions were laid upon him, which are contained in the Return of the said Writ of Habeas corpus, etc. And the Lord Keeper moved the House, That the Judges might first deliver their Opinions, before the said Willoughby be delivered by Privilege of Parliament, whether those other Executions which were laid on him after the Expiration of the said Privilege, be also saved by the Statute of Primo Jacobi.

It was agreed, That the Judges shall, this Afternoon, at Four, attend the Committee for Privileges, and deliver their Opinions to their Lordships what Inconvenience it will be to those who, after the Privilege of Parliament ended, had laid their Executions upon him, if the House shall deliver the said Willoughby out of Prison by Privilege of Parliament.

Earl of Banbury's Precedency.

The Lords were put in Mind of the King's Desire touching the Earl of Banburye's Precedency; whereupon the Lords Committees for Privileges, etc. were appointed to treat with those Lords whom it doth concern in particular, and to accommodate the same. And those Lords whom it doth concern, and who are now in Town, to be at the said Committee for Privileges, at Three this Afternoon, and to be treated with therein. And those Lords who are absent to be treated with when they come.

Petition against Recusants to be presented post meridiem.

The Lord President signified to the House, That His Majesty hath appointed this Afternoon at Two, in the Banqueting Chamber, for both Houses to deliver the Petition against Recusants, etc.

Message to the House of Commons, to acquaint them with it.

A Message was sent thereof to the Commons, by Mr. Serjeant Crewe and Mr. Attorney General; who answered, That they will be ready at the Time appointed.

Petition read.

The said Petition, being fair ingrossed, was read.

Adjourn.
