Duke of Buckingham to put in his Answer to the Charge against him.

It was this Day Ordered, That the Duke of Buckingham may put in his Answer to the Charge of the Commons the first Sitting Day after Whitsontide.

The Lord President reported the Petition agreed upon by the Lords Committees for Privileges to be presented unto the King, which was read, in hæc verba: videlicet,

Petition to the King touching the Earl of Arundel.

"May it please Your most Excellent Majesty,

"Whatever our Care or Desire is to preserve our Right of Peerage; yet it (fn. 1) is far from our Thoughts either to distrust or to press any Thing that stands not with the Affection and Duty of most loyal and loving Subjects; and therefore, in all Humility, we cast ourselves before Your Majesty; assuring ourselves, in that Sacred Word of a King, that with all possible Conveniency Your Majesty will please either to restore the Peer to his Place in Parliament, or express such a Cause as may not infringe our Privilege."

Which was generally approved of; and Ordered to be presented unto His Majesty by the whole House. And the Earl of Carlile and the Lord Carleton to go presently, and know the King's Pleasure when they shall attend His Majesty.

Who, being returned, reported, That His Majesty hath appointed this Afternoon, at Two of the Clock, for the same.

Duke of Buckingham's Counsel.

The Lord President also reported, That the said Committee for Privileges, etc. think fit that the Duke of Buckingham's Request be allowed, for Serjeant Richarson, Serjeant Crewe, and Serjeant Damporte to be of his Counsel (though the King's Serjeants), if His Majesty shall be pleased to give them Leave.

After long Debate; it was Ordered, The Serjeants Oaths to be brought hither To-morrow, and the Judges to be here then.

Lane versus Baud.

The House being moved to consider of the Petition of Robert Lane, exhibited this Parliament, against Fardinando Baud, complaining that, by a Decree in Chancery (Anno 43° Elizab.), unduly procured by one Thomas Pagett, deceased, contrary to the Meaning of the then Lord Keeper, he the said Roberte Lane was debarred to sue at the Common Law for the Manor of Wallgrave, and other Lands mentioned in one Deed Indented, bearing Date the 4th Day of February, Anno 18° Eliz. the said Decree supposing the said to be fraudulent.

It was Ordered, The Cause between the said Lane and Baud to be heard on Monday come Sevennight, at the Bar, with Counsel on both Sides; and the said Lane to give Warning thereof unto the said Boude.

Ld. Colchester's Privilege, Gray arrested.

Upon the Complaint of Thomas Gray, Servant to the Lord Viscount Colchester, the Under-sheriff of Essex and divers others were Ordered to be sent for, to answer their Contempt of the Privileges of this House.
