A Message was brought from the House of Commons, by Mr. Conyers and others:

With a Bill, intituled, "An Act for laying several Duties upon all Soap and Paper made in Great Britain, or imported into the same; and upon chequered and striped Linens imported; and upon certain Silks, Callicoes, Linens, and Stuffs, printed; painted, or stained; and upon several Kinds of stamped Vellum, Parchment, and Paper; and upon certain printed Papers, Pamphlets, and Advertisements, for raising the Sum of Eighteen Hundred Thousand Pounds, by Way of a Lottery, towards Her Majesty's Supply; and for licensing an additional Number of Hackney Chairs; and for charging certain Stocks of Cards and Dice; and for better securing Her Majesty's Duties, to arise in the Office for the Stamp Duties, by Licenses for Marriages, and otherwise; and for Relief of Persons who have not claimed their Lottery Tickets in due Time, or have lost Exchequer Bills or Lottery Tickets; and for borrowing Money upon Stock (Part of the Capital of the South Sea Company) for the Use of the Public;" to which they desire the Concurrence of this House.

A Message was brought from the House of Commons, by Sir Robert Davers and others:

To return the Bill, intituled, "An Act to enable William Western Esquire, an Infant, to make a Settlement of his Estate upon his Marriage, notwithstanding his Infancy;" and to acquaint this House, that they have agreed to the same, with an Amendment, whereunto they desire their Lordships Concurrence.

Then the Amendment was read, and agreed to.

A Message was brought from the House of Commons, by Mr. Levinz and others:

To return the Bill, intituled, "An Act for selling certain Lands, Part of the Manor of Wightfield, alias Whitefield, and other Lands, in the County of Gloucesster, for the Payment of the Debts heretofore of Mary Fermor Widow, and of John More Junior, of Kirtlington, in the County of Nottingham, and Margaret his Wife;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Dunbar versus Erskin:

After hearing Counsel, upon the Petition and Appeal of William Dunbar, Second Son of Sir William Dunbar, late of Durn, Knight and Baronet, deceased, from a Decree of the Lords of Council and Session in Scotland, made on or about the Twenty-sixth Day of February One Thousand Seven Hundred and Six, and an Interlocutory Order in the same Cause, on or about the Fifteenth Day of July One Thousand Seven Hundred and Nine, for Stay of Execution upon the said Decree, made on the Behalf of Colonel John Erskin; and praying, "That the same may be reversed, and the Petitioner relieved therein, according to Justice and Equity:" As also upon the Answer of the said Colonel John Erskin put in thereunto; and due Consideration of what was offered thereupon:

Judgement reversed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That so much of the said Decrees, Orders, and Interlocutors, as are complained of in the said Appeal, and made in this Cause, whereby the Appellant's Execution was stayed, shall be, and they are hereby, reversed and set aside; and that the Lords of Council and Session in Scotland do order Execution to be forthwith issued, for the Sum of One Thousand Seven Hundred Twenty-seven Pounds, Three Shillings, and Ten Pence, Scotch Money, decreed to the Appellant William Dunbar; and for One Hundred and Twenty Pounds, Scotch Money, Costs, decreed to the Appellant by the Sheriffs of Edinburgh; and that the Lords of Council and Session do also forthwith order Interest to be computed and paid, for the said Sum of One Thousand Seven Hundred Twenty-seven Pounds, Three Shillings, and Ten Pence, Scotch Money, from the Time the same came into the Hands of the Respondent Erskin, until the same shall be paid back to the Appellant; and also that the Appellant shall have his full Costs for all his subsequent Proceedings before the said Sheriffs and Lords of Council and Session, since the Taxation of his Costs by the said Sheriffs; and that Execution be also forthwith issued for such Interest and subsequent Costs, after discounting of the Sum of Two Hundred Marks, paid to the Appellant by Alexander Duff, and mentioned in the Decree by the said Lords of Council and Session; and that the Lords of Council and Session do order the same to be done accordingly.
