Message from H. C. to remind the Lords of the Justices of Peace, Bill.

A Message was brought from the House of Commons, by Mr. Cholmondeley and others:

To put this House in Mind of the Bill, intituled, An Act for the better qualifying Justices of Peace, in that Part of Great Britain called England, and the Principality of Wales."

Delsey versus Sedgwick, in Error:

Upon reading the Petition of Adam Delsey, Defendant in a Writ of Error brought into this House from Her Majesty's Court of Queen's Bench, the Second Day of this Instant June, wherein James Sedgwick is Plaintiff; shewing, "That the Plaintiff being indebted to the Petitioner in the Sum of One Hundred Forty-eight Pounds, Twelve Shillings, and Nine Pence, for Goods sold and delivered; the Petitioner, for Recovery thereof, brought an Action against the Plaintiff, in Error, in Her Majesty's Court of Common Pleas, in or about Michaelmas Term One Thousand Seven Hundred and Nine, upon which he declared; and though the Plaintiff in Error trades, and deals as a Merchant, yet he pleaded to the Action, "That he was a Cursitor in Her Majesty's Court of Chancery;" which Plea was set down and argued; and, being over-ruled, the Petitioner recovered Judgement for his Debt, and Thirteen Pounds, Seven Shillings, and Three Pence Costs, as of Trinity Term One Thousand Seven Hundred and Ten; upon which the Plaintiff brought a Writ of Error in the Court of Queen's Bench, where he assigned the General Errors, and the Want of an Original, by which the Petitioner was delayed until the End of last Term, when the Petitioner's Proceedings were all found regular, and according to Law; and Judgement was affirmed, and Twenty-eight Pounds given for Costs upon the Affirmance: But, the Session of Parliament being near an End, the Plaintiff in Error has brought another Writ of Error, returnable in Parliament, on Purpose for Delay; so that the said Cause cannot come on this Session; and the Petitioner, having no Bail on the said Writ of Error, is in Danger of losing his Debt; and praying, "That no Proceedings may be stayed by the said Writ of Error being brought into this House, or the Petitioner otherwise relieved:"

Writ of Error not to stop Execution.

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the bringing the said Writ of Error into this House shall not stay Execution on the said Judgement in the Court below.

Trade to America, Bill:

Hodie 2a vice lecta est Billa, intituled, "An Act for the Encouragement of the Trade to America."

Ordered, That the said Bill be committed to a Committee of the whole House, on Tuesday next, at Eleven a Clock.

Commissioners of Customs to give their Opinion thereupon.

Ordered, That the Commissioners of the Customs shall have a Copy of the said Bill; and do lay their Opinion thereupon, in Writing, before this House, on Tuesday next, at Eleven a Clock.
