Witnesses to Private Bills to be sworn at the Bar.

The House being informed, "That, upon the Reference of Petitions for Private Bills to the Judges, pursuant to the Standing Orders of this House, there arises some Difficulty, as to the Examination upon Oath of the Persons who are produced before them, to prove the Fact, as to the Merits of such Bills:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That, upon the Reference of any Private Bill to the Judges as aforesaid, the Judges to whom the said Bill shall be referred shall send to this House a List or Lists of such Persons Names as are to be sworn, in relation to such Bill; and that they shall be thereupon sworn, at the Bar of this House, in order to be examined by the Judges upon such Oath, in relation to the Bill before them.

Felons, &c. Bill.

Hodie 1^a vice lecta est Billa, intituled, "An Act for repealing a Clause in an Act, intituled, An Act for the better apprehending, prosecuting, and punishing Felons, that commit Burglaries, House-breaking, or Robberies, in Shops, Warehouses, Coachhouses, or Stables, or that steal Horses."

Ordered, That the said Bill be read a Second Time on the Second Day of the Sitting of this House after the Recess; and that the Judges do then attend.

D. of Marlborough's Bill.

The Lords Chief Justices and Lord Chief Baron delivered the Bill prepared by them, for settling the Honours of the Duke of Marlborough, pursuant to the Order of this House.

Then, Hodie 1^a vice lecta est Billa, intituled, "An Act for the settling of the Honours and Dignities of John Duke of Marlborough upon his Posterity, and annexing the Honour and Manor of Woodstock, and House of Bleinheim to go along with the said Honours."

Ordered, That the said Bill be read a Second Time To-morrow.

Elliott versus Davenport:

Upon reading the Petition of William Elliot Esquire; shewing, "That the Petitioner preferred his Appeal against George Davenport the Nineteenth of December One Thousand Seven Hundred and Five, to which George Davenport put in his Answer the Tenth Day of December last, which Appeal is appointed to be heard on Friday next;" and also shewing, "That the Parties have agreed, as appears by George Davenport's Consent, in Writing, Executor of Anne Davenport:"

Appeal withdrawn.

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said William Elliot hath hereby Leave given to withdraw his Appeal, according to the Prayer of his Petition.
